HomeMy WebLinkAbout900848.tiff RESOLUTION RE: APPROVE CERTIFICATE OF DESIGNATION - CITY OF LONGMONT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 19th day of September, 1990 , a public hearing was held in the Chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of considering whether to grant a Certificate of Designation to City of Longmont, c/o Calvin Youngberg, 1100 South Sherman Street, Longmont, Colorado 80501, said site to be located on the following described property: Part of the NE} , Section 8 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Calvin Youngberg, and WHEREAS, this request for a Certificate of Designation was submitted in conjunction with a request for a Site Specific Development Plan and a Special Review Permit, Major Facility of a Public Utility, for a sludge composting facility in the A (Agricultural) Zone District which was approved by the Planning Commission, and WHEREAS, Section 32-20-104 , CRS, as amended, requires the Board to take into account certain factors to approve a Certificate of Designation and, having taken into account said factors, finds as follows: 1. The Conditions of Approval and stated Standards included in USR-914 will minimize the impacts on the surrounding property and the area to the greatest extent possible. The conditions for approval and stated standards will also provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the County. 2. The location of the sludge composting facility will be convenient and accessible to the operators of the City of Longmont waste treatment facility. The applicant has demonstrated in the application materials that it has the ability to comply with the health standards and operating procedures of the Solid Waste Disposal Site and Facilities Act, Title 30-20, Part 1 , C.R.S. 4 . The Colorado Department of Health and the Weld County Health Department have reviewed this request and find, subject to conditions, that the proposal will comply with the standards of the Solid Waste Disposal Sites and Facilities Act, Title 30-20-100 , et seq. C.R.S. and with the regulations promulgated thereunder, 6 CCR 1007-2 , known as the Regulations Pertaining to Solid Waste Disposal Sites and Facilities. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Certificate of Designation for City of Longmont, c/o Calvin Youngberg, 1100 South Sherman Street, Longmont, Colorado 80501 , on the hereinabove described real property be, and hereby is, granted subject to the following condition: 1 . The property shall be maintained in compliance with USR-914 , all submitted application materials on file with the Department of Planning Services, and all requirements of the Weld County Health Department and the Colorado Department of Health. Wes Potter, Health Department representative, said the Health Department also recommends approval. Calvin Youngberg, representing the City of Longmont, explained the request and said this is a treatment facility and not a disposal site. There was no public comment concerning this application. Commissioner Lacy moved to approve the Certificate of Designation for the City of Longmont. Commissioner Kennedy seconded the motion, and it carried unanimously. Vernon, M.D. Executive Director Weld County Board of County Commissioners 915 10th Street Greeley, Colorado 80631 RE: Longmont, Wastewater Sludge Composting Dear Commissioners: The Hazardous Materials and Waste Management Division of the Colorado Department of Health (the Division) has completed its review of the City of Longmont's Proposed Wastewater Sludge Composting Facility Operations Plan (the Plan) submitted April 26, 1990. The site is located in NE1/4, 58, T2N, R68W, south of Highway 119 approximately 2 1/2 miles east of Longmont in Weld County. The site is approximately 11 acres in size. The plan was reviewed to ascertain its compliance with the minimum standards as set forth in the Solid Waste Disposal Act, Sections 30-20-100 to 116, C.R.S. 1973 (Solid Waste Act) and with the Regulations promulgated thereunder, 6 C.C.R. 1007-2 (the Regulations). The Division, in reviewing the submitted plan, has the following comments: 1) The facility will consist of a composting/curing building, mixing/storage buildings and an operations building. The composting operations will consist of 28 days of active composting in an aerated static pile followed by 30 days of curing. The composting is to occur within the specially designed building. 2) The design capacity of the facility is for 8.5 dry tons of sludge cake, five days per week. The sludge will be mixed with previously composted sludge for composting. Initially wood chips or similiar material will be used to start the composting process. 3) Each composting pile will be aerated by using a single dedicated blower. Both compost and curing piles will be aerated. The piles will contain thermocouples that measure pile temperature. The measured temperature and timers will be used to regulate the volume of air and time of the blower run. 4) The site will have a surface stormwater run-off containment and evaporation pond to control waters from the structures and parking lot. The pond is designed to contain a 24 hour, 100 year storm event in accordance with Section 4.2.2 of the Regulations. 