This ordinance would rezone the property in question to

reading. Motion passed with all voting in favor thereof.
C. Quit Claim Deed to property located on State Street
The City Attorney explained that by accepting this Quit
Claim Deed for State Street, it would release Weld County
property, right-of-way, .and easement to the City of Evans
and this would enable staff to pursue the property swap
with Norman Michaud for roadside park improvements.

Re: Right-of-Way Along State Street in the City of Evans
formerly known as State Highway 3
Dear Commissioners :
The undersigned represents the City of Evans . The City of Evans
staff is presently trying to straighten out some problems regarding
State Street as it lies within the City of Evans . State Street was
originally known as State Highway 3 but was abandoned by the State
Highway Department with the construction of Highway 85 in either
1949 or 1950 . Since that point in time the City of Evans has been
maintaining the roadway and it is used as a local street for
citizens of the City of Evans . Chuck Jones has done extensive
research into the real estate records concerning ownership of this
right-of-way and it appears that the County of weld has a
substantial interest either by deed or usage in this right-of-way.
Some of the interest is a fee interest, some is prescriptive and
some is simply a deeded right-of-way. The City of Evans would like
to continue to maintain this roadway as a local street, but in
order to clear up any potential title problems , we feel that it
will be necessary for the County of Weld to quit claim any interest
that it may have in this roadway to the City of Evans . The City
plans to make some alterations in this roadway this calendar year
and would appreciate action by the Board sometime in the near
future. Assistant County Attorney, Lee Morrison, has in his
possession most of the information that has been prepared by Chuck
Jones .

Chuck Jones has done extensive work for the City of Evans regarding
Old State Highway 3 which parallels the main line of the Union
Pacific Railroad running on a southwest to northeasterly direction
between 35th Street and 39th Street.
Mr. Jones ' research, which is documented in the attached
information, shows a number of parcels which apparently are held in
fee by Warranty Deed or Quit Claim Deed to Weld County probably for
right-of-way. There are some other areas which appear to have been
established by prescriptive use. Apparently the highway was
located in that area after 1921 .
It appears that the City of Evans is interested in acquiring the
interests of the County as they occur along this area. In order
for it to transfer to Evans, Weld County would have to deed the
property rather than vacate it as a vacation of the roadway would
result in the property passing to the adjacent property owners .
Ordinarily, land held by the County which is annexed into a city
would automatically go to the responsibility of the city, but
apparently Weld County acquired this property inside the City as
part of the State Highway project and there has been no annexation.
There may be an argument that this is property which should be sold
as surplus property but, in effect, the public purpose still exists
for the property and it is not actually surplus . Therefore, it
appears more appropriate for Weld County to quit claim its interest
in this stretch of road and have the City do an acceptance of the
Quit Claim in order to formally convey the parcel to the City.
My recommendation would be to indicate to the City of Evans that
the County will quit claim the property if and when they are
prepared to accept the Quit Claim Deed. Once Evans indicates they
will do so, and any necessary surveys are performed, the matter
would then be placed on your Board ' s agenda for execution of the
Deed(s ) .

REPORT ON: Old State Highway #3 in the City of Evans
between 35th Street and 39th Street

Dear Tom:
The following chronology of events regarding State Highway #3 (SH
#3) is broken down by Block. I have started at the North end of
this research project which is located immediately North of 35th
Street and then traveling South to 39th Street. As you will note
the Block numbers are not consecutive but follow the highway as it
travels to the South.
Each specific Block will be addressed separately with the inclusion
of my opinions and conclusions for that specific Block. Also
included within this report are rough sketches of each block and
the relationship of the specific parcels. It will be necessary to
refer to these sketches for the Block being discussed to follow the
parcel locations. I will try and work within each block from the
North to the South as I discuss the events as they occurred.
INTENT:
The intent of this report is to delineate the recorded position of
the Right-Of-Way (ROW) of the SH #3 as it travels along the
approximate Westerly line of the Union Pacific Railroad (UPRR)
within the City of Evans between 35th Street and 39th Street.
Certain documents were researched to comprise the basis of this
report. The conclusions and recommendations as stated herein are
my professional opinions based upon this research material . As
there are a considerable amount of documents involved in this
research I will not included a copy within this report.
STATE HIGHWAY #3 (SH #3)
SH #3 as referred to within this report is defined as follows:
Federal Road District No. 3 , State: Colorado, Federal Aid Project
Number: 146. The set of plans that I obtained from the Colorado
Department of Highways (CDoH) does not include any type of date to
indicate when this project was built. Many of the parcels of land

