RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR SINGLE FAMILY DWELLING UNIT ON A LOT UNDER THE
MINIMUM LOT SIZE IN THE AGRICULTURAL ZONE DISTRICT - CLINTON
AND JULIA WAREHIME
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 14th day of March, 1990 , at the hour of 10 : 00 a.m.
in the Chambers of the Board for the purpose of hearing the
application of Clinton and Julia Warehime, 22985 Weld County Road
61 , Kersey, Colorado 80644 , for a Site Specific Development Plan
and Special Review Permit for a single family dwelling unit on a
lot under the minimum lot size in the Agricultural Zone District
on the following described real estate, to-wit:
SW} NE* of Section 7 , Township 4 North, Range
63 West of the 6th P.M. , Weld County, Colorado
WHEREAS, said applicants were represented by Fred Otis,
Attorney, and
WHEREAS, Section 24 . 4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicants and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 .7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicants have shown compliance with Section
24 .4 .2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Weld County
Comprehensive Plan.

b. The proposed use is consistent with the intent of
the Agricultural Zone District. The proposal will
not remove prime agricultural land from production.
c. The use will be compatible with the existing
surrounding land uses and with the future
development of the surrounding area as permitted by
the existing zoning.
d. Special Review Development Standards will provide
adequate protection of the health, safety, and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for a
single family dwelling unit on a lot under the minimum lot size in
the Agricultural Zone District on the hereinabove described parcel
of land be, and hereby is, granted subject to the following
conditions:
1 . The attached Development Standards for the Special
Review Permit shall be placed on the Special Review plat
prior to recording the plat. The plat shall be
delivered to the Department of Planning Services and be
ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners.
2. The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.
3 . Prior to the issuance of building permits, a Weld County
Septic Permit shall be obtained for the proposed home
septic system and the system shall be installed
according to the Weld County Individual Sewage Disposal
Regulations.
4 . Prior to recording the Special Review Permit plat:
a. The applicant shall submit access agreement (s)
which will provide the right to use a minimum
25-foot access easement from Weld County Road 61 to
the site. The agreement shall include conveyance
of the right to cross the Lower Latham Ditch. The
agreement shall be recorded with the Special Review

Permit plat after approval by the Weld County
Attorney ' s Office.
b. The Special Review Permit plat shall be amended to
show the access easement at least 25 feet in width.
c. An erosion control plan, approved by the West
Greeley Soil Conservation District, shall be
submitted to the Department of Planning Services.
e. The following notes shall be placed on the plat:
i) Weld County does not provide access to this
parcel by public right-of-way or publicly
maintained roads.
ii) School bus transportation will be available on
Weld County Road 61 between Weld County Roads
46 and 48 . The requirements of School
District RE-7 must be met before school bus
service will be provided to the site.
f. The legal description of the easement shall be
shown on the Special Review Permit plat.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
March, A.D. , 1990.

1 . The Site Specific Development Plan and Special Review Permit
is for a single family dwelling unit on a lot under the
minimum lot size in the Agricultural Zone District as
submitted in the application materials on file in the
Department of Planning Services and subject to the
Development Standards stated herein.
2 . Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24, C.R.S. , as amended.
3 . The erosion conctrol plan approved by the West Greeley Soil
Conservation District shall be maintained on the site.
4 . The dwelling on the property may be a mobile home or other
dwelling unit.
5 . All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
6 . The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
7. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24 .6 of the
Weld County Zoning Ordinance.
8 . Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.
9 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.