5) All incoming sludge will be monitored for quantity and quality as required by State and Federal Sludge Regulations. At a minimum, the finished compost will meet the requirements of the Colorado Department of Health with respect to stability, pathogen reduction, and metals content. Testing and recordkeeping will be established in accordance with these requirements which were established for land application of sludge for beneficial use. Keith Schuett stated the special Review permit is considered a major facility of a public utility, therefore, the Planning Commission is empowered to approve this request. If the Planning Commission were to deny the request, the applicant has the right to request a hearing before the Board of County Commissioners. Summary of the Weld County Planning Commission Meeting July 24, 1990 Page 4 APPEARANCE: Calvin Youngberg, Project Engineer, City of Longmont, explained they are asking to withdraw approximately eleven acres form a planned unit development and return it to agricultural zoning. They intend to compost sludge, which will be treated and then hauled in from its wastewater treatment plant. The sludge will be composted with sawdust, and turned and aerated unit it has reached the proper moisture level. The dry product (fertilizer) will sold or given away. This site was chosen because it is close to the City of Longmont's landfill and wastewater treatment plants. All sludge will be composted within a covered building. The service area includes the Towns of Mead, Platteville, Fort Lupton, Frederick, Firestone, Dacono, Erie, and the City of Longmont. The site will provide a long-range cost effective facility capable of meeting the existing and future needs of Municipalities in southwest Weld County. - All reasonable alternatives to the proposal have been adequately assessed and the proposed action is consistent with the best interests of the people of Weld County and represents a balanced use of resources in the affected area. - The nature and location of the facility will meet Colorado Department of Health air quality standards. - Adequate utilities are available to service the site. - The nature and location of the facility will not unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any endangered wildlife species, unique natural resource, historic landmark, or archaeological site within the affected area. - No overlay districts affect the site. - Special review development standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. All composting and storage of materials for composting shall occur within the specially designed enclosed building. 4. The stormwater runoff and containment facility shall be designed to contain a 24-hour, 100-year storm event in accordance with Section 4.2.2 of the State Health Department Regulations. 5. All stormwater runoff and containment facilities shall be maintained at all times in compliance with the plan approved by the Weld County Health Department. 6. Underground drains around building perimeters shall be installed to route perched groundwater to the stormwater retention pond. 7. If evaporation is not sufficient to maintain water levels in the stormwater retention pond, liquids from the pond shall be tested for biological pathogens and disposed of in a manner approved by the Weld County Health Department. 8. The design capacity of the facility shall not exceed 8.5 dry tons of sludge cake per day, five days per week. 9. Sludge shall be mixed with previously composted sludge prior to composting. Wood chips or similar materials may be used to start the composting process. 10. Each composting and curing pile shall be aerated by using a minimum of one dedicated blower. Air volume and time of blower run shall be controlled by thermocuples that measure pile temperature. 11. All incoming sludge shall be monitored for quantity and quality to meet or exceed State and Federal sludge regulations. FT 0949 Development Standards City of Longmont USR-914 Page 2 12. All finished composting shall meet or exceed the requirements of the Colorado Department of Health's standards for stability, pathogen reduction, and metals content as established for land application of sludge for beneficial use. 13. Testing of materials and record keeping requirements shall be in accordance with the State Health Department Regulations on sludge for beneficial use. 14. The composting facility shall use a scrubber approved by Weld County Health Department to clean the building's air of odors and minimize potential of nuisance conditions. 15. The operator shall transport, handle, and stockpile sludges from the City of Longmont to the Special Review site in a manner that will prevent nuisance conditions. 16. The compost piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insects pests, or pollutant runoff. 17. The compost storage site shall have a water-tight surface which does not permit seepage or percolation of pollutants into the ground. 18. No permanent storage of sludge or compost shall take place at the site. 19. Waste oil, waste paints, treatments, anti-freeze, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 20. An air emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department Health, for fugitive dust, odors, ammonia and other emissions, if required. 21. NPDES permits shall be obtained or amended from the Water Quality Control Division of the Colorado Department of Health, if required. 22. Sludge, sludge cake, and compost shall be handled and stored at the facility in such a manner so that no nuisance is created by odor, blowing of debris, and fugitive dust on or around the facility. 23. The compost facility shall have sufficient emission control scrubbers to comply with an odor standard of fifteen to one dilution threshold. The maximum permissible noise level shall not exceed the commercial limit of 60 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 28. St. Vrain Sanitation District shall be the only sewer treatment system for the proposed operation. 