that were deeded to Weld County occurred during 1921. The CDoH did
realign this highway at its Southerly end which is indicated on the
following plans: Federal Road District No. 3, State: Colorado,
U.S.W.P.H. Project No. : W.P.M.H.-226-C"2. This realignment ties
into the "Old" SH f3 and does indicate a first revision date of
February 3 , 1936. It would appear from this information that SH
f3 as it was originally constructed occurred prior to that date.
UNION PACIFIC RAILROAD (UPRR) RIGHT-OF-WAY (ROW)
We have discussed the possible problem or at least the uncertainty
of the width of the ROW of the railroad between 31st Street and
42nd Street in the City of Evans.
In my discussions with a Mr. Jack Nelson with the UPRR in Omaha I
was informed that the railroad had in their opinion a "Determinable
Fee Title" to the ROW for the railroad as opposed to "Fee Simple
Absolute" or "Fee Simple. "
Black's Law Dictionary, Fifth Edition defines "Determinable Fee
Title" as:
Also called a "base" or "qualified" fee. One which has a
qualification subjoined to it, and which must be determined
whenever the qualification annexed to it is at an end. An
estate in fee which is liable to be determined by some act or
event expressed on its limitation to circumscribe its
continuance, or inferred by law as bounding its extent. An
estate that may last forever is a "fee," but if it may end on
the happening of a merely possible event, it is a
"determinable," or "qualified fee."
Based upon this information and my conversation with Mr. Jack
Nelson it is my understanding that the railroad has fee title to
the ROW as long as it's used for the purposes of a railroad. That
when and if the railroad should abandon the use of the property for
railroad purposes that the title reverts back to the Federal
Government or creating what is called "Determinable Fee Title. "
This than creates the situation were the railroad can not deed or
quit claim any of its ROW because it does not own the ROW. This
should be kept in mind in reading the remaining portion of this
report addressing the railroad ROW.
Southwest Quarter (SW1/4) of Section 20, Township 5 North, Range
65 West of the 6th P.M.
This being the area between 31st Street and 37th Street:
The patent from the United States TO Andrew H. Smith was recorded
May 6, 1873 in Book 8, Pages 453 through 454 and reads in part as
follows describing the parcel of land:

South West Quarter of Section Twenty in Township Five North
of Range Sixty five west in the District of lands subject to
sale at Denver City Colorado Territory containing one hundred
and sixty acres.
According to the official plat of the survey of the said
lands, returned to the General Land Office by the Surveyor
General which said tract has been purchased by the same Andrew
H. Smith. Now Know Ye, That the United States of America in
consideration of the premises and in conformity with the
several acts of Congress in such case made and provided, Have
Given and Granted and by these presents do give and grant,
unto the said Andrew H. Smith and to his heirs, the said tract
above described, To Have and To Hold the same together with
all the rights, privileges, immunities and appurtenances of
whatsoever nature thereunto belonging with the said Andrew H.
Smith, and to his heirs and assigns forever.
There are no specific reservations stated within this document that
addresses railroad ROW.
Northwest Quarter (NW1/4) of Section 29, Township 5 North, Range
65 West of the 6th P.M.
This being the area between 37th Street and 42nd Street:
The deed FROM John Evans, Trustee of the Denver Pacific Railway and
Telegraph Company TO David H. Moffat Jr. Trustee for the Denver
Land Association as recorded February 18, 1879 in Book 3 , on Pages
21 through 22 inclusive the following described parcel of land:
The North West quarter of Section Twenty nine (29) Township
Number Five (5) North in Range Sixty five (65) West of the
Sixth Principal Meridian containing One hundred and Sixty
acres more or less
Reserving to said company and its assigns Depot Ground as laid
off and the right of way for said Railway in width on each
side of the track one hundred feet in manner and form as
provided by the Acts of Congress.
The Congressional Act dated July 1, 1862, Chapter CXX, Sec. 2
address the width of the right-of-way and states the following:
"said right of way is granted to said railroad to the extent
of two hundred feet in width on each side of said railroad
where it may pass over the public lands. "
There have been four separate plattings of the City of Evans which
occurred during 1869, 1872, 1891, and 1908. All of these plattings
indicate that the ROW through the City of Evans is 100 feet on each