10 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

A public hearing was conducted on March 14, 1990, at 10:O0 A.M. , with
the following present:

The following business Baas transacted:
_I hereby certify that pursuant to -a notice dated January 31, 1990, and
-duly published March 1, 1990, in The New News, a public hearing was
-conducted to _consider the application of Clinton and Julia Warehime for
a Site Specific Development Plan and Special Review Permit for a single
family dwelling unit on a lot under the minimum lot size in the
Agricultural Zone District. -Chairman $ranter informed all present
that, with only four Commissioners present for this hearing, if the
hearing should result in a tie vote, Commissioner Harbert would review
the record and listen to the tape of this hearing before casting the
deciding vote. Lee Morrison, Assistant County Attorney, made this
matter of record. Keith Schuett, representing the -Planning Department,
entered the Planning Commission's recommendation for approval of this
request into the record. Fred Otis, Attorney, came forward to
represent the applicant. Mr. Otis said that main issues of controversy
concerning this x-equest have been resolved. _Kim Lawrence, Attorney
representing the Lower Latham Extension Ditch Company, said the ditch
company withdraws its objection since the applicant-s have agreed to
limit the access to one bridge for this quarter section. Mr. Otis
submitted a letter from William Danks withdrawing his objections to
this request. Mr. Otis asked that the references to a 30-foot easement
in -Condition #4 be amended to refer to a 15-foot easement. He also
requested that the application be amended to reflect the new access
easement required by the use of only one bridge. Robert Frank came
forward to represent his father, who owns property adjacent on the west
of this property. Mr. Frank said the fence line is not on the surveyed
property line, and he requested that the applicant be required to
establish the fence line along the property line. Mr. Otis said this
information is not relevant to this hearing. Mr. Morrison advised the
Board that the established procedure for resolving this type of issue
does not involve the Board. After discussion concerning the
availablity of water on this parcel, Commissioner Lacy moved to approve
this request, subject to the Conditions and Development Standards
contained in the Planning Commission's recommendation, with Condition
#4 amended to refer to a 25-foot easement and subject to the additional
Condition that the legal description of the easement is to be attached
to the plat. The motion was seconded by Commissioner Kennedy. (Tape
change #90-18) Commissioner Lacy reviewed the criteria for approval of
a Special Review Permit. Commissioner Kirby stated that he would vote
for the motion, but he has concerns about the access for other homes
which may be approved in this area in the future. The motion carried
unanimously.

Pursuant to the zoning laws of the State of Colorado and the Weld County
Zoning Ordinance, a public hearing will be held in the Chambers of the Board
of County Commissioners of Weld County, Colorado, Weld County Centennial
Center, 915 10th Street, First Floor, Greeley, Colorado, at the time

Dear Ms Curry:
I represent the Lower Latham -Extension Ditch Company which is
concerned about the Warehime application No. 90-3 set for hearing
March 14 , 1990 at 10 :00 a.m. before the Commissioners . Access to
the Warehime property is by a bridge over the Lower Latham
Extension Ditch which was constructed pursuant to an Agreement
between the ditch company and the Warehime' s predecessor, William
A. Moore, a copy of which is enclosed.
A single -bridge to access this property was anticipated when this
agreement was made. The ditch company is opposed to having two
bridges across the ditch in this area as it makes maintenance and
operation of the ditch more difficult. One bridge should be
sufficient to provide access to all owners of property in the
northeast quarter of Section 7 .
The ditch company is opposed to the granting of the Warehime
application unless the following condition is attached :
1 . Access to the Northeast Quarter of Section 7 , Township 7
North, Range 63 West of the -6th P.M. , or any part thereof, over
the Lower Latham Extension Ditch shall be by a single bridge
which now exists pursuant to an Agreement dated February 26 ,
1985, recorded at Book 1063 , Reception No. 2O042-99 on April 2,
1985 .

