HomeMy WebLinkAbout930792.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1524 - ANDOLSEK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1524, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1524 was submitted by Edward and Esther Andolsek for property which is described as Lot B of RE #174, being part of the W? of Section 2, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 162 acres and 4 acres, more or less. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. A Weld County septic permit is required for the proposed home, and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 3. An Individual Sewage Disposal System Permit must be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. The parcel of land on which this subdivision request is being made is described as Lot B of RE-174 being a part of the W2 of Section 2, T6N, R65W of the 6th P.M. , Weld County, Colorado. The property is located approximately three miles east of the Town of Eaton. The request is to divide a 166.5 acre tract of land, which is the total contiguous land holdings of the applicants, into a 162 acre parcel and a 4 acre parcel, more or less. Two dwellings are located on proposed Lot A and no dwellings are located on proposed Lot B at this time. Access to the lot is provided from Weld County Road 45, a gravel county local road. Water service to the smaller lot is provided by North Weld County Water District, and is proposed for the larger lot. Sewer service is provided by a septic system to the smaller lot, and a septic system is proposed for the larger lot. The Department of Planning Services' staff recommends denial based on the level of development and the potential for continued division occurring in this area. The level of development in this area has reached a level where continued divisions may evade the intent and purpose of the Weld County Subdivision Regulations. The proposed four acre parcel would be the third small acreage, one right after the other, along the east side of Weld County Road 45. Section 2 contains 14 parcels, Section 3 to the west contains 15 parcels and Section 11 to the south contains 15 parcels, for a total of 44 parcels in a 3 square mile area. Utilizing the minimum lot size of 80 acres, one would expect to find only 24 parcels. Therefore, this immediate are is developed 83 percent more than what would be determined to be appropriate under the Weld County Zoning Ordinance. Furthermore, there are five dwellings in this tightly packed location, four stick-built homes and one mobile home. To make matters worse, there are four small acreages on the west side of Weld County Road 45, all with existing dwellings. The configuration of these lots on the county road constitutes a linear subdivision which is not consistent with efficient and orderly development. Approval of this recorded exemption will create additional accesses 930792 XL"- /5. z/ Board of County Commissioners RE-1524 Page 2 on to Weld County Road 45 and increase the density of the linear subdivision. Development in this area has reached a level where continued divisions evade the intent and purpose of the Weld County Subdivision Regulations. Due to the nature of the linear subdivision along Weld County Road 45, and development in the surrounding area, the Department of Planning Services's staff recommends this Recorded Exemption be denied by the Board of County Commissioners. We own another farm across the road from this parcel and have both farms for sale. The reason we are requesting this amended exemption is so that we may be able to retain our principal residence for our retirement. We have spent considerable time and money on our house and yard . We enjoy the location, and would like to spend our retirement there. The feed yard and feed shed would remain with the farm. Item 2 .