29. Groundwater monitoring wells shall be installed around the composting facility, and samples shall be collected and tested annually. The site will provide a long-range cost effective facility capable of meeting the existing and future needs of Municipalities in southwest Weld County. - All reasonable alternatives to the proposal have been adequately assessed and the proposed action is consistent with the best interests of the people of Weld County and represents a balanced use of resources in the affected area. - The nature and location of the facility will meet Colorado Department of Health air quality standards. - Adequate utilities are available to service the site. - The nature and location of the facility will not unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any endangered wildlife species, unique natural resource, historic landmark, or archaeological site within the affected area. - No overlay districts affect the site. ▪ Special review development standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application submitted by the applicant, other relevant information regarding the request, and the responses of the referral entities which have reviewed this request. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the property until the Certificate of Designation is approved, and the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder p� f.?�'OTS USR-914 City of Longmont Page 3 2. The attached development standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval of the Certificate of Designation by the Board of County Commissioners. 3. Prior to locating materials on the site for composting: a. a copy of a letter shall be submitted to the Department of Planning Services indicating the stormwater runoff and containment facilities are installed according to a plan approved by Weld County Health Department; b. the Special Review site shall be bermed and landscaped on the north, east, and west to visually screen the buildings and uses from the property zoned P.U.D. and Highway 119; and c. evidence shall be submitted to the Department of Planning Services that the Weld County Health Department has approved an acceptable source of potable drinking water. 4. Within 30 days of approval of the Certificate of Designation by the Board of County Commissioners, the applicant shall submit an odor abatement and control plan and a stormwater runoff and containment plan to the Weld County Health Department for review and approval for the facility. The stormwater runoff and containment plan shall be designed, in compliance with State Statutes, by a registered professional engineer. 5. Within 24 hours from receipt of written notification by the Weld County Health Department that an odor violation exists, the operator shall respond with odor abatement and control measures as identified in the plan approved by the Weld County Health Department. In the event that an odor violation condition exists for five continuous days from the date of written notification, the operator shall voluntarily close the facility, not accept additional materials for composting, and shall remove all compost materials from the facility. These materials shall be removed, handled, and disposed o£ in accordance with the approved odor abatement and control plan. 6. All buildings on the Special Review site shall be earthtone in color for compatibility with surrounding land uses. 7. Air emissions control equipment shall be inspected and approved by the weld County Health Department prior to installation and operation. �� 9,19 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS CITY OF LONGMONT USR-914 1. The Site Specific Development Plan and Special Review permit is for a major facility of a public utility (sludge composting facility) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. All composting and storage of materials for composting shall occur within the specially designed enclosed building. 4. The stormwater runoff and containment facility shall be designed to contain a 24-hour, 100-year storm event in accordance with Section 4.2.2 of the State Health Department Regulations. 5. All stormwater runoff and containment facilities shall be maintained at all times in compliance with the plan approved by the weld County Health Department. 6. Underground drains around building perimeters shall be installed to route perched groundwater to the stormwater retention pond. 7. If evaporation is not sufficient to maintain water levels in the stormwater retention pond, liquids from the pond shall be tested for biological pathogens and disposed of in a manner approved by the Weld County Health Department. 8. The design capacity of the facility shall not exceed 8.5 dry tons of sludge cake per day, five days per week. 9. Sludge shall be mixed with previously composted sludge prior to composting. Wood chips or similar materials may be used to start the composting process. 10. Each composting and curing pile shall be aerated by using a minimum of one dedicated blower. Air volume and time of blower run shall be controlled by thermocuples that measure pile temperature. 11. All finished composting shall meet or exceed the requirements of the Colorado Department of Health's standards for stability, pathogen reduction, and metals content as established for land application of sludge for beneficial use. 13. Testing of materials and record keeping requirements shall be in accordance with the State Health Department Regulations on sludge for beneficial use. 14. The composting facility shall use a scrubber approved by Weld County Health Department to clean the building's air of odors and minimize potential of nuisance conditions. 15. The operator shall transport, handle, and stockpile sludges from the City of Longmont to the Special Review site in a manner that will prevent nuisance conditions. 16. The compost piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insects pests, or pollutant runoff. 17. The compost storage site shall have a water-tight surface which does not permit seepage or percolation of pollutants into the ground. 