RE: APPROVAL OF RECORDED EXEMPTION NO. 1237 - KENT AMAN,
C. G. & C. (A COLORADO CO-PARTNERSHIP) , AND RIDGE WEST
CONDOMINIUMS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 1237 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 1237 was
submitted by Kent Aman, C. G. & C. (a Colorado Co-Partnership) ,
and Ridge West Condominiums for property which is located in part
of the Ni NE$ of Section 9 , Township 5 North, Range 66 West of the
6th P.M. , Weld County, Colorado, being more particularly described
in the plat which shall be provided by the applicant and known as
Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 1. 3 acres and 0 . 6 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions in accordance with information
submitted in the application and the policies of the County:
1 . The existing septic system shall be reviewed by a Colorado
Registered Professional Engineer and a copy of that review
shall be submitted to the Weld County Health Department for
an ISDS evaluation.
2 . All new septic systems shall be designed by a Colorado
Registered Professional Engineer according to the Weld County
Individual Sewage Disposal Regulations.

3 . Prior to recording the plat:
a. The plat shall be amended to show a 60-foot right-of-way
reservation south of U.S. Highway 34 .

been purchased for the new lot created by this recorded
exemption.
4 . The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld
County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the
Weld County Subdivision Regulations. The plat shall be
submitted within sixty days from the date of approval by the
Board of County Commissioners. The applicant shall be
responsible for paying the recording fees .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 31st day of
January, A.D. , 1990 .

Re: Recorded Exemption #1237
Dear Commissioners:
This request for a recorded exemption is submitted by Kent Aman, C. G. & C.
(a Colorado Co-Partnership) , and Ridge West Condominiums. The parcel of
land on which this request is being made is described as part of the Ni NEI
of Section 9, T5N, R66W of the 6th P.M. , Weld County, Colorado, The
property is zoned C-3 (Commercial) and is located approximately .3 of a mile
west of Weld County Road 33 on the south of U.S. Highway 34 (West 10th
Street) , at 6268 West 10th Street. The parcel under consideration is the
total contiguous land holdings of the applicants. The request is to divide
the property into two (2) parcels of 1.287 acres, more or less, and .586
acres, more or less. A house is located on the proposed smaller parcel and
a 5 unit commercial condominium is located on the larger parcel.
The Weld County Health Department reviewed this request and had no
objections provided that the existing septic systems are reviewed by a
Colorado Registered Professional Engineer and a copy of that review is
submitted to the Weld County Health Department for an ISDS Evaluation. In
addition, all new septic systems must be designed by a Colorado registered
Professional Engineer according to the Weld County Individual Sewage
Disposal Regulations.
The City of Greeley Planning Department indicated that the property is
located in its Long Range Expected Growth Area where the gross density is
not to exceed one dwelling unit on 10 acres. The property is currently
being used commercially with no dwelling units proposed.

The City of Greeley Water and Sewer Department reviewed this proposal and
found no conflicts with its interest provided that each parcel created has
its own water tap. An additional water tap is available from the City of
Greeley. The applicant, in the application materials, has indicated that
should this request be approved, the second tap would be purchased and
installed.
The State Highway Department reviewed this request and determined that an
additional 17 feet of right-of-way reservation is required. The City of
Greeley also requested that adequate right-of-way be provided. A total of
60 feet of right-of-way is required south of the centerline of U.S. Highway
34.
Section 9-2 E. (1) (e) of the Weld County Subdivision Regulations requires
that parcels less than (1) acre in size be specifically exempted by the
Board. The applicant is requesting the creation of a lot measuring .586
acres.
The staff requests that the Board of County Commissioners consider this
request and determine if the standards of 9-2 E. (1) (a) through (m) of the
Weld County Subdivision Regulations have been met.

The Board of County Commissioners has determined through the review that the
standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. Recorded Exemption #1237 is approved
with the following conditions in accordance with information submitted in

Concerning requirements for Recorded Exemption of our prop-
erty located at 6268 W 10th Street, Greeley, CO.
Item 1--Attached application form

Item 4--We would like to obtain a Recorded Exemption in order
for us to develop our property to its fullest poten-
tial and in order for the owner of the front property
to sell his land . Five years ago the property was
sold to two separate owners and both were given clear
title from Transamerica Title Company with separate
legal descriptions and surveys . Separate taxes have
been assessed on both properties for the past five
years and now Mr . Aman wants to sell his front prop-
erty and found out that a Recorded Exemption was
never completed on the property. The other owners of
the rear property would also like to build another
set of units on their property.
Item 5--The area involved is in an area where there has been
mostly commercial improvements . The residential
tracts have sold for the most part or converted to
commercial use and have been approved by the Weld
County Planning and Zoning and the Building and
Inspection Department .
Item 6--In the zone district in which the property is located
there are many other businesses . Across the road
there is a veterinarian's office, to one side there
is an irrigating supply firm and self-storage units
and on the other side there are two residential lots,
then some commercial units and various other types of
businesses .
Item 7--We have a set of By-Laws and a Declaration of Cove-
nants, Conditions and Restrictions for our commercial
condominiums that were recorded with the county and
are attached with this package . They were recorded