AGREEMENT
THIS AGREEMENT made and entered into this 26th day of
February, , 11383, by and between the Lower Latham
Extension Ditch Company, hereinafter referred to as "Latham, " and
William A. Moore and Sylvia A. -Moore, hereinafter referred to as
"Moore, "
WITNESSETH:
WHEREAS, Moore is the owner of the Northeast Quarter of
Section 7 , Township 7 North, 12ange b3 West of the 6th P.M. , Weld
County, Colorado; and
WHEREAS, the Lower Latham Extension Ditch traverses the
property of Moore' s and Latham has an historical right-of-way for
the ditch through said property; and
WHEREAS, Moores wish to construct a road bridge over the
ditch and right--of-way of Latham on the Moore property.
NOW, THERE-FORE, in consideration of one dollar (-$1 . 00 ) and
other good and valuable considerations and the mutual promises
and covenants of the parties -hereto, it is agreed as follows :
1. Latham hereby grants to Moores the right to build said
road bridge and telephone line, maintain, alter and repair the
same across the right-of—way and ditch of Latham.
2 . Moores agree to construct and maintain the road bridge
in such a way that the bridge stringers shall be and remain a
minimum of five feet above the bottom of the canal.
3 . Moores agree to maintain said road bridge in working
condition, to clean any debris that might pile up and to keep
weeds and other objectionable material free and clear twenty-five
feet in all directions from the edge of the bridge.
4 . Moores agrein to make all necessary repairs or
maintenance upon the bridge so as to prevent it from obstructing
the flow of water in the ditch or prevent the accumulation of
debris around the bridge.
5. Moores further agree to indemnify and hold harmless
Latham on account of any damages sustained by Latham and from any
and all claims by any other party for damages against Latham
arising -by reason of the construction and location of the road
bridge across the Latham Mitch and right-of-way.

Dear Commissioners:
I am writing to oppose this application. My wife, Noblet
Danks, and I own the Southwest Quarter of Section 6.
In 1984 , the previous owners of our property (Holderness)
granted an easement to the previous owners of the Northeast Quarter
of Section 7 (Moore) . At that time, the Moore's owned the entire
quarter section. The easement -permits access to that property from
Weld County Road 61 along the southern boundary of our property.
If the application of the Warehime's is granted, additional people
will want to use the easement. We believe that the easement was
not intended for subdivided property.
We, therefore, will object to anyone using the easement if the
quarter section is divided. If the Warehimes wish to 'divide their
property, they need to make arrangements for access over another
route.
The only notice which we have received is for the March 14,
1990 hearing. We did not receive notice of any previous hearings.

and the Frasiers, -who plan to buy and improve the property, are driving from
Denver to help the Warehimes. The only _objection from any referrals is that
the school buses will not go to She door. This request -would be proper _use
of this property end it fits into the requirements of the Comprehensive
Plan. Fred Otis stated -he is rejecting the staff's recommendation -for
denial. They are not taking agricultural land out of production because
there are no water rights. Currently, -the land 1s essentially useless.

Julia Warehime, property owner, reported thrs _farm is -dryland and has not
been farmed that she is aware -cf. she people _buying the forty acres would
landscape their property and plant it to native grasses. There is already
and existing domestic well on the proposed -forty acre parcel.
The Chairman called for _discussion _from the audience.
Robert Frank, -whose father owns property -to the west, stated he has no
objections to this proposal.
Mrs. £rank Duell stated they used to farm this property. There are sonny
weeds on the property _because it was broken out of native sod and farmed.
-This quarter section did not have water with it, but they used water from
another quarter section on part of it, and -on the remainder of the land they
farmed 4ryland -grains.
The Chairman -asked Lanell Curry to road the _recommendation of the Department
of Planning Services' staff into the record.
The Planning Commission members asked Lanell Curry if the staff tad prepared
conditions of approval and development standards. These were _distributed to
the members of the Planning Commission.

Ken Lind, Attorney, represented the applicants. This request is for a
livestock -trailer washout facility. The request Ins been approved by the
State under the Solid Waste Disposal Regulations. Only the land forth of
the Ogilvey Ditch, -which is the washout facility area', will be fenced. This
property is a parcel of wasteland that will be turned into a profitable
venture. They have reviewed the staff recommendations and are taking
exception to Development standard 25. They would prefer following the
recommendations of the soil conservation district rather than returning the
land -to the original contours.
Judy Schmidt, -Weld County Environment Health Services, stated the applicant
is required to kelp a daily log of all activity. Also, the Health
Department #has set Strict standards for odor.
Cecil Crow, Alpha Engineering, reported the capacity of this facility is
engineered for approximately ten trucks per day. This is a contained system
so there is no danger of envizonmental contamination.

