RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR WELD COUNTY ASSESSOR DATA ELEMENTS
AND CITY OF GREELEY BUILDING PERMIT DATA AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement
for Weld County Assessor data elements and City of Greeley building permit data
between the County of Weld and the City of Greeley, commencing immediately, and
ending December 31, 1992, to be renewed automatically on a year-to-year basis,
with the further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement for Weld County Assessor
data elements and City of Greeley building permit data between the County of Weld
and the City of Greeley be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 28th day of September, A.D. , 1992.

INTERGOVERNMENTAL AGREEMENT
FOR
WELD COUNTY ASSESSOR DATA ELEMENTS
AND
CITY OF GREELEY BUILDING PERMIT DATA
THIS AGREEMENT, made this ) day of v /2t ra „ ,—, , 1992, by and between
the CITY OF GREELEY, COLORADO, with its principal place of business at 1000 Tenth
Street, Greeley, Colorado 80631, hereinafter referred to as "Greeley," and the
COUNTY OF WELD, STATE OF COLORADO, a county government with its principal place
of business being the Centennial Center, 915 Tenth Street, Greeley, Colorado
80631, hereinafter referred to as "Weld County", is subject to the following
agreed to terms:
A. This Agreement shall be effective immediately and shall continue
through December 31, 1992, and to be renewed automatically on a year
to year basis, except as provided in paragraph 4 hereof.
B. Greeley agrees to make available the requested Building Permit Data
in a form usable to Weld County and Weld County desires to acquire
said data.
C. Weld County agrees to make available the requested Assessor data
elements in a form usable to Greeley and Greeley desires to acquire
said data.
D. Greeley agrees that use of Weld County supplied data elements will
be for Greeley use only.
E. Weld County agrees that use of Greeley supplied data elements will
be for Weld County use only.
NOW THEREFORE, in consideration of the forgoing terms and in consideration of the
provisions, terms, and conditions set forth below, the parties agree as follows:
1. Acquisition of Data.
a. Greeley agrees to provide to Weld County that portion of the
Greeley Building Inspection Data Base that is public record
subject to the following limitations and conditions: 1) Weld
County shall, from time to time, submit a list of desired Data
Elements which Weld County deems to be of value, 2) Greeley
shall provide updates of the data requested by Weld County at
such time intervals as requested by Weld County, and 3)
Release of all data elements by Greeley subject to written
approval by the chief building official of the City of
Greeley. These data elements are itemized in Attachment "A".

b. Weld County agrees to provide to Greeley that portion of the
Assessor' s Data Base that is public record subject to the
following limitations and conditions: 1) Greeley shall, from
time to time, submit a list of desired Data Elements which
Greeley deems to be of value, 2) Weld County shall provide
updates of the data requested by Greeley at such time
intervals as requested by Greeley, and 3) release of all data
elements by Weld County is subject to written approval by the
Weld County Assessor. These data elements are itemized in
Attachment "B".
2. Charges and Fees.
a. Greeley agrees to provide to Weld County the requested
Building Permit data elements itemized in Attachment A at no
charge.
b. Weld County agrees to provide to Greeley the requested
Assessor data elements itemized in Attachment B at no charge.
3. Method of Delivery.
a. Greeley agrees to provide Weld County with the Building Permit
data elements via 9-Track 1/2-inch magnetic tape reels, which
shall be furnished by Greeley written at 6250 BPI.
b. Weld County agrees to provide Greeley with the Assessor data
elements via 9-Track 1/2-inch magnetic tape reels, which shall
be furnished by Weld County written at 6250 BPI.
c. Greeley agrees to format each record in the same manner and
agrees to apprise Weld County of the length of each record,
blocking factor, coding factors and other pertinent
information. Record length is described as fixed.
d. Weld County agrees to format each record in the same manner

e. Greeley agrees to provide Weld County with the file
descriptions and tape layouts of the material and all
necessary tables to decode the Building Permit data elements.
f. Weld County agrees to provide Greeley with the file