side of the track as laid out and not the 200 feet as indicated by
the Congressional Act of July 1, 1862.
The railroad restricted the width of the ROW within the NW1/4 of
Section 29 by stating the width as "and the right of way for said
Railway in width on each side of the track one hundred feet in
manner and form as provided by the Congressional Acts." The
problem here is that by the Act of Congress the width is defined
as being 200 feet in width on each side of the track. This creates
a conflict between the Act of Congress and the written document
created by the railroad.
It is apparent that someone discovered this and possibly other
problems along this line of track from Denver to Cheyenne. The
Congressional Act of June 24 , 1912, Chapter 181 addresses this line
of track and states the following:
"of or concerning land forming a part of the right of way
between Denver, Colorado and Cheyenne, Wyoming, of any said
companies granted by or held under any Act of Congress, and
all conveyances or agreements confining the limits of said
right of way, or restricting the same, are hereby legalized,
validated, and confirmed to the extent that the same would
have been legal or valid if the land involved therein had been
held by the corporation making such conveyances or agreement
under absolute or fee-simple title."
After my discussion of this problem with Mr. Russ Anson the
following determinations can in my professional opinion be made:
11: That within the NW1/4 of Section 29, the ROW of the UPRR is
100' feet on each side of the track. This determination is
based upon the restriction of this ROW within the deed FROM
John Evans, Trustee of the Denver Pacific Railway and
Telegraph Company TO David H. Moffat Jr. Trustee for the
Denver Land Association as recorded February 18, 1879 in Book
3 , on Pages 21 through 22 inclusive which states that the ROW
will be 100' feet on each side of the track.
Though the railroad could not make such a restriction of its
ROW at the time the NW1/4 was deeded to David H. Moffat Jr.
the Congressional Act of June 24, 1912 "legalized, validated,
and confirmed to the extent that the same would have been
legal or valid if the land involved therein had been held by
the corporation making such conveyance or agreement under
absolute or fee-simple title. "
This then allowed the restriction of the ROW in the SW1/4 of
Section 29.

12: The SW1/4 of Section 20 is a different problem entirely. The
Congressional Act of July 1, 1862 defined the ROW width as
being 200 feet on each side of the track.
The patent from the United States TO Andrew H. Smith was
recorded May 6, 1873 in Book 8, Pages 453 through 454
inclusive states in part: "in consideration of the premises
and in conformity with the several acts of Congress in such
case' made and provided, Have Given and Granted and by these
presents do give and grant, . "
It must therefore follow that the ROW as prescribed by the Act
of July 1, 1862 was part of the "several acts of Congress" and
therefore the ROW must be 200 feet on each side of the tracks.
There are two possible circumstances under which the ROW
within this SW1/4 has been restricted by either the acts of
the railroad or the adjacent property owners to 100 feet on
each side of the track. The first would be by the four
plattings and recording of the City of Evans plats which would
constitute constructive notice, or secondly by the actual
occupation of the Lots and Blocks within the platted areas.
In either case the ownership would have to be based upon
adverse possession.
The Congressional Act of June 24, 1912 goes on further to
state: "That in all instances in which title or ownership of
any part of said right of way heretofore mentioned is claimed
as against said corporation, or either of them, or the
successors or assigns of any of them, by or through adverse
possession of the character and duration prescribed by the
laws of the State in which the land is situated, such adverse
possession shall have the same effect as though the land
embraced within the lines of said right of way had been
granted by the United States absolutely or in fee instead of
being granted as a right of way. "
The determination that would have to be made is whether at the
time of the Congressional Act of June 24, 1912 the necessary
parts of adverse possession had been met as prescribed by the
laws of the State of Colorado at that time.
If all the parts of adverse possession has been met than the
ROW would be restricted to the 100 feet on each side of the
track. If adverse possession can not be met than the ROW
would remain at 200 feet on each side of the track as
prescribed by the Congressional Act of July 1, 1862.
There are two Quit Claim Deeds recorded September 8, 1916 both of
which are FROM the Union Pacific Railroad Company. The first one
is in Book 445, on Pages 523 through 524 inclusive and is TO
"Owners in fee simple of their respective portions of the real