1. The Site Specific Development Plan and Special Review permit is for -a
single family dwelling unit on a lot under the minimum lot size in the
Agricultural zone district as submitted in the application materials on
file in the Department of Planning Services and subject to the
Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. The erosion conctrol plan approved -by the West Greeley Soil
Conservation District shall be-maintained on the site.
4. The dwelling on the property may be a mobile home or other dwelling
unit.
5. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
6. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
7. The property owner or operator shall be responsible for complying with
the Operation _Standards of Section 24.6 of the Weld County Zoning
Ordinance.
8. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to -ensure the activities
carried out on the property comply with the Development St-andards
stated hereon and all applicable Weld County Regulations.
9. The Special Review area shall to limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment -of the
Permit Joy the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
10. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of

1. She att-ached Development -Standards for the Special Review permit shall
be adopted and placed -on the Special Review plat prior to recording the
plat. The plat shall be delivered to the Department of Planning
Services and be ready for recording in the Weld County Clerk and
Recorder's office within 15 days of approval by the Board of County
Commissioners.
2. The Special Review activity shall hot occur nor shall any building or
electrical permits be issued on the property until the Special Review
plat is ready to be recorded in the office of the Weld County Clerk and
-Recorder.
3. Prior to the issuance of building permits, a Weld County Septic permit
shall be obtained for the proposed home septic system and the system
shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
4. Prior to _recording the Special Review permit plat:
- the applicant shall submit access agreement(s) which will provide
the right to use a minimum 30 foot access easement from Weld
County Road 61 to the site. The agreement shall include
conveyance of the right to cross the Lower Latham Ditch. The
agreement shall be recorded with the Special Review permit plat
after approval by the Weld County Attorney's -Office;
the Special -Review permit plat shall be amended to show the access
easement at least 3D -feet in width;
- an erosion control plan, approved by the West Greeley Soil
Conservation District, shall be submitted to the Department of
Planning Services; and
- the following notes shall be placed on the plat:
- Weld County does not provide access to this parcel by public
right-of-way -or publicly maintained roads; and
School bus transportation will be available on Weld County
Road 61 between Weld County Roads 46 and 48. The
requirements of school District RE-7 -must be met before
school bus service will be provided to the site.

1. The applicant has not demonstrated in the submitted application
materials that the standards and conditions of Section 24.3 of the Weld
County Zoning Ordinance have been met.
The proposal is not consistent with the Weld County Comprehensive Plan
-Agricultural Goals and Policies. The Comprehensive Plan discourages
conversion of agricultural land to residential development when the
subject site is located outside of a municipality's comprehensive plan
area or urban growth boundary area. The policy is intended to promote
conversion of agricultural land in an orderly manner that is in harmony
with the phased growth plans of a municipality and the County. It is
also intended to minimize the incompatibilities that occur between uses
in the agricultural district and districts that allow urban-type uses.
The policy is intended to minimize the costs to Weld County taxpayers
of providing additional public services in rural areas for uses that
_require services on an urban level. This parcel of land is not located
in an urban growth boundary area and is intended to remain agricultural
-rather than develop residentially.
-This proposal is not consistent with the intent of the Agricultural
zone district or with the future development of the surrounding area as
permitted by the existing zoning. The Agricultural zone district is
intended to provide areas for the conduct of agricultural activities
and activities related to agriculture and agricultural production
without the interference of other incompatible land uses. Agriculture
in Weld _County is considered a valuable resource which must be
protected from adverse impacts resulting from uncontrolled and
undirected land uses. The area is intended to remain agricultural in
tature.

