APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that the
standards of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision
Regulations have been met. This Recorded Exemption is approved with the following
conditions in accordance with information submitted in the application and the
policies of the County.
A Weld County septic permit is required for the proposed home and its septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
An ISDS evaluation by the Weld County Health Department on all existing septic systems
will be necessary prior to issuing the required septic permits on the existing
systems.
The Individual Sewage Disposal System permit shall be finalized and approved by an
Environmental Protection Specialist within one (1) year of the application date.
The following note shall be placed on the recorded exemption plat prior to recording:
A Flood Hazard Development Permit will be required for any new construction or the
substantial improvement of existing structures in the Floodway or Floodprone Districts
located on the property.
The applicant shall submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County
Subdivision Regulations. The plat shall be submitted within sixty (60) days from the
date of approval by the Department of Planning Services. The applicant shall be

Dear Mr. Grubb:
We have reviewed the application material for the above referenced recorded exemption request
to divide an existing 35 acre tract of land into two parcels of land of approximately 1.26 acres and
34 acres.
The material presented indicates that an existing registered well currently serves a single family
dwelling and associated domestic uses located on the 35 acre tract. The existing dwelling and
outbuildings would be located on the proposed 1.26 acre parcel. Although the existing well was
not identified by permit number in the material you provided, a search of our records indicates that
the well is probably registered in this office under permit No. 126978. No change in the use of the
existing well is anticipated, and the proposed division of land would not violate the conditions of
approval attached to permit No. 126978.
According to the material provided, the 34 acre parcel is presently used for agricultural purposes,
and would continue to be used for agricultural purposes. The applicant has provided a letter of
commitment from the Central Weld County Water District indicating that the district would provide
water service, should the 34 acre parcel be developed. Information in our files indicates that the
Central Weld County Water District has adequate water resources to serve the parcel. We consider
this a one-time exemption and would provide an additional well permit for the 34 acre tract. Since
the proposed exemption would not require an additional well, we can recommend approval.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic
system and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
2. An I.S.D.S. Evaluation on all existing septic systems will be necessary
prior to issuing the required septic permits on the existing systems.
3. It is the policy of this Division not to recommend for approval of any lot
size less than one (1) acre, which will utilize an Individual Sewage
Disposal System.
4. Individual Sewage Disposal System permit must be finalized and approved by
an Environmental Protection Specialist within one (1) year of the

Godfrey Bottom Ditch Company, and together with all ditch rights and lateral rights for
the purpose of carrying water to and upon the above described premises and excepting
from the above described premises rights-of-way for ditches and public highways at the
same now exist.
Water service can be made available to the above described property provided all requirements
of the District are satisfied, including easements where required for District facilities.
Central Weld County Water District requires that contracts be consummated within one (1) year
from the date of this letter, or this letter shall become null and void unless extended in writing