estate hereinafter described." The second one is in Book 445, on
Pages 524 through 525 inclusive and is TO "City of Evans,
Colorado. "
Essentially these documents Quit Claimed the railroads right of
way lying outside of a 100 foot strip of land on each side of the
tracks, or being the outside 100 foot of right of way of a 400 foot
total right of way reducing this right of way to 200 feet in total
width.
As stated before the railroad does not own this ROW in fee simple
absolute or fee simple and therefore can not deed this property.
In my conversation with Mr. Jack Nelson he stated that in his
opinion the Quit Claim to the adjacent property owners was an
invalid document and did not transfer any property. He further
stated that he believed that the railroad could deed the platted
street ROW within the City of Evans that was within the ROW of the
UPRR to the City of Evans.
During my conversations with Mr. Russ Anson he stated that due to
the reversionary clause within the Quit Claim that this document
was probably invalid. The statement reads as follows:
"THIS GRANT is made upon the further condition that if the
said grantee, its successors or assigns shall at any time
attempt to sell or otherwise dispose of any portion of said
premises or permit its use for railroad purposes by any other
person or corporation, or to use said premises except for the
usual and ordinary purposes of a street or highway, or shall
in any manner, abandon the use of said premises for street or
highway purposes, then this grant shall become null and void
and of no effect and all rights hereby granted and conveyed
shall thereupon cease and determine, and the premises hereby
granted shall revert to the said grantor herein, it successors
or assigns.
It is therefore my opinion that these two documents FROM the UPRR
are invalid documents. Mr. Russ Anson further stated that it was
his belief that if it were necessary to go to court to address the
issue of the ROW that no court would uphold the railroads claim to
a 400 foot ROW through the City of Evans.

CONCLUSION:
Only an actual location of the highway in relationship to the
platted Block and Street lines would determine whether a problem
exists in the position. My professional opinion at this time
though is that there is no problem within Block 158 between the
actual location of SH #3 and the parcel of land as described in

is located approximately 25' feet to the West of the Westerly ROW
line of the UPRR ROW. It would appear that Lot 5 is located
entirely within the area used for the ROW of SH #3. According to
the records of the Weld County Assessors Office (WCAO) George A.
Wicks and Mary C. Wicks own Lot 5 as described in Doc #13. It
would ails° appear from the sketch that Lot 6 is entirely located
within the area used for the ROW of SH #3. Doc #7 deeded Lots 3
through 6 FROM George K. Brown TO J.O. Ireland and Doc #9 deeded
Lot 3 FROM J.O. Ireland TO Prexy Wilson. This is the last time in
the title chain that Lot 6 appears. From these existing deeds it

NORTH HALF (N1/21 OF LOT ELEVEN (111 and LOT TEN (101 :
Document #19 (Doc #191 : Book 650, Page 123 as recorded June 30,
1921.
This document deeded a strip of land Fifty feet (50' ) in width
across the aforesaid lots. The Easterly line of said 50' strip of
land being coincident with the Westerly ROW line of the UPRR.
CONCLUSIONS:
It appears that Weld County owns in fee the strip of land within
Lots 1, 2, 12, 11, and 10 for the ROW of SH #3 and that this strip
of land varies in width from 50' to 60' .
It appears that the use of the strip of land across Lots 3, 4, 5,
6, 14 , and 13 is by prescription.
It should be noted at this time that there have been several tax
sales of Lots 1 through 6 where these lots were sold to Weld
County. On December 14, 1931 by Certificate #937 Lots 1 thought
5 LESS HIGHWAY were sold to Weld County, and was redeemed on
February 13 , 1932 by C.M. Christensen. On December 15, 1939 by
Certificate #57 Lots 1 through 6 LESS HIGHWAY were sold to Weld
County, which Lots 1 through 3 and Lot 6 LESS HIGHWAY were redeemed
on January 8, 1940 by C.D. Pearson, and Lots 4 and 5 were redeemed
by Louis and Louise Warmuth on May 13, 1940 with no reference made
to highway.
Please note the reference to the highway within these tax sales.
PROBLEM:
Document #20 (Doc #201 : Book 1567, Page 56 as recorded September
22, 1960.
This document vacated the North/South alley within Block 167 as
indicated on the attached sketch by the cross hatched area. The
use of this strip of land for SH #3 would be by right based upon
the dedication of this area in the platting of the City of Evans
as a public way or alley. As can be seen in the sketch for Block
167 where the ROW for SH #3 travels along the Easterly line of this
Block in the area of this vacated alley this right has now been
vacated because of Doc. #20 and the use of this area would be by
prescription as the ownership of this alley would revert to the
adjacent property owners because of this vacation.

It appears that Weld County owns all that part of Lot 8 lying East
of the line described. The West line of this strip of land is tied
to the location of the actual pavement and not the UPRR ROW as
indicated in Doc #22 for Lots 6 and 7. It would also appear that
the West line of the ROW for SH #3 would jog to the West as
indicated in the attached sketch for Block 173.
LOT NINE (91 :
Document #25 (Doc #251 : Book 622, Page 150 as recorded June 30,
1921 deeded FROM Frank Loustalet TO Weld County all of Lot 9.
Document #26 (Doc #261 : Book 914, Page 356 as recorded May 28 ,

It appears that Weld County owns all that part of Lot 9 lying East
of the line described. The West line of this strip of land is tied

RECOMMENDATIONS:
As indicated within the notes for Lots 8 and 9 on the attached
sketch for Block 173 the ROW for SH #3 in Lots 8 and 9 is tied to
the centerline of the highway as constructed. There appears to be
a jog in the Westerly line of the ROW because of this situation.
It appears from all of the documents that I have viewed that
generally the ROW for SH #3 is 50' in total width and in some 60'
in width but the ROW is centered on the centerline of the existing
highway. This does not appear to be the case in these two lots.
It may be possible to abandon part of the ROW of SH #3 to the West
of the centerline of the existing highway.

