RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN ACCESSORY STRUCTURE OVER 1500 SQUARE FEET IN THE A (AGRICULTURAL) ZONE DISTRICT - EDWARD AND BETTY FRANK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of July, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Edward and Betty Frank, 15164 Good Avenue, Fort Lupton, Colorado 80621, for a Site Specific Development Plan and Special Review Permit for an accessory structure over 1500 square feet in the A (Agricultural) Zone District on the following described real estate, to-wit: Lot 2, Block 66, Aristocrat Ranchettes, Weld County, Colorado WHEREAS, Edward Frank, said applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area Goals and Policies. The Urban Growth Boundary Area section of the Zoning Ordinance provides for the County to encourage land-use development proposals as long as they conform to the desires of affected municipalities. This land use is located within the Urban Growth Boundary Area of Fort Lupton, which reviewed this request and expressed no objections. b. This proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The permitted uses will be compatible with the existing surrounding land-uses which include agricultural production, pasture, rural residences, the City of Fort Lupton, and oil PL0917 930583 Pkagr7 / , / SPECIAL REVIEW PERMIT - FRANK PAGE 2 and gas production. The uses will be compatible with the future development of the surrounding areas as permitted by the A (Agricultural) Zone District. d. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an accessory structure over 1500 square feet in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Site Specific Development Plan and Special Review Permit is for an accessory structure over 1500 square feet in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 5. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 6. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 7. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Edward Frank, the applicant, was present and stated he wants to build a garage/agricultural building for equipment, a boat, and other vehicles. He confirmed for Commissioner Kirkmeyer that he had no problem with the Conditions of Approval and Development Standards. Mr. Frank said he currently stores his equipment outside, in response to a question from Commissioner Hall. Mr. Thompson confirmed for Chairman Harbert that the proposed building will be within the offset requirements. There was no public testimony offered concerning this matter. Commissioner Webster moved to approve the request of Edward and Betty Frank for a Site Specific Development Plan and Special Review Permit for an accessory structure over 1500 square feet in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. Judy Yamaguchi asked Ed Frank how tall the building would be and what material would be used on the outside of the garage. Ed Frank stated that it would be approximately 12 high and approximately 14 feet high to the peek. He also stated the material on the outside would be steel. Bud Clemons asked it the garage would be attached to the residence. LEGAL DESCRIPTION: Part of the SE4 of Section 9, T6N, R67W of the 6th P.M. , Weld County, Colorado. LOCATION: West of Weld County Road 19 , north of Weld County Road 70. Gary Tuttle, representative for Fort Collins Orthopaedic Associates, stated that this project is north of the Town of Windsor. It is located at Weld County Roads 19 and 70. The site is approximately 97 acres. The area is outside Windsor' s Primary Growth Boundary. This area is outside of where Windsor will be developing within the next 10 to 15 years. The applicant feels the change of zone is justified because of the changing conditions in the area, there are many rural residences in the area. There is the Prerd Himmel Planned Unit Development to the north and east of the property and the subdivisions of Antelope Hill and Kennedy, and on Weld County Road 70 there are four or five Recorded Exemptions. There will be 30 lots , the size will be approximately 2.5 acres to 3 acres. The larger lots will allow horses and will help reduce agricultural problems. The larger lots will be to the north. Public Service and Poudre Valley REA will be handling utilities, North Weld Water will be supplying water, there will also be irrigation water for the site, the Windsor-Severance Fire Protection District will be handling fire protection, the lots will have individual septic. The access to the property is along the section line. Interior open space system of trails for walking, horse riding, and bicycling will be controlled by a homeowners' association.