18. No permanent storage of sludge or compost shall take place at the site. 19. Waste oil, waste paints, treatments, anti-freeze, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 20. An air emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department Health, for fugitive dust, odors, ammonia and other emissions, if required. 21. NPDES permits shall be obtained or amended from the Water Quality Control Division of the Colorado Department of Health, if required. 22. Sludge, sludge cake, and compost shall be handled and stored at the facility in such a manner so that no nuisance is created by odor, blowing of debris, and fugitive dust on or around the facility. 23. The compost facility shall have sufficient emission control scrubbers to comply with an odor standard of fifteen to one dilution threshold. No permanent disposal of wastes shall be permitted at this site. 25. Wood shavings, sawdust, and other bulking agents shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 26. Fugitive dust shall be controlled on this site. 27. The maximum permissible noise level shall not exceed the commercial limit of 60 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 28. St. Vrain Sanitation District shall be the only sewer treatment system for the proposed operation. 29. Groundwater monitoring wells shall be installed around the composting facility, and samples shall be collected and tested annually. Test results shall be submitted to the Weld County Health Department. 30. Any composted sludge applications within Weld County shall be conducted according to the Weld County Ordinance No. 89-S. 31. The property shall be maintained in accordance with the State Oil and Gas Conservation Commission's requirements. 34. The property shall be maintained in compliance with SARA Title III. 35. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 36. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 37. The site is located in NE1/4, S8, T2N, R68W, south of Highway 119 approximately 2 1/2 miles east of Longmont in Weld County. The site is approximately 11 acres in size. The plan was reviewed to ascertain its compliance with the minimum standards as set forth in the Solid Waste Disposal Act, Sections 30-20-100 to 116, C.R.S. 1973 (Solid Waste Act) and with the Regulations promulgated thereunder, 6 C.C.R. 1007-2 (the Regulations). The Division, in reviewing the submitted plan, has the following comments: 1) The facility will consist of a composting/curing building, mixing/storage buildings and an operations building. The composting operations will consist of 28 days of active composting in an aerated static pile followed by 30 days of curing. The site is located in NE1/4, 58, T2N, R68W, south of Highway 119 approximately 2 1/2 miles east of Longmont in Weld County. The site is approximately 11 acres in size. The plan was reviewed to ascertain its compliance with the minimum standards as set forth in the Solid Waste Disposal Act, Sections 30-20-100 to 116, C.R.S. 1973 (Solid Waste Act) and with the Regulations promulgated thereunder, 6 C.C.R. 1007-2 (the Regulations). The Division, in reviewing the submitted plan, has the following comments: 1) The facility will consist of a composting/curing building, mixing/storage buildings and an operations building. The composting operations will consist of 28 days of active composting in an aerated static pile followed by 30 days of curing. The composting is to occur within the specially designed building. 2) The design capacity of the facility is for 8.5 dry tons of sludge cake, five days per week. The sludge will be mixed with previously composted sludge for composting. Initially wood chips or similiaematerial will be used to start the composting process. 3) Each composting pile will be aerated by using a single dedicated blower. Both compost and curing piles will be aerated. The piles will contain thermocouples that measure pile temperature. The measured temperature and timers will be used to regulate the volume of air and time of the blower run. The proposed site has a primary service area of approximately 453 square miles with a population of approximately 65,000 people. The service area includes the Towns of Mead, Platteville, Fort Lupton, Frederick, Firestone, Dacono, Erie, and the City of Longmont. The site will provide a long-range cost effective facility capable of meeting the existing and future needs of Municipalities in southwest Weld County. - All reasonable alternatives to the proposal have been adequately assessed and the proposed action is consistent with the best interests of the people of Weld County and represents a balanced use of resources in the affected area. - The nature and location of the facility will meet Colorado Department of Health air quality standards. - Adequate utilities are available to service the site. - The nature and location of the facility will not unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any endangered wildlife species, unique natural resource, historic landmark, or archaeological site within the affected area. • No overlay districts affect the site. - Special review development standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application submitted by the applicant, other relevant information regarding the request, and the responses of the referral entities which have reviewed this request. Proposed Use of Property The 11 . 