RE: APPROVAL OF RECORDED EXEMPTION NO. 1283 - DENNE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 1283 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1283 was
submitted by John and Anna Denne for property which is located in
part o£ the E§ SE} SEi , Section 29 , Township 6 North, Range 65
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 5 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following Conditions:
1) A Weld County septic permit is required for the proposed
home and its septic system shall be installed according
to the Weld County Individual Sewage Disposal System
(ISDS) Regulations .
2) The following notes shall be placed on the Recorded
Exemption Plat prior to recording:
a) "A Flood Hazard Development Permit will be required
for any new construction or the substantial
improvement of existing structures in the Floodway
or Floodprone Districts located on the property.

b) "The property shall be maintained in accordance
with the Weld County Airport Overlay Zone
Regulations. "
3) The applicant shall submit a mylar plat to the
Department of Planning Services to be recorded in the
office of the Weld County Clerk and Recorder. The plat
shall be prepared in accordance with the requirments of
Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within 60 days
from the date of approval by the Department of Planning
Services. The applicant shall be responsible for paying
the recording fees.
4) There shall be only one access onto Weld County Road 41
from the created parcels .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 11th day of
July, A.D. , 1990 .

RE-1283
I. A Weld County septic permit is required for the proposed home and its
septic system shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) regulations.
2. The following notes shall be placed on the Recorded Exemption Plat
prior to recording:
- "A Flood Hazard Development Permit will be required for any
new construction or the substantial improvement of existing
structures in the Floodway or Floodprone Districts located on
the property."
- "The property shall be maintained in accordance with the Weld

Re: Recorded Exemption #1283
Dear Commissioners:
This request for a recorded exemption is submitted by John and Anna Denne.
The parcel of land is described as part of the Ei SE} SE} of Section 29,
T6N, R65W of the 6th P.M. , Weld County, Colorado. The property is located
at the northwest corner of Weld County Road 64 ("0" Street) and Weld County
Road 41 (First Avenue) . This request is to divide a 9.9 acre tract,
creating a 4.5 acre tract and a 5.4 acre tract.
The Department of Planning Services' staff recommends this application be
denied. It is the opinion of the Department of Planning Services' staff
that the use of the recorded exemption process to create this type of linear
development evades the purpose of the Weld County Subdivision Regulations.
The applicant has failed to show how this proposal is consistent with the
following elements of Section 1 - 3 of the Weld County Subdivision
Regulations:
1. To ensure conformance of land subdivision plans with the public
improvements plans of the County and its various municipalities.
2. To ensure coordination of intermunicipal public improvements plans and
programs.
3. To encourage well planned subdivisions by establishing adequate
standards for design and improvement.
4. To promote the health, safety, and general welfare of the residents.
If this application is approved, there will be 23 parcels accessing Weld
County Road 41 within one mile. Continued development in this area will
create increased traffic and the need for a higher level of services.

This application is not consistent with specific urban growth boundary goals
and policies outlined in the Weld County Comprehensive Plan which are:
I. Land-use development proposals within an urban growth boundary shall be
encouraged so long as they conform to the desires of the municipality
as expressed in its comprehensive plan or by its land-use decision
making body and if the municipality has agreed to provide services.
2. Maintain land-use regulations in the urban growth boundary areas that
allow the County and municipalities to coordinate plans, policies, and
standards relating to land use, zoning regulations, street and highway
construction, public infrastructure systems, and other closely related
matters affecting the orderly development within urban growth boundary
areas.
In its letter of June 8, the City of Greeley Planning Department recommended
denial and stated that the division would be in conflict with its goal of
keeping residential development at one unit per twenty acres within its
urban growth boundaries. In the southeast quarter of this quarter-section
(consisting of forty acres) , there are four existing parcels, making the
current density one unit per ten acres. This level of density is twice that
which the City of Greeley recommends.
The applicant has also failed to explain how this application is consistent
with the Weld County Comprehensive Plan and the guidelines used to allow an
agricultural lot to be divided into two lots as stated in Agricultural
Policy 117. The purpose of the guidelines is to:
a. enable the property owner, who is retiring, an opportunity to live on
or sell the existing farm improvements;
b. enable the property owner to sell off agricultural land that is
nonproductive for one single family dwelling homesite; and
c. enable the property owner to provide a residence for direct members of
the farm family and also, for workers employed at the farm.
The intent of the recorded exemption process is to create lots in accordance
with the adopted policies and regulations. The applicant has not
demonstrated in the submitted application materials that the proposal is
consistent with the recorded exemption policies and regulations.

Gentlemen:
On behalf of John E.Denne and Anna B. Denne , I submit this
proposal to divide their 9 . 2 acre parcel (subject to
approval of the proposed Subdivision Exemption) . At which
time they wish to sell one of the proposed parcels and
retain one as a personal building site .
The proposal is consistent with the Weld County
Comprehensive plan and the existing surrounding land uses
because along 1st Street to the North, and especially the
South, the area consists of well maintained residential
acreages . The area is zoned agriculture and had been
taxed, based on a feedlot use . The new owners plans are
compatible with the overall complexion of this area and
are consistent with efficient and orderly development .
Domestic water is available through North Weld County
Water District and sewage disposal is by septic system.
There is also Natural gas service available. The property
does not lie in a flood plain and is in the City of
Greeley and the Weld County Airport overlay district area.