Document #27 (Doc #271 : Book 622, Page 300 as recorded January 10,
1922 deeded FROM Ruth C. Erickson TO County of Weld a strip of land
described by a meets and bounds description.
When calculated the width of this strip of land is 50' . There does
appear to be a possible problem with some of the dimensions within
this description as it describes more ground along the North and
Easterly line of said Block 4 than is platted.
In any event the Easterly line of this strip of land does tie by
description to the Westerly ROW line of the UPRR which may
alleviate any problems with the location of this described parcel
of land.
CONCLUSIONS:
It may be necessary to locate the boundary of Block 4 to determine
exactly what part of this Block is affected by this description.
Document 128 (Doc #281 : Book 1234, Reception Number 02181454 as
recorded June 2, 1989 indicates the current holder of title of this
Block. This deed only addresses Lots 2 through 9 and does not
indicate any reference to the 50' strip of land as indicated in Doc
#27 . This deed also does not indicate Lot 1.
It appears that Lot 1 is entirely located within the ROW of SH #3
and that title to this lot passed in Doc #27.

recorded August 14, 1969 is a vacation of the ROW of 8th Street
(Now 38th Street) between Idaho Street and Denver Street.
As can be seen in the attached sketch the ROW for SH #3 crosses a
portion of this vacated street. The use of this land for SH #3
would be by right based upon the dedication of this area in the
platting of the City of Evans as a public way or street. As can
be seen in the sketch for Block 5 where the ROW for SH #3 travels
along the Westerly line of the UPRR ROW in the area of this vacated

As far as I can determine Weld County still owns this strip of
land.
CONCLUSION:
Please note on the attached sketch for Block 12 that there is a
strip of land platted along the Westerly ROW line of the UPRR.
There are no dimensions indicated on any of the four (4) plats for
the City of Evans. There also is no street name indicated for this
strip of land. As a last resort I scaled this dimension on all 4
of the plats as are on file in the office of the Weld County Clerk
and Recorders (WCCR) .
This strip of land scales between 40 feet and 45 feet in width.
The strip of land as described in Doc #33 is described so that the
Easterly line of said 50' strip of land is coincident with the
Westerly ROW of the UPRR and because of the platted strip of land
as previously indicated only approximately the Easterly 5 feet to
10 feet of Lot 1 was deeded to Weld County for SH #3.
Also note that the Westerly ROW line of SH #3 is indicated on the
attached sketch for Block 12 by a dashed line. Note that this line
is West of the West line as deeded in Doc /33 . This may or may not
be a problem depending upon where the actual roadway is constructed
in relationship to the platted Block lines.
Doc #31 is a vacation of the ROW of 8th Street (Now 38th Street)

recorded April 5, 1977 is a Personal Representative Deed TO Joan
M. Roberts and addresses Lots 2 and 3. The document does reference
a strip of land along the East side for highway.
The reference in Lot 2 indicates that the width is 60 feet.
Document 135 (Doc 1351 : Book 650, Page 120 as recorded June 30,
1921 FROM Sam Maxwell TO Weld County is a Warranty Deed and
describes the following parcel of land: `That portion of Lots Two,
Three, and Four (2,3 ,4) , Block Twelve (12) , Town of Evans,
according to the recorded plat thereof, lying between straight
parallel lines, the Westerly of which intersects the West boundary
of said Lot 2 at a point 75 feet North of the Southwest Corner of
said Lot 2 and intersects the East boundary of said Lot 4 at the
Northeast Corner of said Lot 4. '
This line is indicated on the attached sketch for Block 12. Please
note that the Westerly line is indicated on the sketch and that the
Easterly line would run into the platted strip of land being
approximately 40 feet to 45 feet in width lying between Block 12
and the Westerly. ROW of the UPRR. (See note within this Block
description explaining this strip of land)
CONCLUSIONS:
I do not see any major problems within this block. Please note on
the sketch for Block 12 that the Westerly ROW of SH 13 as indicated
on the CDoH plans would indicate that a portion of Lot 5 may be
included within the use of SH 13. This could only be determined
by an actual location of the constructed highway and the platted
Block lines.