0 acres which is the subject of this application is to be used for composting facilities to treat sludge generated by the City of Longmont ' s municipal wastewater treatment plant. As part of the sludge composting project, the City is also constructing new sludge thickening and dewatering processes at the City' s treatment plant. The sludge composting process is described in more detail in the following paragraph. The initial step in the composting process will be dewatering of waste sludge at the wastewater plant. The dewatered sludge (approximately 24% to 25% solids) will then be transported by truck to the composting project site (the subject property) . At that location, it will be mixed with an organic amendment such as finished compost, composted organic material or wood chips and placed into five foot high piles for composting. All of these processes will take place in fully enclosed buildings to insure that the proper conditions for rapid and controlled composting exist. The composting process itself will be accelerated and controlled by forced aeration supplied to the piles via blowers and perforated pipe. This initial composting period will last for 28-30 days. Finished compost will then be placed in curing piles and aerated at a lower rate for 30-60 days . Both composting and curing processes will be utilize micro-processor control of aeration rates to guarantee rapid stabilization of the sludge. The final product will be disposed of on the City' s existing State-approved agricultural land application sites in Boulder County or used as a revegetation amendment on the existing landfill, which will close in 1990 . B. Need for Use The existing wastewater treatment plant, although it has been expanded several times, is currently at capacity with respect to sludge treatment. Although the hydraulic portion of the plant is only at about 62% of capacity, the sludge treatment portion must be enlarged in order for the plant to meet its State and Federal permit requirements. Several alternatives for sludge treatment were evaluated through facilities planning and predesign efforts which began in 1987. The evaluations resulted in sludge composting being chosen as the most cost-effective and environmentally sound treatment method. After the planning study (facilities plan) was approved by the State and EPA in 1988 , design of the facilities commenced in 1989 . The project has since been bid and construction is awaiting County approval. Since Federal funding was available to construct the recommended facilities, planning and design have been completed in accordance with all of the require- ments of both the State Health Department and the Environmental Protection Agency. A grant for construction of the facilities was awarded in December of 1989 and construction must begin in 1990 in order to retain the grant. This project is very important to the City as it brings the wastewater plant up to the standards which are required by State and Federal law. l Weld County Use by Special Review Application - Page 2 C. Use of Surrounding Properties . All of the property surrounding the subject property is zoned either agricultural (A-1 ) or light industrial/commercial (I-1 ) . The land to the North and West is zoned light industrial/commercial and is owned by Cordell P. Richardson, from whom the City purchased the subject property; this land is currently being leased to a farmer. Property to the South is owned by the City of Longmont and is being used for the City' s landfill. Land to the East is zoned A-1 and contains the only residence in the area, which is approximately 600 feet northeast of the northeast corner of the subject property. D. Users of Property. The only users of the property will be City of Longmont personnel associated with the sludge composting operation. E. Number of employees and shifts. The facilities will initially be staffed by 4 employees, eight hours per day (either 8 A.M. to 4 : 30 P.M. or 7 A.M. to 3 : 30 P.M. ) . F. Utilities . Water service will be provided by the Left Hand Water Company. Sewer utilities will be provided by the St. Vrain Sanitation District. G. Access and traffic. Access to the site will be via Colorado Highway 119 and the existing City landfill access road. The access road will be widened to 30 feet, regraded and resurfaced as part of this project. Initially, 4 or 5 single-axle ( 3 to 4 cubic yard capacity) dump truck trips per day will be needed to transport sludge to the site. The operations personnel will generate an additional 4 or 5 vehicles per day. At capacity (year 2010 ) , operator traffic would remain the same and the number of sludge trucks could increase to between 12 and 15 per day ( less if trailers are attached to the trucks) . H. Fire protection. No fire protection systems are included in the mixing, composting or storage facilities. All of the buildings are metal frame and shell with asphalt or concrete floor. Both the building materials and the compost constituents are noncombustible. The only inhabited structure will be the operations building; in that location, chemical extinguishers of appropriate number, size and type will be provided. If additional requirements are imposed by the Longmont Rural Fire Protection District, the City will comply with them. I . Waste, stockpile and storage areas. The facilities are for treatment of wastewater sludge. The composting/curing building will be used to store composted sludge until it is disposed of. The storage building will contain bulking agents such as recycled compost, wood chips or sawdust which will be used on a daily basis to create the sludge compost mixture. The composted product will be beneficially reused on agricultural land at locations in Boulder County; therefore, no permanent storage of materials will take place at the site. Once operating at full capacity, approximately 8 . 