- The use which would be permitted would not be compatible with the
existing surrounding land uses. Surrounding parcels of land are from
160 acres to 320 acres in size and are used for irrigated crops and
pasture. The creation of a nonirrigated 40 acre parcel in this area
for residential purposes is -not compatible with existing land uses.
- Adequate access is not available to the site. The applicant has
proposed a private access easement .75 miles in length from a public
road to the site. Public maintenance of the easement would not be
provided by Weld County. Concerns have been expressed by the Platte
Valley School District regarding school bus service. The School
District has stated that bus service would not be provided to the site
unless certain road standards are met. The cost of providing the road
improvements would be prohibitive to the applicant.

1. The attached Development -Standards for the Special Review permit shall
be adopted and placed on the Special -Review plat prior to recording the
plat. The plat shall be delivered to the Department of Planning
Services and be ready for secording in the Weld County Clerk and
Recorder's office within 15 days of approval by the Board of County
Commissioners.
2. The Special Review activity shall not occur nor shall any building ar
electrical permits be issued on the property until the Special Review
plat is ready to -be recorded in the -office of the Weld County Clerk and
Recorder.
3. Prior to the issuance of building permits, a Weld County Septic permit
shall be obtained for the proposed home septic system and the system
shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
4. Prior to re-cording the Special Review permit plat:
- the applicant shall submit access agreement(s) which will provide
the right to use a minimum 30 foot access easement from Weld

file in the Department of Planning Services and subject to the
Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. The erosion conctrol plan approved by the West Greeley Soil
Conservation District shall be maintained on the site.
4. The dwelling on the property may be a mobile home or other dwelling
unit.
5. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
6. The property owner or -operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
7. The property owner or -operator shall be responsible for -complying with
the Operation Standards -of Section 24.6 of the Weld County Zoning
Ordinance.
8. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
9. The Special Review area shall be limited to the plans shown -hereon and
governed by the foregoing Standards and all -applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County

As a representative of Platte Valley School District Re-# 7, the only response
I feel necessary to Case # USR-9O2 is relative to bus transportation.
Should the Warehime's or any future resident of said property require school
bus transportation, the following conditions would be required. School bus
transportation would be available at any location on W.C.Rd. 61 between
W.C.Rd. 48 and 46. For the residence to be eligible for student loading in
the yard, would require that the road be improved and maintained, including
snow removal , the road needs to be passible with a large vehicle such as a
school bus, that there be a turn-around place in the yard large enough to turn
the bus around without backing the vehicle, and that a bridge be provided
across the irrigation ditch. The bridge needs to be structurally rated by the
county for a vehicle the weight of a loaded school bus and must have railings
on each side to provide visual notice of the edges of the bridge.

Dear Department of Planning Services :
This letter is intended to comply with the Application
Requirements of the Use by Special Review Procedural Guide.
References to numbers below are to the specific references on
the Application requirements.
1 . A complete Application form is attached.
2 . A detailed description of the proposed use shall be
supplied. Julia and Clinton Warehime ("the Warehimes") own
the Northeast Quarter of Section 7, Township 4 North, Range
63 West of the 6th P.M. , Weld County, Colorado, containing
approximately 162 acres. Warehimes desire to sell the South-
west Quarter of their property to Larry and Sandra Frasier.
Larry and Sandra Frasier desire to build a home on the
conveyed property and, therefore, a Use by Special Review
( "USR") Permit is required. Accordingly, the property on
which the USR is requested is the Southwest Quarter of the
Northeast Quarter of Section 7, Township 4 North, Range 63
West of the 6th P.M. , Weld County, Colorado, containing
approximately 40 acres .
(a) Explain proposed use. See 2 above.
(b) Explain need for use. The Warehimes desire to Sell
a portion of their property to Larry and Sandra Frasier.
Larry Frasier has been helpful to Warehimes in maintain-
ing the property since Mr. Warehime was stricken with a
total disability due to a fall from a two-and-a-half-
story building in 1984 .
(c) Explain the types of existing uses on surrounding
properties. The surrounding properties are all in
agricultural use at the present time.
(d) The distance of the proposed use to residential
structures in each direction.

