RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL AND GAS EQUIPMENT STORAGE YARD - SNYDER OIL CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 4th day of August, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Snyder Oil Corporation, 1625 Broadway, Suite 2200, Denver, Colorado 80202, for a Site Specific Development Plan and Special Review Permit for an oil and gas equipment storage yard on the following described real estate, to-wit: Part of the SE* SE4 of Section 35, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, at the hearing on August 4, 1993, said matter was continued to August 18, 1993, at 10:00 a.m. , to allow the applicant time to respond to proposed Development Standards, and WHEREAS, at the hearing on August 18, 1993, said applicant was represented by Dan Nelson, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies. This proposal will not remove any prime agricultural land from production. 930810 SPECIAL REVIEW PERMIT - SNYDER OIL CORPORATION (S35, T4N, R66W) PAGE 2 b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for in the Weld County Zoning Ordinance as a Use by Special Review. c. The permitted uses will be compatible with the existing surrounding land uses which include pasture, agricultural production, and oil and gas production. d. The permitted uses will be compatible with the future development of the surrounding area which is expected to remain agricultural. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an oil and gas equipment storage yard on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. A Recorded Exemption shall be approved and recorded within 30 days of approval of this Permit by the Board of County Commissioners. 4. Prior to the Special Review activity occurring on the site, an off-site Road Improvements and Maintenance Agreement shall be approved by the Board of County Commissioners. The agreement shall mitigate impacts generated on Weld County Road 35 by this Special Review activity. 'The Site Specific Development Plan and Special Review-Permit is for an oil and gas equipment storage yard in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. b. In the event that the facility becomes permanently manned on a full-time basis, a water supply, approved by the Weld County Health Department, shall be provided on site at all times. 7. The facility shall be maintained in compliance with the off-site Road Improvements and Maintenance Agreement. 8. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 10. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 11. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. -930810 DEVELOPMENT STANDARDS - SNYDER OIL CORPORATION (S35, T4N, R66W) PAGE 2 12. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also Present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated July 14, 1993, and duly published July 22, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Snyder Oil Corporation for a Site Specific Development Plan and Special -Review Permit for an oil and gas equipment storage yard. Lee Morrison, Assistant County Attorney, made this a matter of record, and he noted said matter had been continued from August 4, 1993, to allow the applicant time to -respond to proposed Development Standards. Greg Thompson, Planning Department representative, reviewed the reasons for continuance regarding traffic restrictions and dust abatement. Mr. Thompson read into the record a letter, Exhibit G, be sent to Dan Nelson, Snyder Oil Corporation, stating amendments to include: 1) Light vehicles, such as pick-up trucks, may have up to two trips per day, seven days per week; and 2) Heavy trucks may have up to three trips per day and a maximum number of twelve trips per week. His letter also noted the County Engineer suggested the dust abatement shall be applied from the north on Weld County Road 35, but will need to be clarified with the Board. Mr. Nelson and Jim Phelps were present representing Snyder Oil Corporation. Mr. Nelson stated the letter is agreeable and his understanding is that the dust abatement is to be in effect only if building permits are issued for the period of construction. Mr. Morrison said the building permits should not be issued until the dust abatement plan has been implemented during construction. Mr. Nelson said that is agreeable. Commissioner Kirkmeyer suggested a Condition of Approval be added concerning dust abatement on Weld County -Road 35 during construction. Mr. Thompson suggested rewording Condition of Approval #4. Mr. Morrison said the abatement could be an addition to, or a part of, the agreement referred to in Condition of Approval #4; therefore, leaving it too broad and open-ended. _Chairman Harbert suggested removing Condition of Approval #4 and rewording the entire condition to -require the dust abatement be effective before building permits are issued. Commissioner Kirkmeyer said Condition of Approval #4 should remain, but the requirement of dust abatement on Weld County Road 35 during construction should be added to it. Mr. Morrison suggested proposed language for said Condition, and the applicant agreed. Commissioner Kirkmeyer moved to approve the request of Snyder Oil Corporation for a Site Specific Development Plan and Special -Review Permit for an oil and gas equipment storage yard, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, and the addition of Conditions of Approval #5 and #6 concerning traffic being limited as per Mr. Thompson's letter and the requirement -of dust abatement on Weld County -toad 35. Mr. Morrison suggested adding said requirements as -Development Standards #14 and #15 rather than conditions. Mr. Thompson suggested the dust abatement be approved by the Health Department and possibly the Engineering Department. I accept Snyder Oil's explanation that the heavy traffic