5 dry Weld County Use by Special Review Application Page 3 tons per day of sludge will be transported to the composting site and mixed with 10-16 dry tons of bulking agent. Twenty-eight active piles and eight curing piles will be continuously maintained. The final compost product will only have about 200 of the volume of the incoming sludge. On the average, about 1500 dry tons of compost/ bulking agent mixture with a volume of approximately 3800 cubic yards will be in active composting at any given time. Another 184 dry tons with a volume of 400 cubic yards will be in the curing piles. The storage building on the site will contain finished compost, wood chips , sawdust or other similar material for use as bulking agent in the composting process. This building can only contain about 1000 cubic yards of material and it will be continuously used and replenished during the course of operations . All of the mixing, composting and curing operations take place in totally enclosed buildings. The storage building will only have three walls, with the East-facing side remaining open. J. Animals. There will be no animals on the site. K. Storm water detention. Surface runoff from the paved areas of the site will be channeled to a 5-acre (782, 000 gallon) detention and evaporation pond. This pond, which will be fully lined with impervious material, has been designed to completely contain the runoff from a 24-hour, 100-year storm event. L. Landscaping/erosion control. Since a large portion of the site will be paved, the need for erosion control is minimized. The landscaping plans call for the North and West borders of the project site to be shielded by a low berm. The berm will be planted with native grasses , wildflowers and bushes . M. Reclamation. These facilities have been designed for a minimum 20-year life. If operations cease after that time, the site and the buildings would probably be sold for other uses . Since there will be no disposal on site, reclamation of disturbed or filled land is not an issue. N. Operation timetable. This project has already been bid and a grant for construction has been awarded by EPA. Upon approval by the County of the rezoning, use by special review and Certificate of Designation, construction will start. The latest estimated timetable is as follows: Commencement of construction - June 1, 1990 Completion of construction - November 1, 1990 Commencement of operations - March 1 , 1991 or 0 r, g r� Weld County Use by Special Review Application Page 4 2 . CONSISTENCY WITH POLICIES OF WELD COUNTY COMPREHENSIVE PLAN The use of the site is consistent with and meets several of the policies of the Weld County Comprehensive Plan. First, the composting facilities will produce a product that will benefit agricultural land. The compost product is to be used as a soil amendment either on the existing landfill to enhance revegetation or on State-approved agricultural sites as a soil amendment. Although the approved application sites are currently in Boulder County, Weld County agricultural land could be used in the future. The composting facilities also meet the goal of permitting commercial and industrial uses of agricultural property at locations along highways with adequate access. The composting site is in an approved industrial/commercial (I-1 and C-2 zoning) PUD which has already been removed from agricultural uses; this rezoning will return a portion to the previous zoning classification, but with uses which remain compatible with the PUD. Adequate access is provided by the current landfill access road, which will be used for the proposed facilities. The City will widen and resurface the road as part of this project. This road will eventually be further upgraded to serve as an alternate entrance to the adjacent PUD. 3 . COMPATIBILITY OF PROPOSED USES WITH DISTRICT AND SURROUNDING LAND The uses of the property will be compatible with the approved land uses in both the adjacent, existing PUD (which is zoned industrial/ commercial) and the neighboring agricultural land. The sludge composting operations will be totally enclosed and the buildings on the site will have the physical appearance of standard metal warehouses . As noted previously, the site will be bermed and landscaped to provide a buffer between the facilities and the other PUD lots. The berms will also provide a visual screen to keep the buildings from being seen from Highway 119. As explained above, operator and equipment activity at the site will be limited to 8 hours per day, 5 days per week, and traffic will consist of 4 or 5 private vehicles and a maximum of 12 to 15 single-axle dump trucks per day. Since the road to this project will continue as the access to the City' s landfill, this number of vehicles will have a negligible impact on the total use of the road, which is currently estimated to be 80 to 90 vehicles per day. The road into the facilities will enter the property at its Southeast corner, well out of the planned PUD corridor. Other industrial or light industrial uses in the area would have buildings of similar appearance and would probably have a much higher number of employees per acre of development with correspondingly higher traffic impacts. Even if the PUD would develop with commercial users, the composting facilities will still generate lower traffic, noise and visual impacts than other commercial ventures in the Highway 119 corridor. Because the project planned for the site is for treatment of wastewater sludge, there may be some concerns about odors generated by the facilities and the impact on the surrounding land uses. Both planning and design of the facilities have taken the mitigation of odors into account. The most odorous part of the operation, mixing of sludge with composting amendment, will be separately ventilated through a biological soil scrubber, which should eliminate any problems from this source. The active composting portion of the �' A A. Weld County Use by Special Review Application Page 5 project will be totally aerobic, which should minimize or eliminate offensive odors. However, the composting building has also been designed to prevent odor