HomeMy WebLinkAbout930304.tiff RESOLUTION RE: SET FEE FOR SPECIAL TRANSPORT PERMIT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Section 42-4-409 (1) (a) , CRS, Weld County, Colorado, as a "local authority" with respect to the highways under its jurisdiction may issue special transport permits to those persons operating or moving vehicles or combinations of vehicles of a size or weight of vehicle or load exceeding the maximum specified in Title 42 of the Colorado Revised Statutes or otherwise not in conformity with the provisions thereof, and WHEREAS, the Weld County Engineering Department has in the past been responsible for issuing said special transport permits and has charged the sum of $500.00 per transport to all persons transporting oil rig equipment over Weld County roads, and WHEREAS, recent weather conditions have caused soft spots, ruts, and water holes in many gravel Weld County roads which are normally firm, and WHEREAS, on Wednesday, April 7, 1993, and on April 9, 1993, the Board of County Commissioners met with representatives of various oil and gas companies which operate in Weld County, Colorado, wherein it was concluded that a majority of the damage to Weld County roads recently has been caused by the transporting of oil rig equipment, even though said transports were done pursuant to the issuance of special transport permits, and WHEREAS, at said meetings, the oil and gas representatives suggested and concurred to a proposal to raise the special transport permit fee for oil rig equipment to $1000.00, in order to pay for the damage caused to Weld County roads, especially during the recent wet weather conditions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Engineering Department is directed to require all persons requesting and/or applying for special transport permits to transport oil rig equipment on Weld County roads to pay the sum of $1000.00 per permit. BE IT FURTHER RESOLVED by the Board that said increased fee shall continue until such time as the Weld County Board of Commissioners deems it necessary and advisable to reduce the permit fee. BE IT FURTHER RESOLVED by the Board of County Commissioners that all such fees shall be paid into a special account to be used solely for the upkeep and maintenance of those Weld County roads severely impacted by the transport of oil rig equipment thereon. 930304 EA W 33- CC f �:y C✓l RE: SET FEE FOR SPECIAL TRANSPORT PERMIT PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of April A.D. , 1993.
