RESOLUTION
RE: APPROVE AGREEMENT FOR SNOW REMOVAL, SANDING AND CINDERING WITHIN THE
BOUNDARIES OF THE TOWN OF MEAD AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Snow Removal,
Sanding and Cindering within the Boundaries of the Town of Mead between the Town
of Mead and Weld County, Colorado, by and through the Board of County
Commissioners, commencing January 25, 1993, and ending December 31, 1993, with
the further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Snow Removal, Sanding and Cindering
within the Boundaries of the Town of Mead between the Town of Mead and Weld
County, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 25th day of January, A.D. , 1993.

AGREEMENT FOR SNOW REMOVAL. SANDING AND CINDERING
WITHIN THE BOUNDARIES OF THE TOWN OF MEAD. COLORADO

of 044. , 1993, by and between THE TOWN OF MEAD, hereinafter
ref red ag7"Town, " and THE COUNTY OF WELD, STATE OF COLORADO, by and through
the Board of County Commissioners of the County of Weld, Colorado, hereinafter
referred to as "County. "
WHEREAS, Town is desirous of entering into a contract with the County for
the performance of snow removal, sanding and cindering on WCR 7 and WCR 34
within the boundaries of the Town of Mead, and
WHEREAS, County is agreeable to rendering such services pursuant to the
terms and conditions hereinafter set forth, and
WHEREAS, Agreements between County and other governmental entities are
authorized and provided for by the provisions of Section 29-1-203, C.R.S. , and
so provided for Section 2-3 of the Weld County Home Rule Charter.
NOW, THEREFORE, pursuant to the terms of the aforesaid statute and Weld
County Home Rule Charter, and in consideration of the mutual promises and
covenants contained herein, it is agreed as follows:
1. That the County, by way of the Road & Bridge Department, agrees to
provide snow removal, sanding and cindering when necessary on WCR 7
and WCR 34 within the boundaries of the Town of Mead.
2. That the County shall furnish and supply all labor, supervision and
equipment for said services.
3. The Town shall phone the Road & Bridge Department or submit in
writing to the County a request for road services. The Town
understands that County projects will be given priority and that snow
removal, cindering or sanding will be scheduled so as not to
interfere with County work.
4. The Town agrees to pay the County for the services rendered under
this agreement. The agreement shall run from year to year unless
terminated by either the Town or the County, providing the party
seeking to terminate this agreement gives the other party ten (10)
days written notice. The fee will be $425.00 per year. The Town
will be billed annually for all snow removal, sanding and cindering
performed by the County for the calendar year.
5. The County understands that it will not necessarily be the exclusive
contractor for this type of service and that Town may employ whomever
it determines to be most adequate to perform such services.

6. The Town shall indemnify the County, its officers and employees,
against liability for injury or damage caused by any negligent act
or omission of any county employees or agents in the performance of
this agreement, and shall hold the County harmless from any loss
occasioned as a result of the performance of this agreement.
7. This agreement shall commence on the date of the signing herein, and
shall continue until December 31, 1993, and shall run from year to
year unless terminated by either the Town or the County, providing
the party seeking to terminate this agreement gives the other party
ten (10) days written notice.
IN WITNESS WHEREOF, the parties hereto agree to the terms and conditions