problems. The building, and therefore the composting operation itself, will be totally enclosed and actively ventilated by large, high-velocity updraft fans in the roof. This will insure positive mixing and dispersion of building air into the atmosphere even during stagnant weather conditions . Odor dispersion was also examined during the planning process. One of the reasons for choosing this site was to take advantage of prevailing winds and air movement which will tend to dilute and disperse any odors quickly. In addition, the site is over 100 feet above the river valley which keeps it out of possible areas of stagnant air. The odors associated with the composting operation are expected to be far less noticeable than many agricultural activities. Since the process is totally enclosed and controlled and the ventilation at critical points is scrubbed, there should be no detriment to the proposed land uses in the remainder of the PUD or on neighboring agricultural property. If , by some chance, problems do occur in the future, the composting/curing building ventilation has been designed so that air scrubbers can be added. 4. HEALTH, SAFETY AND WELFARE. The proposed use of the site as a composting project should have no negative impact on the surrounding area or residents of the County. The treatment and disposal of wastewater sludge is controlled by both Federal and State laws and regulations, which have been developed to protect the public from exposure or contact with inadequately treated or unsafe material. These requirements apply to the treatment process as well as the stability and quality of the compost product. The City must meet these requirements or civil and criminal penalties could be assessed. Air emissions from the facility will be regulated via permit by the Colorado Department of Health under the Colorado Clean Air Act. In addition to meeting the standards and other provisions of the air quality regulations, the project incorporates odor control through the use of scrubbing or forced ventilation of all processes . The requirements of these various agencies as well as the commitment of the City of Longmont to maintain an environmentally sound operation will provide more than adequate safeguards to County residents in the vicinity of the project. 5 . COMPATIBILITY OF PROPOSED USES WITH FUTURE DEVELOPMENT. All property in the vicinity of the subject parcel is zoned Agricultural except for the Baldridge/Richardson PUD, a portion of which this rezoning request addresses. Although the composting facilities will be a special use within the proposed agricultural zoning, the mitigation for both visual and odor impacts described above should prevent any negative impacts on the surrounding land uses. Future uses of the surrounding property appear to be assigned to agriculture with the exception of the development corridor along Highway 119, which is slated for commercial and industrial development. As explained in 2 . and 3 . above, the proposed use will not be in conflict with either agricultural or commercial/industrial ventures in the area. r r a:-e s c) Weld County Use by Spacial Review Application Page 6 6. FLOOD PLAIN, GEOLOGIC HAZARD, OVERLAY AREA. The property is not located in a flood plain, area of geologic hazard or any Weld County overlay area. 7. AVAILABILITY OF WATER. Potable water for the site will be provided by Left Hand Water Company. Water will only be used in the operations building for showers and bathroom facilities. Although Left Hand indicates that they do not have adequate pressure to serve the operations building, they have left open the possibility of the use of a holding tank or cistern which would be filled during low-use hours. The City has planned for the installation of a tank in the operations building, and if Left Hand can not provide the water in this manner the City will deliver bulk water to the site by truck as needed. A letter from Left Hand Water Company is attached. Irrigation water will also be needed for landscape irrigation. The City' s Water Quality Division and Solid Waste Division are currently planning a pump station to supply St. Vrain Creek water for both the landfill revegetation and irrigation for the subject property. This pump station will be constructed later in 1990 . The City has a St. Vrain water rights available for this purpose. S. OWNERSHIP OF SITE. A copy of the title for the property showing the City as owner is attached. 9. NOISE REPORT. No noise report has been prepared. The noise associated with the composting operations will be less than what is currently being generated by the existing landfill and traffic on Highway 119. The equipment to be used in the composting operation includes one loader, two small skidsteer loaders, sludge mixers and aeration blowers for composting and curing. The loader and skidsteers will be diesel powered and the motors for the mixers and blowers are electric. Only the loader and the skidsteers will operate outside of the buildings and their circulation on the site will be restricted to the space between the mixing, storage and composting/ curing buildings at the South end of the property. Their use will also be limited to building the compost piles and site cleanup, which should only take up approximately one-half of the eight hour work day. The sludge mixers and aeration blowers are totally enclosed in the mixing and composting/curing buildings, and any sound from their operation will not be noticeable outside of the buildings. Noise from the trucks delivering sludge to the site will be far less than that associated with the continuing landfill operation. The berms that are to be built around the North and West edges of the site should also reduce any impact on surrounding property. 10. SURROUNDING PROPERTY OWNERS.
