Thank you for your letter of September 11. The Department of Planning
Services' staff has reviewed your request. The staff has determined that
the enlarged receiving pit, the expansion of the concrete slab under the
aeration engine, and the concrete slab on the southwest corner of Pond C
would not be considered a material deviation from the plans approved for
Special Use Permit #454.
Building permits must be applied for and approved prior to the start of

Three areas at the site are in need of improvements as reviewed in the
blue prints .
1. We would like to enlarge the recieving pit , and surrounding concrete
area . This will increase the separation and reduce the pumping time
needed to keep the pit at an acceptable level .
2 . Expand the concrete slab under the aeration engine. This will enable
us to contain the entire engine and any leaks that might occur_
3 . Pour a concrete slab on the S.W. corner of Pond C. This will pro-
vide solid footing when we are skimming.

would facilitate these improvements please let me know.

motor support pad on the ponds and enlarging the receiving pit at the disposal
site.
The division approves of the construction so long as the entire project is
supervised by a registered professional engineer. The engineer shall assure that
the clay liners on the ponds are not compromised in any way during and after the
construction. No surface or sub-surface contamination shall occur during or
after the construction project. A letter from the engineer certifying that the

Dear Jane:
This letter will serve to specify and elaborate on the Division's interpretation
of the liquid waste stream that Weld County Disposal has been authorized to
receive regarding underground storage tanks
The basis for the waste is specifically water that has been contaminated with
gasoline or diesel fuel. This could include waste water from:
A. Groundwater tables adjacent to and contaminated by leaking storage
tanks.
B. Water removed from fuel storage tanks which held gasoline or diesel.
C. Water from fuel lines, transport truck tanks, pumps or other fuel
related equipment.
D. Water recovered from the surface of the ground which is contaminated
with gasoline or diesel fuel.
E. Water that has been used to flush and/or clean gasoline or diesel
fuel tanks, lines or equipment.
The amount of petroleum contamination is not a limiting factor because these
products are compatible with the existing waste stream. The level of lead can
be a limiting factor if it is too high. Any liquid waste containing toxic
substances or hazardous waste cannot be considered.
I think that this adequately defines the waste that is approved for the facility.

Dear Mrs. Godby:
Thank you for your letter of July 3. The Department of Planning Services'
and the Health Department's staffs have reviewed your request to accept
contaminated water recovered from leaking underground storage tanks. The
Planning staff has determined that the disposal of the materials would not
be a material deviation from approved Special Review permit #454. This
approval, however, is conditional upon the following requirements:
1. The waste from each clean up site shall be evaluated,
reviewed, and approved by the Weld County Health Department
on a case-by-case basis. No disposal of waste shall occur
without a letter of approval from the Weld County Health
Department.
2. The approved waste will be restricted to only water recovered
from sites contaminated by leaking underground storage tanks.
The approval shall limit the waste to only those sites
contaminated by diesel fuel and leaded and unleaded gasoline.
3. The liquid waste shall be tested in a laboratory approved by
the Weld County Health Department for the following:
- Total petroleum hydrocarbons
- Oil and grease chemicals
- Benzene
- Toluene
- Xylene
- Ethylbenzene
- Lead

4. The operator shall submit a request for review and approval
for each contamination site being considered to the Weld
County Health Department and a copy of the request to the
Department of Planning Services. The request shall include:
a. name and address of the property owner of the site being
cleaned up;
b. the operator or responsible party requesting to dispose
of the liquid waste;
c. the location of the site where the waste is being
removed;
d. the total amount, in gallons, of the waste to be
disposed; and
e. the laboratory analysis of the liquid waste.

The staff has reviewed the proposal from Weld County Disposal to receive for
disposal, contaminated water recovered from leaking underground storage
clean-up sites. The waste is compatible with the existing waste stream and
the request is not considered to be a substantial change from the Certificate
of Designation approved for the facility.
The Division recommends for approval with the following conditions:
1. The waste from each clean-up site shall be evaluated, reviewed and
approved by the Weld County Health Department on a case by case
basis. No disposal of waste shall occur without a Letter of
Approval from the Weld County Health Department.
2. The approved waste will be restricted to only water recovered from
sites contaminated by leaking underground storage tanks. The
approval shall limit the waste to only those sites contaminated by

Dear Keith :
Weld County Waste Disposal Inc . is requesting permission to
accept water from leaking underground storage tanks . We feel
this request is in no way a major deviation from the exsisting
water coming in to our site at the present time . The present
waste stream containsapproximately 2% by volume the same con-
stituents as to what we are requesting . This water may contain
small amounts of unleaded gasoline , diesel , or possible leaded
gasolines . In our screening process we are requesting an analysis
of the Total Lead Content or the Total Petroleum Hydrocarbons
for each site the water will be retrieved from. We will limit any
load with an excess of 10-20ppm. Due to the extreme need for
proper disposal of this type of waters , we feel it would be in
everyones best interest and in no way would there be a negative
impact to our environment , if disposed of properly .

gate . It will be placed on 12 ' beams that will be 2 ' deep in
the ground making the final sign dimensions 10 ' x4 ' .

This department has received the proposal by you concerning a variance on the
freeboard levels at the Weld County Disposal Brinewater facility located east
of Fort Lupton, Colorado. The freeboard levels have been set by the Development
Standards. These Development Standards were agreed upon by the County and the
owner of the facility, Howard Duckworth. This Division feels this request is

Dear Wes:
I would like to request -a temporary variance to the freeboard limits
set at the above referenced project. My last visit to the facility found
the operation was still meeting the freeboard levels as set by the
Development Standards. However, the freeboard levels were nearing
the three foot (3') limits allowed. Therefore, the owner has
requested my assistance to request a temporary variance.
We would like to request a temporary variance to allow the
freeboard limits to be raised to the two foot (2') limit. I do not
anticipate this request to be a problem since most impoundment in
the State and County have a two foot freeboard limit. We would like
this limit as a temporary measure to continue operations at the
facility until the ice disperses in Pond D, allowing the operator to
reinstall the sprayer system as approved in the past. The operator
will install the third leg of the system in Pond D as shown on the
plans and approved by the County.
The owner is only asking for this request until the freeboard limits
are then lowered to the freeboard limits agreed upon in the
Development Standards. The lowering of the water level will be
obtained by the reinstallation of the sprayer unit in Pond D and the
--effects- of better weather.
The owner does not want to install the sprayer system that has bin sujj
approved in Pond C until it is a necessity. I agree with the owners_ a
concerns with the system in this pond, due to the shape of the pond
and the proximity to the neighbor to the east. '�'

I further feel it is in the best interest for the County to allow the
temporary variance of the freeboard limits. This will allow the
facility to stay open therefore minimizing the potential for "midnight
dumping". I also feel the o*.vrer is making the attempt to work with
the County on this situation.
I do not anticipate this request to 'be an annual event. As you know
the facility did not get the sprayer system in operation until late last
summer. The sprayer system was a new system and needed time to
work out the bugs. I feel confident that the operator understands
the system much better, as was evident by the operator providing
annual maintenance during my last visit.