The majority of the ROW of SH /3 appears to be in fee simple by
either Warranty Deed or Quit Claim Deed to Weld County. There are
areas that appear to be by prescriptive use. This is caused by the
fact that no specific documents were recorded indication the
transfer of the appropriate property. It does appear interesting
though that there are parcels being used apparently by prescription
that are bounded on the North and South by deeded parcels. This
may be caused simply by the fact the appropriate documents were
executed but never recorded.
I have been unable to locate any type of information within the
records of Weld County relative to this research project. I was
able to locate the set of drawings from the CDoH for SH 03 as
indicated within this report. From this information the highway
does not appear to be a straight line parallel with the ROW of the
UPRR but the centerline has several small curves located along its
length.
Of the apparent 32 Lots affected by the ROW of this highway 24 of
these Lots have deeds to Weld County addressing this ROW and the
remaining 8 Lots are apparently by prescription.
There are two areas as noted where one street and one alley have
been vacated by the City of Evans that may cause some problem with
the ROW of SH 03.
There is no way that I can determine at this time based only upon
this research whether there may be a problem with the actual
placement of the constructed roadway in relation to the deeded
parcels of land. Only a Land Survey of this area would make this
determination.
This research project has been as extensive as possible with
research being conducted through many different agencies within
Greeley, Weld County, and the UPRR in Omaha.

Dear Tom:
The following is provided as per our conversation of December 17 ,
1990 regarding the manner of presentation of this information. I
would also suggest that a meeting be set up to go over this
material with you and other people wi hin the City of Evans to
answer any questions that will no dobbt arise based upon this
information.
The purpose of this research was to determine the standing of the
right-of-way (easement) of the old State Highway 13 (SH/3) between
39th Street and 42nd Street and West of the Union Pacific Railroad
(UPRR) . I have broken this information down by blocks to help
delineate this title track. The copies of the abstracts that you
provided have been extremely helpful in this research.
BLOCK 21 :
Lots One ( 1 ) through Six ( 6) :
Though these lots are not owned by `Michaud' it does indicate the
existence of the old highway right-of-way (ROW) .
Document 11 (Doc . 11) : Recorded March 19 , 1917 , Book 362 , Page 425
is a deed from `The Northern Colorado Elevation Company' TO `The
Colorado Milling & Elevator Company . ' This deed addresses Lots 1
through 6 . No reference to any existing roads or ROW's is
addressed within this document.
Document 12 (Doc . /2) : Recorded July 26 , 1949 , Book 1158 , Page 461
is a deed from `The Colorado Milling & Elevator Company' TO `Arthur
C Roberts and Laurin H. Roberts . ' This deed also addresses Lc`_s
1 through 6 , Block 21 , BUT also states `subject to rights-of-Way
for public highway and railroad as now located. '
CONCLUSION: I have been unable to locate any information that
would indicate that Weld County ever owned, or was deeded any part
of Lets 1 through 6 of Block 21 . My professional opinion is that
the old roadway as constructed for SH 13 over any part of these

lots exists at this time by prescription. This is subject to
possibly obtaining information from Weld County regarding this
situation.
I should also point out that depending upon a survey of this
property that there may .be a small portion of some of these lots
lying East of the ROW of the old SH #3 .
Lots Seven (7 ) through Nine (9) :
Document #3 (Doc . #3 ) : Recorded July 10 , 1918 , Book 509, Page 55
and is a deed from `The I . Rothschild Produce Company' TO `The
Great Western Sugar Company. ' This deed addresses Lots 7 through
9 . No reference is made to any roads or ROW's.
Document #4 (Doc. #4 ) ; Recorded August 29 , 1931 , Book 919 , Page
34 and is a deed from `The Great Western Sugar Company' TO `James
R. Hayes. ' This deed addresses Lots 7 through 9 , BUT contains the
following reservation: `Reserving, however, from said Lots 7, 8 and
9 , a strip of land 50 feet wide , the central portion whereof is
occupied by the concrete highway constructed by the County of Weld,
as the same appears on said lots. '
CONCLUSION: Again I have been unable to locate any information
that would indicate that Weld County ever owned, or was deeded riy
part of Lots 7 through 9 of Block 21 . My professional opinion Is
that the old roadway as constructed for SH #3 over any part of
these lots exists at this time by prescription. This is subject
to possibly obtaining information from Weld County regarding this
situation.
Lots Ten ( 10 ) through Twelve ( 12 ) :
Document #5 (Doc . #5) : Recorded June 30 , 1921 , Book 650 , Page 122
and is a deed from `James Hayes, known also as J. R. Hayes' TO
`Weld County, Colorado. ' This is a Warranty Deed and addresses the
East Forty feet ( E. 40 ' ) of Lots 10 through 12 and deeded this
portion to Weld County in Fee Simple.
Document #6 (Doc . #6) : Recorded July 30 , 1937 , Book 1013 , Page 500
and is a deed from `Weld County, Colorado' TO `Mr. William H.
Harris . ' This is a Quit Claim Deed and addresses `All that part
of Lots Ten ( 10 ) , Eleven ( 11) , and Twelve ( 12 ) , in Block Twenty One
( 21 ) , Town of Evans according to the recorded plat thereof , not
included in the right of way of Highway No . 85 as now laid out and
constructed. '
CONCLUSION: It appears that Weld County owns the ROW for SH #3 in
Fee Simple. Weld County took title in Fee Simple to the East 40
feet of Lots 10 through 12 and then deeded by Quit Claim that part
NOT included in the ROW.

