HomeMy WebLinkAbout911685.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JULY 31, 1991 TAPE 1191-21 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the law and bylaws of said Board at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, July 21, 1991, at the hour of 9:00 A.M. ROLL CALL: The meeting was called to order by the Chairman and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Gordon E. Lacy, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C. W. Kirby Commissioner W. H. Webster Also present: Weld County Attorney, Thomas O. David Acting Clerk to the Board, Carol Harding Finance and Administration Director, Don Warden MINUTES: Commissioner Harbert moved to approve the minutes of the Board of County Commissioners meeting of July 29, 1991, as printed. Commissioner Webster seconded the motion, and it carried unanimously. ADDITIONS: There were no additions to today's agenda. CONSENT AGENDA: Commissioner Kennedy moved to approve the consent agenda as printed. Commissioner Harbert seconded the motion, and it carried unanimously. PRESENTATIONS: RECOGNITION OF SERVICES - WILLIAM F. KIPP: Chairman Lacy read a poem written by C. A. Gray in regards to Mr. Kipp's retirement. Chairman Lacy also presented a plaque and a retirement pin to Mr. Kipp commending him for his service to Weld County. WARRANTS: Don Warden presented the following warrants for approval by the Board: General fund $244,619.33 Handwritten warrants: Payroll $ 3,292,82 Commissioner Kennedy moved to approve the warrants as presented by Mr. Warden. Commissioner Kirby seconded the motion which carried unanimously. Let the record reflect that a recess was taken at this time to allow the Board to convene as the Board of Social Services. BIDS: APPROVE COPIER - HEALTH DEPARTMENT: This bid, which was continued from July 17, 1991, was rejected in the July 24, 1991 Board meeting. 911685 BUSINESS: NEW: RECEIVE INTERIM REPORT FROM CLERK AND RECORDER ON INITIATIVE AND REFERENDUM PETITIONS: Mary Ann Feuerstein, Clerk and Recorder, gave an Interim Report on the Petition for Referendum on an Enacted Resolution, filed by the Concerned Citizens for Weld County's Future Committee, indicating there were 43 sufficient signatures and 2, 768 insufficient signatures. Since 1,897 valid signatures are required, the Committee will have 15 days to remedy the petition beginning August 1 and ending August 15, 1991 by filing new supplemental circulator affidavits and new supplemental petitions to meet the required number of signatures. Ms. Feuerstein also gave an Interim Report on the Petition to Initiate Amendment to Home Rule Charter for Weld County, filed by the Concerned Citizens for Weld County's Future Committee, indicating there were 37 sufficient signatures and 2,543 insufficient signatures. This petition also requires 1,897 valid signatures, and the 15 days indicated above to remedy the Petition is also in effect for this petition. No action is required by the Board at this time. Ms. Feuerstein also read a letter written in response to an inquiry from Weld CARES Committee regarding an Administrative Hearing, detailing the requirements of a formal protest. CONSIDER AMENDMENT #1 TO CVD PROJECT CONTRACT WITH STATE DEPARTMENT OF HEALTH AND AUTHORIZE CHAIRMAN TO SIGN: Jeannie Tacker, Weld County Health Department, explained the change on said Amendment to the Cardiovascular Project Contract is to extend the term through December 31, 1991. Commissioner Kennedy moved to approve said Amendment. Commissioner Kirby seconded the motion, which carried unanimously. CONSIDER REQUEST FOR RENEWAL OF 3.22 BEER LICENSE FROM CONO SERVICES, INC. , DBA CONOCO 1106355: Chairman Lacy read the Sheriff's report stating there were no violations for this establishment in the past year. Commissioner Webster moved to approve the renewal. Commissioner Kirby seconded the motion, which carried unanimously. CONSIDER EMERGENCY CLOSURE OF WELD COUNTY ROAD 33 BETWEEN WELD COUNTY ROADS 90 AND 94; AND TEMPORARY CLOSURE OF WELD COUNTY ROAD 47 BETWEEN WELD COUNTY ROADS 48 AND 50: Commissioner Kirby moved to close said roads. Seconded by Commissioner Harbert, the motion carried unanimously. CONSIDER RESOLUTION RE: INCREASE CHANGE FUND FOR WELD COUNTY CLERK AND RECORDER: Ms. Feuerstein explained this increase is necessary due to the IRS filing Tax Liens and being billed for them, instead of paying for them when completed. Commissioner Kirby moved to approve said increase. Commissioner Kennedy seconded the motion, which carried unanimously. PLANNING: CONSIDER RESOLUTION RE: VIOLATIONS OF THE ZONING AND BUILDING CODE ORDINANCES - COLORADO ENGINEERING EXPERIMENT STATION INC. , KINNEY, TRI-STATE COMMODITIES, VONFELDT, JOHNSON, GRIEGO, VINCEQUERRA, REESE, AND KOSS: Commissioner Webster moved to approve this Resolution authorizing the County Attorney to proceed with legal action against Colorado Engineering Experiment Station, Inc. , Robert Kinney, Tri-State Commodities, Victor and Martiel VonFeldt, Richard M. and Rita A. Johnson, Kenneth L. Griego, Dorothy Vincequerra, Daniel L. and Elizabeth B. Reese, and Joseph L. and Cynthia A. Koss for violations of the Weld County Zoning and Building Code Ordinances. Commissioner Harbert seconded the motion, and it carried unanimously. Minutes - July 31, 1991 Page 2 CONSIDER RE 111361 - HOFF: Brian Grubb, Department of Planning Services, read the unfavorable recommendation of the Planning staff into the record. This request is to split a 61.041 acre parcel into two lots of 48.684 acres and 14.369 acres. Charles Unfug, Attorney representing the applicant, explained their reasons for requesting the Recorded Exemption. The 14.369 acre parcel will be sold to Doris Carpenter to provide a "buffer zone" on the north side of her property, as well as preserve her view in a westerly direction. After discussion, Commissioner Kirby moved to approve Recorded Exemption #1361. The motion was seconded by Commissioner Harbert. Mr. Grubb asked that certain Conditions of Approval be attached to the Recorded Exemption, and read the four conditions into the record. The motion carried unanimously. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the consent agenda. There were no Ordinances. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board. NEW BUSINESS: CONSIDER NEW DIRECTIONS/JOB OPPORTUNITIES AND BASIC SKILLS PROGRAM INTRA-GOVERNMENTAL AGREEMENT BETWEEN SOCIAL SERVICES AND HUMAN RESOURCES AND AUTHORIZE CHAIRMAN TO SIGN: Commissioner Webster moved to approve said Agreement and to authorize the Chairman to sign. Seconded by Commissioner Kennedy, the motion carried unanimously. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