(h) Explain the access route (s) to be utilized for the
proposed use. The access route will be an easement along
the West 20 feet of the Northwest Quarter of the North-
east Quarter of Section 7, Township 4 North, Range 63
West of the 6th P.M. , Weld County, Colorado.
(i) Explain type, size, weight and frequency of vehicu-
lar traffic associated with the proposed use. The
vehicular traffic will be that associated only with a
single-family residence.
(j) The type of sewage facilities for the proposed use.

centrated on the Use by Special Review area at any one
time. It is anticipated that animals on the Use by
Special Review area will be those typically associated

(p) Explain proposed landscaping plans and erosion
control measures associated with the proposed use. After
construction of a home on the Use by Special Review area,
it is anticipated that the disturbed and unbuilt areas
will be replanted with pasture grass and the area
immediately around the house will be landscaped.
(q) Reclamation procedures to be employed upon cessation
of the Use by Special Review activity. n/a
(r) A time table showing the periods of time required
for construction and start-up of the proposed use. The
residence will be built within 90 days of the time the
Use by Special Review Application is approved depending
upon the weather.
3. The following written materials and supporting documents
shall be submitted as part of the Application:
(a) A statement explaining how the proposal is consis-
tent with the Weld County Comprehensive Plan. The
property on which the residence will be built is not
prime agricultural land. No property will be taken out
of production or away from agricultural uses.
(b) A statement explaining how the proposal is con-
sistent with the intent of the district in which the use
is located. The district is zoned agricultural . The
uses are consistent because no property is being taken
away from agricultural use and the disturbed areas will
be reseeded in pasture grass upon completion of the
project.
(c) If applicable, a statement explaining what efforts
have been made in the location decision for the proposed
use to conserve productive agricultural land in the
agricultural zoned district. No property is being taken
from agricultural production and all of the property is
being reseeded or landscaped on completion of the
project.
(d) A statement explaining there is adequate provision
for the protection of the health, safety and welfare of
the inhabitants of the neighborhood and the county. This
property is located a long distance from any other
inhabitants of the neighborhood and county. As is
indicated in Paragraph 2 (d) above, the only other
residential structures are at least one-quarter of a mile
away and will not be affected by the additional residence
contemplated by Applicants .

(e) A statement explaining, the uses permitted will be
compatible with the existing, surrounding land uses
(include a description of the existing land uses of all
properties adjacent to the property) . As indicated in
Paragraphs 2 (c) and 2 (d) above, there are agricultural
uses surrounding this property with a few residences
quite some distance away. The use by Applicants will be
harmonious and compatible with such uses.
(f) A statement explaining the proposed use will be
compatible with the future development of the surrounding
areas permitted by the existing zone and with future
development as predicted by the Comprehensive Plan of the
County or the adopted master plans of affected municipal-
ities. The residential use contemplated by Applicants
will be very similar and, therefore, compatible with the
surrounding uses and is certainly compatible with the
agricultural zone in which it is located. This property
is outside the zoning area of all municipalities.
(g) A statement explaining the Use by Special Review is
not located in a flood plain, geologic hazard and Weld
County Airport Overlay District or that the Application
complies with Section fifty (50) , overlay district
regulations as outlined in the Weld County Zoning
Ordinance. The Applicants ' property is not located in
a flood plain, geologic hazard or Weld County Airport
Overlay District.
(h) Proof that a water supply will be available which
is adequate in terms of quantity, quality, and depen-
dability (e.g. , a well permit or letter from a water
district) . See documents attached.
(i) A copy of the Deed or legal instrument identifying
the Applicants ' interest in the property under considera-
tion. If an authorized agent signs the Application for
the fee owner (s) , a letter granting power of attorney to
the agent from the property owner (s) shall be provided.