BLOCK 24:
Document #7 (Doc. #71 : Recorded June 30 , 1921 , Book 650 , Page 126
is a Warranty Deed from `Julius Holick, known also as Julius
Hollick' TO `Weld County, Colorado' and addresses `the North 140
feet of Block 24 . '
Document #8 (Doc. #81 : Recorded June 30 , 1921 , Book 650, Page 127
is a Warranty Deed from `George H. Young' TO `Weld County,
Colorado' and addresses `All that part of Block 24 , lying South of
the North 140 feet. '
At this point Weld County, owns all of Block 24 in Fee Simple.
Document #9 (Doc. #91 : Recorded October 18 , 1934 , Book 967 , Page
269 is a Quit Claim Deed from `Weld County Colorado' TO `Charles
W. Michaels' and addresses `All that part of Block 24, lying West
of a line parallel to an twenty-five feet West of the center line
of the paved concrete highway across said block. '
This deed goes on further to state `reserving, however, to the
party of the first part a right of way for highway purposes, a
strip of land five ( 5 ) feet wide lying adjacent to and immediately
West of the East boundary of the land herein conveyed. '
CONCLUSION: It is my professional opinion that Weld County,
Colorado owns in Fee Simple the ROW for SH #3 across Block 24 as
it is now constructed. It appears from all the information
obtained that the width of this ROW is Fifty feet ( 50 ' ) . It also
appears that a right-of-way (ROW) or easement exists along the East
line the of above property as described in Doc . #9 , being 5 feet
in width for `highway purposes' .
Document #10 (Doc. #101 : Recorded July 7 , 1937 , Book 1012 , Page
481 is a Quit Claim Deed from `Weld County, Colorado' TO `Charles
W. Michaels' and addresses `All that part, if any, of Block 24 in
the Town of Evans according to the recorded map or plat thereof ,
lying West of the right of way of the Union Pacific railroad Eid
East of the right of way of State Highway No. 85 . '
IN CONCLUSION: It appears that some of the ROW for SH #3 is by
prescription and some is in Fee Simple . I have been unable to
obtain any information from Weld County regarding this situation.
Depending upon the direction that the City of Evans wishes to
pursue regarding this matter it would be necessary in my opinion
for Weld County to participate in the vacation or abandoning of
this roadway. It would also be my suggestion that the Colorado
Department of Highways (CDoH) also be involved in this matter to
insure that all parties that have, or may have acquired an interest
in this roadway be involved in this process .

