RESOLUTION RE: SUBMITTING TO THE REGISTERED ELECTORS AT A SPECIAL ELECTION OF THE COUNTY OF WELD, STATE OF COLORADO, AN AMENDMENT TO THE HOME RULE CHARTER AND DECLINING TO SUBMIT A REFERRED ISSUE SEEKING TO REPEAL A RESOLUTION OF THE WELD COUNTY BOARD OF COUNTY COMMISSIONERS ADOPTED JUNE 17, 1991 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statue and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Clerk and Recorder reported on August 28, 1991, that they had reviewed the Petition to Initiate Amendment to the Home Rule Charter for Weld County and the Petition for Referendum on an Enacted Resolution, which reports to the Board are attached hereto as Exhibits A and B, and WHEREAS, Weld County Clerk and Recorder indicated that there appeared to be a sufficient number of valid signatures on both petitions but further that her review of the petitions did not extend to whether the subject matter of the proposed charter amendment and enacted resolution were of an administrative nature and thus, not subject to initiative or referendum, and WHEREAS, the Board has received an opinion from the Weld County Attorney's Office which indicates that both petitions involve subjects which may be considered as administrative rather than legislative in nature but further that there is a greater probability that a decision not to place the initiative on the ballot would be upheld upon judicial review than a refusal to place the referendum on the ballot, and WHEREAS, pursuant to Article XVII, Section 17-1 (1) (a) & (3) the Board shall- publish-ncadce of and call an election to be held not less than 30 nor more than 120 days after said publication; the text of any proposed amendment to be published with said notice, and WHEREAS, the Board directs the Weld County Clerk to the Board to publish the full text of said proposed amendments along with a Notice of Election no later than September 26, 1991, and WHEREAS, within 30 days of receipt of the report, which constitutes initiation of a proposed amendment to the Weld Countyshall Home notice leCharter, the and Board, pursuant to Article XVII Section 17-1 (3) , publish call an election to be held not less than 30 nor more than 120 days after said publication, and WHEREAS, there is no general election within the 120 days following date of publication, and WHEREAS, the Board finds and determines that the referendum on an enacted resolution pertains to issues of an administrative rather than a legislative nature and are, therefore, not appropriate issues to be made subject to referendum pursuant to the Weld County Home Rule Charter and the constitution of the State of Colorado. 911064 911953 L,C000 J GC kJ- J Pet uo tme s - Page 2 RE: BALLOT ISSUE - CHARTER AMENDMENT NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the initiated amendment to the Weld County Home Rule Charter be considered at a special election to be held October 29, 1991. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board shall publish notice of the election along with the full text of the proposed amendments in the New News, the legal newspaper for Weld County, no later than September 26, 1991. BE IT FURTHER RESOLVED that the form of the question and the text of the amendment be as set forth in the petitions submitted to this Board by the Weis County Clerk and Recorder on August 28, 1991. BE IT FURTHER RESOLVED that each elector voting at said election and desirous of voting for or against said amendment should cast his or her vote as provided by law either "Yes" or "No" on the proposition shown as "questions" in the Petition to Amend the Home Rule Charter for Weld County, sample of which is attached hereto as Exhibit C and incorporated by this reference. BE IT FURTHER RESOLVED that the Special Election called for October 29, 1Y91, may be conducted in accordance with the Mail Ballot Election Act and the regulations of the Secretary of State promulgated thereunder if the Clerk and Recorder is so directed by separate resolution of the Board. BE IT FURTHER RESOLVED that the Petition for a Referendum on an Enacted Resolution shall not be submitted to the electors of Weld County.
