O. Box 4356, Englewood, Colorado 80155, hereinafter referred to as "Company. " WITNESSETH: WHEREAS, Company has contracted with the State of Colorado to provide topsoil and other materials for use in the construction of U.S. Highway 34, and WHEREAS, Company has been granted a permit from the Mined Land Reclamation Division of the State of Colorado, for the removal of topsoil and other materials from property located in Section 29, Township 5 North, Range 64 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, Company plans to haul said material off of said property onto Weld County Road 51 and proceed north to U.S. Highway 34, and WHEREAS, Company expects to run approximately 12,500 loaded trucks north from said property to U.S. Highway 34, and WHEREAS, County believes that said use of WCR 51 will cause extraordinary damage to the roadbed and road surface, and WHEREAS, County has the duty to maintain said portion of WCR 51 and make it safe for travel by the public, and WHEREAS, County has the authority, pursuant to Colorado law, to post its Weld County roads at weights that are reasonable and appropriate for the preservation of the road surface and for the safety of the public travelling thereon. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties hereto agree as follows: 1 . TERM: This Agreement shall commence as of the date of its signing as set forth below. The Agreement shall end upon the completion of the Company' s material hauling on WCR 51 and upon determination by County that Company has Page 1 of 3 Pages eC OO � � complied with all the requirements of this Agreement. Company shall notify the County of the date when said material hauling is completed. 2 . ROADWAY KEPT IN SAFE CONDITION: Company agrees to maintain the roadway in a safe condition for the travelling public during the term of this Agreement. Company shall perform the following maintenance: A. GRADING: Company agrees to grade WCR 51, between the point at which access is obtained thereon, northward to U.S. Highway 34, at least twice per day, and more often if necessary in order to keep the roadway surface in a condition safe for travel . B. REPAIR: Company agrees to gravel soft holes on the roadway surface and otherwise repair any other holes or soft spots as necessary in order to keep said stretch of WCR 51 in a safe condition for travel. C. BRIDGE : Company agrees to guarantee that the bridge located on WCR 51, approximately 6/10ths of one mile south of U.S. Highway 34 , shall be in the same condition after the hauling of said materials is completed as it was in before the project commenced. County shall have the sole right to inspect said bridge after the hauling is completed and to order Company to perform necessary repairs, or to perform necessary repairs at Company' s expense. 3 . DUST CONTROL: Company agrees to place magnesium chloride on said stretch of WCR 51 in front of the houses located thereon. Company also agrees to water the remaining portion of the haul route on WCR 51 on an as needed basis . 4 . PAYMENT IN LIEU OF GRAVELING: Company agrees to pay the sum of $8,500 .00 to County on or before Tuesday, August 27, 1991, in lieu of the normal County requirement of graveling the entire width and length of the haul route upon the completion of the material hauling. 5. BOND: Company agrees to provide County with a $10,000 . 00 bond which shall ensure that the Company will : A. Maintain the roadway in a safe condition during the material hauling. Make necessary repairs or pay for any necessary repairs to the bridge upon completion of the material hauling. 6 . WEIGHT POSTING OF ROADWAY: In consideration of the above agreements on the part of Company, County agrees to forebear from posting said portion of WCR 51 at a weight which is lower than the weight of the haul trucks owned by Company as fully loaded, only if said trucks are twenty-two fee(/t or less in length.