I have also looked at the platting of this portion of the City of
Evans regarding the strip of land located along the West line of
the UPRR. This strip of land is not dimensioned on any of the
following town plats , 1869, 1872 , 1891 , and 1908 . It is an
accepted standard within the surveying profession NEVER to scale
a drawing for the purposes of obtaining a dimension. As the
dimension for the width of this strip of land is not indicated on
any of the aforesaid plats I have scaled this width to try and
determine its APPROXIMATE dimension. It appears that this width
is APPROXIMATELY between 40' and 45' . It may be possible to
determine a more accurate width based upon the platted dimension
along the North line of Block 24 in relationship to the position
of the existing center line of the UPRR tracks. In any event this
area is in my professional opinion some type of street or alley
right-of-way and is NOT part of any block or the ROW of the UPRR.
I have also looked into the three following documents:
Document #11 (Doc. #11 ) : Recorded February 18, 1870 , Book 3 , Page
21 is a deed from `John Evans, Trustee of the Denver Pacific
Railway and Telegraph Company' TO D. H. Moffat, Trustee Denver Land
Association' the following property ` The Northwest Quarter of
Section Twenty-nine ( 29 ) , Township Five ( 5) North in Range Sixty-
five ( 65) West of the Sixth Principal Meridian. ' This deed
addresses the strip of land as reserved by the railroad and reads
as follows : `Reserving to said Company and its assigns Depot Ground
as laid off and the right of way for said Railway in width on each
side of the track one hundred feet in manner and form as provided
by the Acts of Congress in relation thereto. '
Document #12 (Doc, #12 ) : Recorded September 8 , 1916, Book 445 ,
Pages 523 and 524 and is a Quit Claim Deed from the `Union Pacific
Railroad Company' TO `Owners in Fee Simple if their respective
portions of the real estate hereinafter described, as such owners
appear of record' . '
Document #13 (Doc. #13 ) : Recorded September 8 , 1916 , Book 445,
Pages 524 and 525 and is a Quit Claim Deed from the `Union Pacific
Railroad Company' TO `the City of Evaqs This document states
`whereas the City of Evans is now using End desires to continue the
use for street purposes of a portion of the outer margin of the
right of way belonging to the said Union Pacific Railroad. ' This
document goes on further to state `or shall in any manner, abandon
the use of said premises for street or highway purposes, then this
grant shall become null and void and of no effect and all rights
hereby granted and conveyed shall thereupon cease and determine,
and the premises hereby granted shall revert to the said grantor
herein, its successors or assigns . '

CONCLUSION: We have had several discussions regarding the
reversion of ownership of vacated streets by the City of Evans
located within a strip of land thought to have been part of the ROW
of the UPRR. It would appear that by oc. 111 the railroad has not
owned any ROW other than a strip of land being one hundred feet in
width on each side of the track as per Doc. 111 and that Doc. 113
has no basis in creating a reversion of ownership.
RAILROAD PARK/DEPOT:
You also asked me to look into the ownership of that parcel of land
as indicated on the town plat as being `Railroad Park or Depot' .
This being a parcel of land bounded on the North by 39th Street,
on the East by Denver Street, on the South by 40th Street, and on
the West by the UPRR.
In researching this I checked the tractrindex at Transamerica Title
Company, here in Greeley. I found no tract or block index for the
following parcels : `Railroad' , `Park' , `Railroad Park' , or `Depot. '
I viewed the plats of the Town of Evans located in the Weld County
Clerk and Recorders office (WCCR) for the following years: 1869,
1872 , 1891 , and 1908 .
The 1869 plat indicates that the railroad ROW jogs out around and
includes this area and is designated as `Ry. Co. ' The 1891 plat
indicates a separation of this area from the railroad ROW by a
dashed line. My professional opinion at this time based upon the
information that I have viewed and the research that has been
completed is that this parcel of land is not and was not part of
the railroad ROW, based upon Doc, 111, but yet it is not and was
not part of the platting of the Town of Evans. The description in
Doc. 111 indicates that the railroad reserved `to said Company and
its assigns Depot Ground as laid off and the right of way for said
Railway in width on each side of the track one hundred feet in
manner and form as provided by the Acts of Congress in relation
thereto. '
CONCLUSION: Based upon this information it is my professional
opinion that the railroad DID NOT deed this parcel of land in Doc.
Ill , that it was not contained within the 1869 platting of the Town
of Evans , as this 1869 plat was signed November 26 , 1869 ,
acknowledged December 11 , 1869 and recorded January 3 , 1970 , and
Doc. #11 was signed December 13 , 1869 and recorded February 18 ,
1870 . It would therefore follow that the correct description of
this property would be a meets and bounds description or at least
as described by being bounded on the North by 39th Street, on the
East by Denver Street, on the South 40th Street, and on the West
by the ROW of the UPRR.

cause a problem in title should the wrong party be deeded the
property by the municipality upon vacation.
The preceding information is presented to help delineate the
apparent current ownership of the ROW of the old SH #3, Railroad
Park, and strip of land located along the West line of the ROW of
the UPRR. I realize that there is a lot of information contained
herein and as I recommended at the beginning, that I sit down with
you or other people form the City of Evans to answer questions that
will no doubt arise because of this research.
It has been my pleasure to do this research and prepare this report
and findings. The information as contained herein is based upon
current documents of record, the abstracts as provided to me by
your office, documents as located at the CDoH, and my professional
opinion based upon these preceding documents. It would also be my
suggestion to have Mr. Russ Anson, City Attorney, look this
information over and get his feelings as to what the cities
position should be regarding some of the problems as outlined.
