RE: APPROVE PURCHASE OF SERVICES AGREEMENT BETWEEN FENWC AND COLORADO
DEPARTMENT OF HEALTH'S MIGRANT HEALTH PROGRAM AND AUTHORIZE CHAIRMAN TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Purchase of Services Agreement
between the Family Educational Network of Weld County and Colorado Department of
Health's Migrant Health Program, commencing June 15, 1993, and ending October 6,
1993, with the further terms and conditions being as stated in said agreement,
and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Purchase of Services Agreement the between Family
Educational Network of Weld County and Colorado Department of Health's Migrant
Health Program be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 26th day of May, A.D. , 1993.

PURCHASE OF SERVICES AGREEMENT
THIS AGREEMENT, made and entered into this jig day of
'-Ifloe,r , 1993, by and between the Colorado Department of Health's Migrant
Health Program, hereinafter referred to as "Health Program," and the Weld County
Division of Human Resources' Family Educational Network of Weld county,
hereinafter referred to as "FENWC."
NOW, THEREFORE, in consideration of the mutual covenants herein, the
parties hereto agree as follows:
1. Physical Examinations:
The Health Program will provide physical examinations for Migrant Head Start
children from the Alamosa, and Fort Morgan centers. FENWC agrees to
reimburse the Health Program a maximum of $10.00 per child for the
examination services not to exceed $1,500.00 ($10.00/child x 150 children =
$1,500.00).
2. Nursing Services:
The Health Program will provide nurses and nursing students to serve the
Alamosa, Greeley, Frederick and Fort Morgan, and Brighton/Hudson centers.
Nursing staff includes:

3. Health Aides:
The Health Program will provide health aides for the Ft. Morgan,
Greeley, Frederick and Brighton/Hudson centers.

FENWC agrees to reimburse the Health Program a maximum of $6.20 per
hour for health aides for a total not to exceed $15,053.60 ($6.20/hr x
2,428 hours = $15,053.60).
4. Dental Hygienists
The Health Program will provide dental hygienists for the Northern
(Greeley, Frederick, Brighton, Hudson and Fort Morgan) and Alamosa
sites to provide preventive dental services to the children.

5. Dental Students/Graduates:
The Health Program will provide dental students/graduates for
Frederick, Hudson/Brighton and Fort Morgan to provide preventive
dental services, and screenings.

FENWC agrees to reimburse the Health Program a maximum
of $1447.60 for dental services.
6. Dental Services:
The Health Program will provide dental work above and beyond
preventive screenings for Fort Morgan and Alamosa FENWC centers.
FENWC will reimburse the Health Program a maximum of: $25.00 per
child X 5 children for the Fort Morgan location ($125.00), and $25.00
per child X 30 children for the Alamosa location ($750.00) for a maximum
total of $875.00.
7. Medical Care
The Health Program will arrange and provide medical care for acute
conditions and follow up on abnormal screening results for the Alamosa
and Fort Morgan FENWC sites. FENWC agrees to reimburse the Health
Program $25.00 X 50 children for treatment for the Alamosa location
($1,250.00) and $25 x 10 children in the Ft. Morgan location ($250.00),
not to exceed $1,500.00.
8. Pharmacy Services
The Health Program shall arrange and provide for pharmacy services
for the Fort Morgan and Alamosa FENWC sites. FENWC agrees to
reimburse the Health Program a maximum of $200 for Fort Morgan and
$700 for Alamosa for a maximum of $900.00.
9. Travel
The Health Program will pay summer staff for travel related to fulfilling
this contract including nurses, nursing students, health aide, and
dental hygienist assigned to all sites. FENWC agrees to reimburse the
Health Program a maximum of $2,500.00 (.25 x 10,000 miles =
$2,500.00).

c. No L. _acer, member, or employee of We,. County and no member
of their governing bodies shall have any pecuniary interest,
direct or indirect, in the approved Agreement or the proceeds
thereof.
d. The Health Program understands that monitoring and evaluation
of the performance of this Agreement shall be conducted by the
Weld County Division of Human Resources and the results
provided to the Weld County Board of Commissioners.
e. The Health Program and FENWC assure compliance with Title VI
of the Civil Rights Act of 1986, and that no person shall, on the
grounds of race, creed, color, sex, handicap, or national origin
be excluded from participation in, be denied the benefits of, or
be otherwise subjected to discrimination under the approved
Agreement.
IN WITNESS WHEREOF, the parties hereunto have caused this
Agreement to be duly executed as of the day and year first hereinabove set
forth.

10. Operating cpenses:
The Health Program will provide miscellaneous operating services to the
staff it employs to fulfill this contract including costs for recruitment,
orientation, nursing supplies, dental supplies, health education
supplies, office supplies, forms and keypunch. Equipment is excluded
and remains the responsibility of FENWC.
FENWC agrees to reimburse the Health Program for miscellaneous
operating expenses up to a maximum of $1,345.00.
11. Indirect Costs:
FENWC agrees to pay the Health Program an average of 15% indirect
costs to administer this program not to exceed $9,834.34.
12. Maximum Reimbursement:
The total maximum amount to be reimbursed to the Health Program
under this Agreement is $75,396.62. The Health Program will submit a
bill for services to FENWC no later than November 15, 1993.
12. Assurances:
a. The Health Program agrees that it is an independent contractor
and that its officers, employees, and clients do not become
employees of Weld County, and therefore are not entitled to any
employee benefits as Weld County employees, as a result of the
execution of this Agreement.
b. FENWC, the Weld County Board of Commissioners, its officers
and employees, shall not be held liable for injuries or damages
caused by any negligent acts or omissions of the Health Program,
its employees, volunteers, or agents while performing this
Agreement. The Health Program, its officers and employees,
shall not be held liable for injuries or damages caused by any
negligent acts or omissions of FENWC, or its employees,
volunteers, or agents while performing functions as described in
this Agreement. The Health Program shall provide adequate
liability and worker's compensation insurance for all of its
employees, volunteers agents engaged in the performance of this
Agreement, as required by the Colorado Worker's Compensation
Act. Likewise, FENWC, by and through the Board of Weld
County Commissioners, shall provide adequate liability and
workers' compensation insurance for all employees of FENWC
engaged in the performance of this Agreement.

Enclosed for Board approval is a Purchase of Service Agreement between the Family
Educational Network of Weld County (FENWC) and the Colorado Department of
Health's Migrant Health Program (Health Program) .
FENWC agrees to reimburse the Health Program a maximum of $75,396.00. The Health
Program will submit a bill for services to FENWC no later than November 15, 1993.
The term of this Agreement is from June 15, 1993 through October 6, 1993.