referred to in the application materials was during the construction phase. I recommend a condition of the special use permit which would restrict the traffic in and out of the site at a level indicated in Mr. Brookman's letter. In other words, one to two pickup trucks per day and heavy trucks moving inventory it-ems such as storage tanks and pipe limited to three trips per day within a one week period. That restriction is based on my interpretation and not information supplied-by Snyder Oil Corp. LOCATION: Approximately 4 miles south of Kersey, west of Weld County Road 53 and north of Weld County Road 46. Dale Butcher, representing Conquest Oil, stated the brinewater facility is now permitted for 3,000 gallons of brine water per day. With a growing demand for brine water disposal they would like to amend the permit to allow 5,000 gallons of brinewater per day. This would involve having to add 5, 500 gallon water tanks and adding one additional pump this would have minimal visual effect and the pump would also have no noise impact. Bill O'Hare asked how many loads of brine water .are brought in per day. Dale Butcher stated that the loads vary in size, so the number of loads vary. The Chairperson asked if there was anyone in the audience who would like to speak for or against the application. No one wished to speak. Dale Butcher did have concerns about Development Standards #4, #11, and #23. Development Standard #4 states "An individual sewage disposal system is required for the proposed facility and the system shall be installed according to the Weld County Individual Sewage Disposal Regulations. Dale Butcher stated this was changed at the County Commissioners' hearing of the original proposal. The closest paved roads are WCR 44, three miles to the north, and WCR 39, two miles to the east. In the applicant's submittal materials under section "Maximum Number Users, Patrons" , it is indicated the facility will have up to eighteen employees and deliveries from up to ten contractors daily. The section "Type, Size, Weight, and Frequency of Vehicular Traffic" , the number of vehicles is estimated at twelve which would consist mainly of pickup trucks. The two statements are not consistent, and I think the site will be a major truck traffic generator. The purpose of the site is to store pipe, casings, tanks, master meters, separators and other oil and gas related equipment. That type of equipment is handled by heavy truck traffic. It is my opinion the roads in the area will not support this site. The drawings indicate an Associated Natural Gas block valve is located within the county road right-of-way. I believe this issue has come up before. This site is on a highly erosive soil, an Olney Tine-sand loam, that needs to be protected from wind erosion at all times . Upon reclamation, we recommend that a native grass mixture be reseeded into the disturbed areas . This process would consist of eliminating soil compaction from the heavy traffic this site will receive _luring operation; using either a cover crop, or mulch to protect the newly seeded areas from wind erosion; use of the proper seeding equipment ; and proper management after seeding to maintain a viable stand of grass . In order to create a soot zone, soil compaction needs to -be reduced, or eliminated. This can be done with the use of any primary tillage equipment . A plow, lister, subsoiler, or disc harrow would suffice . Additional attachments may be necessary. This should be done shortly before seeding, to avoid leaving the surface susceptible to wind erosion for a long period of time . Furthermore, the disturbed areas should be replaced back to their original -slope surface which is 1 to 3% if compaction has severely effected the slope percent . If planting a cover crop, a long stem sorghum or a sorghum hybrid should be planted in the Month of July, using a grain drill . The grass mixture then can be planted directly into the standing dead sorghum matter. This will provide a firm yet friable seed bed to plant in, and protect the area from wind erosion. If you choose to use a mulch instead of a cover crop, use a long stem native prairie hay, and not a straw. A straw will promote the growth of it' s own species, and hinder the growth of the grass mixture . Apply the mulch directly after 930819 seeding the grass mixture using the crimping method, at a rate o± three to four thousand pounds per acre . The grass seed mixture should be planted between November first and April thirtieth, on unfrozen ground, using a grass drill . Seeding in the springtime has proven the most favorable . The drill should be equipped with double discs, an agitator box, and depth bands . The disc spacing on the drill_ should be eight to ten inches apart, with the tube placements directly between the discs . The depth setting should be between one half and three quarters of -an inch deep . Listed below is the recommended grass mixture . I am concerned you were forwarded inaccurate information on how this site will be utilized. Snyder Oil reported a worse case scenario for vehicle traffic . The 18 employees and up to 10 contractors for daily traffic referenced a construction phase . Construction within this site is possible given Snyder operates valves and fittings, and meter houses within this site . In my opinion this type of construction, at best, will occur once a year for a one to two day duration. Normal operation of this facility will involve one operator and one pickup visiting the site daily. This site will also be used to store tanks and pipe, but movement of that inventory should occur on an extremely limited basis . We feel the additional traffic generated due to the activities at this site will be negligible . We apologize for the unclear description for how this site will be utilized.