g. Greeley agrees to provide the desired Building Permit data
elements for all building permits issued within the most
recent twelve-month period. The data will be provided for the
most recent twelve-month period unless twelve-months of data
is not available in which case data for a period less than
twelve months will be accepted by Weld County. This data will
be provided by the tenth day of the month in the above
described format, except in the case of delay caused by
hardware or software failure, in which case delivery will be
as soon as possible after the repair of the failure.
h. Weld County will determine if a parcel is located within the
city limits of Greeley by determining if the parcel is
assigned to a taxing district that includes the City of
Greeley. This determination will be made using the most
accurate data available from the Weld County Assessor's files
as of the date being processed.
i. Weld County agrees to provide Greeley with one (1) initial
tape of data that contains data for all parcels, according to
the Weld County Assessor's files, that are located within the
city limits of Greeley.
j . Weld County agrees to provide Greeley with monthly updates to
the initial data commencing on the first Friday following the
fifteenth of each month or the first Weld County business day
thereafter. The monthly updates will contain data for any
parcel, according to the Weld County Assessor's files, that is
located within the city limits of Greeley, in which the
requested data elements changed.
4. Representations.
a. Greeley represents that it will use its best efforts to
provide accurate data to Weld County pursuant to the terms of
this Agreement. Greeley does not, however, guarantee the
accuracy of the data provided.
b. Weld County represents that it will use its best efforts to
provide accurate data to Greeley pursuant to the terms of this
Agreement. Weld County does not, however, guarantee the
accuracy of the data provided.
c. Greeley will not lend, sell, give, lease, or otherwise
disclose the Weld County Assessor data elements without the
written approval of Weld County, unless required to disclose
pursuant to the provisions of the Colorado Open Records Act,
Sections 24-10-101, et. seq. , C.R.S. , or by Court order.
d. Weld County will not lend, sell, give, lease, or otherwise
disclose the Greeley Building Permit data elements without the
written approval of Greeley, unless required to disclose
pursuant to the provisions of the Colorado Open Records Act,
Sections 24-10-101, et. seq. , C.R.S. , or by Court order.

e. The obligations set forth in this Paragraph 4 shall survive
the termination of the Agreement.
f. Greeley represents that it will not, under any circumstances,
resell or republish the raw data provided by Weld County to
any third party. The data obtained from Weld County shall be
for the sole use of the Greeley Building Inspection
Department, except when incorporated in reports made to
management, City Council, or the public.
g. Weld County represents that it will not, under any
circumstances, resell or republish the raw data provided by
Greeley to any third party. The data obtained from Greeley
shall be for the sole use of the Weld County Assessor's Office
except when incorporated in reports made to the County
Commissioners or the public.
h. Greeley and Weld County recognize the provisions of the
Colorado Open Records Act (§24-72-101,et seq. , C.R.S. ) as
possible exceptions to subparagraphs (f) and (g) of this
paragraph.
5. Miscellaneous.
a. This Agreement shall be binding and inure to the benefit of
Weld County and Greeley.
b. No alteration or variation of the terms of this Agreement
shall be valid unless made in writing and signed by the
parties hereto.
c. Greeley or Weld County may not assign or transfer this
Agreement, any interest therein, or claim thereunder without
the prior written approval of the other party.
d. Weld County or Greeley may terminate this Agreement at any
time by giving the other party a thirty-day written notice of
termination and may terminate this Agreement at any time
without notice upon a material breach of the terms of this
Agreement by the other party.
e. The relative liabilities of Greeley and Weld County for any
action brought as a result of an injury to a person or
property shall be determined in accordance with C.R.S. ,
Section 13-21-111.5 (1987 Repl. Vol. ) . Greeley and Weld
County shall provide necessary workmen's compensation
insurance at their own cost for their own employees.
f. No portion of this Agreement shall be construed to confer a
benefit or right of a cause of action lying in tort, contract,
or otherwise upon any person or entity not a part to this
Agreement. Furthermore, no portion of this Agreement shall be
deemed to constitute a waiver of any governmental or personal
immunities held by the parties or their officer, agents, or
employees.

g. All notices required to be given under the terms of this
Agreement shall be effective upon the dispatch of a copy of
the notice, first class mail, postage prepaid, certified or
registered mail, return receipt requested.

RESOLUTION NO. 35 , 1992
A RESOLUTION AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH WELD
COUNTY TO EXCHANGE DATA FROM THE WELD COUNTY ASSESSOR AND THE
CITY OF GREELEY BUILDING PERMIT DATA.
WHEREAS, the City of Greeley, Colorado and Weld County,
Colorado wish to enter into an agreement authorizing the Weld
County Assessor, and the City of Greeley to exchange information
on various data held by each party; and
WHEREAS, it is in the best interests of the people of the
City of Greeley to enter into such an agreement; and
WHEREAS, the exchange of data elements between the Weld
County Assessor and the City of Greeley Building Permit Data will
commence immediately until December 31, 1992 , and be renewed
automatically on a year to year basis;
NOW THEREFORE, BE IT RESOLVED BY THE GREELEY CITY COUNCIL:
1. That the Mayor of the City of Greeley is authorized to
sign the intergovernmental agreement which is attached hereto and
incorporated herein regarding the exchange of data elements
between the Weld County Assessor and the City of Greeley, for
building permit data.
PASSED AND ADOPTED, SIGNED AND APPROVED, this 20th day of
October 20 , 1992 .
