RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION
AGAINST CERTAIN PARTIES FOR VIOLATIONS OF THE WELD COUNTY BUILDING CODE
AND ZONING ORDINANCES
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Alberto S. Haro and Maria DeJesus Ramos V. DeHaro, BCV #2082, Rudy
and Soledad Dominguez, VI #2022, Joyce M. Greenfield, VI #2016, Donna and Harvey
Carey, BCV #1940, and Vincente Martinez, BCV #1961, are alledgedly in violation
of the Weld County Building Code and Zoning Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the
violations have not been corrected, and
WHEREAS, on the 8th day of March, 1994, a public hearing was held before
the Board of County Commissioners for the purpose of hearing any testimony
relating to said violations, and
WHEREAS, Maria DeJesus Ramos V. DeHaro, Donna Carey, Vincente Martinez, and
Don Greenfield, representing Joyce M. Greenfield, were present at said hearing,
and
WHEREAS, Rudy Dominguez was not present at said hearing, although he was
in contact with the County Attorney's Office by phone, and
WHEREAS, the Board of County Commissioners delayed referral of said
violations to the Weld County Attorney's Office for a period of thirty days to
allow adequate time for property owners to bring subject properties into
compliance, and
WHEREAS, the Board deems it advisable to proceed with legal action against
the above named individuals without further Board action if the subject
properties are not brought into compliance within thirty days.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violations still exist on April 8, 1994, the Weld
County Attorney be, and hereby is, authorized to proceed with legal action
against Alberto S. Haro and Maria DeJesus Ramos V. DeHaro, Rudy and Soledad
Dominguez, Joyce M. Greenfield, Donna and Harvey Carey, and Vincente Martinez,
to remedy the violations of the Weld County Building Code and Zoning Ordinances,
and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified
parties.

October 27, 1993 Property inspected. Property still in violation.
January 21, 1994 Zoning Permit for a Mobile Home #1874 was denied.
Permit canceled.
February 10, 1994 Property inspected. Property still in violation.
February 23, 1994 Property inspected. Property still in violation.
February 25, 1994 Letter sent to property owner indicating that the
violation case was scheduled before the Board of County
Commissioners.
February 28, 1994 Owner talked to Monica Daniels-Mika on how to solve
zoning issue.
The installation of a mobile home without a building permit is a violation of
Section(s) 70 of the Weld County Building Code Ordinance. To correct the
violation a mobile home building permit must be approved and issued or the mobile
home must be removed from the property.
The Department of Planning Services recommends that the County Attorney be
authorized to proceed with legal action against any other persons occupying the
properties, any person claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

The purpose of this letter is to summarize the different points which were
discussed during our conversation on February 28, 1994.
At this meeting we mutually agreed that the actions which need to be taken to
correct this violation are:
1. Remove the mobile home.
2 . Obtain the appropriate zoning and building permits for temporary
storage which would allow the mobile home to remain on the property
for six months. Utilities are not permitted to be hooked-up to the
mobile home. Blocking and tie-downs are required.

questions concerning this matter, please call or write.

I met with Vincente Martinez on February 28, 1994. According to our conversation
Mr. Martinez wanted to initiate action to correct his current building code
violation on Lot 2, Block 24, Aristocrat Ranchettes (7704 Woodruff) . I explained
to Mr. Martinez that prior to obtaining a zoning permit for a mobile home to be
used for temporary storage, he would need to proceed with a substantial change
hearing. Mr. Martinez also expressed some interest in moving the existing mobile
home, which is currently in violation, to another lot which has a zoning permit
for a mobile home for a principal dwelling ZPMH-1496 (Lot 2, Block 6 of
Aristocrat Ranchettes) . In order to move the mobile home, I explained to Mr.
Martinez that he would need to obtain all of the appropriate permits.