Item 8--As the City of Greeley continues to grow and in that
the property is located within an area where commer-
cial development has been going on for the past ten
to fifteen years, the surrounding area would benefit
from this exemption because it would allow us to
fully develop our properties to their full potential .
The front residential property would become a busi -
ness and the vacant lot would be developed into more
commercial condominiums . With the improvements we
could create more Jobs, more taxes for the county and
improve the existing lots .
Item 9--Since the lots in the area are changing from residen-
tial use to a commercial use our development would be
consistent with the development of the area . As more
businesses move into an area it helps the other
businesses and becomes a more efficient use of the
land, rather than having a mixture of different types
of uses of the lots .
Item 10-Both properties have septic systems located on their
own lots . The one system was on the property when it
was purchased in 1979 ( for the front property) . The
second system was installed when the condominium
units were constructed in 1979-80 . The system was
approved by Weld County Environmental Health and
installed as per their requirements . The reason for
dividing the lot as it is to insure that the septic
systems are located on their own properties . We have
shared a common water tap since 1979 . However, since
the City of Greeley, who is the supplier of the
water, wants each property to have its own tap. We
have applied for a separate tap for the front
property and they have already agreed to the tap.
All we have to do is pay for it and it will be
installed. (See attached copy of estimate )
Item 11-According to our surveyor, McRae and Short, our prop-
erty does not exist in a flood plain, geologic hazard
or Weld County Airport overlay district.
Item 12-Our properties have an existing paved road that has
been recorded as a general common element for both
properties . When we applied for a driveway permit
from Division of Highways, State of Colorado on Aug-
ust 22, 1979 they informed us that we needed one
common driveway for the property. We were granted
the application and installed the driveway as per the

state 's instructions so that we could exit West 10th
Street in a safe and orderly manner . (Our application
and it 's approval are attached . ) We have been using
this property since 1979 . When it was divided and
sold to two separate owners in 1984 we thought all
conditions had been met since clear title was given
to both owners . The owner of the front property
wants to sell his land. The owners of the rear prop-
erty want to finish the development of their lot .
Neither can be completed until a Recorded Exemption
has been granted .

As it is my understanding that you will be paying the fees required for

must be paid before tap installation can be scheduled:

3/4-inch water meter 30.00
Labor and materials to install tap 700.00
Cash in lieu of raw water (0.586

The Meter Shop and the Water Distribution Division will permit the
installation of the meter in the existing concrete pit, providing the
entire meter pit is brought up to code and meets all Project Management
Manual specifications.
If a separate meter pit Installation is chosen, you will still need to
bring the existing pit up to city code. While the maintenance of the
meter is the responsibility of the city, the pit, lid, and all other
plumbing are to be maintained by the property owner per city ordinance.

To Whom It May Concern:
I want to obtain a recorded exemption for my property located
at 6268 W. 10th in order to sell my lot that I purchased five
years ago. I purchased my land and house as an investment
property, the rear lot and building were sold as commercial
condominiums. By dividing the land it was more affordable
for me as well as the business in the rear. By obtaining a
recorded exemption now the lots would be able to be divided
rather then sit the way they are.
The lots surrounding mine have been developed as commercial
properties such as veterinarian clinic, pipe storage and
sales, individual storage units, and other commercial
condominium units.
I have a set of by-laws and covenants that exclude certain
business from this land, such as auto body painting, but
allow other businesses to develop. (See attached documents. )
Since other businesses surround me the recorded exemption
would allow for better use of the Land and for the
development of more compatible businesses.
I have applied for another water tap, and since my land is
contiguous with the mainline on West 10th there doesn 't seem
to be a problem. I have my own septic tank and leach field
located on my property that was installed when the house was
built. Another septic tank and leach field was installed
when the building in the rear was built. It is contained on
their land. (See attached permit ). They have their own
water tap.
Both properties share a common driveway approved by the State
Highway Department, (see attached form. ) and documented on my
improvement location certificate.

I have an opportunity to sell my land to a man who wishes to
move his business to West 10th because of the location and
because of the other businesses in the area. The owners at
the rear property would like to develop their lot, but
neither can be accomplished without the recorded exemption.
I would now like to take care of this issue in order to
improve the area and not have it stay as it now is.

for the purpose of supplying water to said premises. It is expressly understood and agreed by the undersigned that, if
granted, said tap shall be in consideration of and upon the following terms and conditions, to-wit:
1. That applicant shall pay all costs or charges incident to making said tap. as may be determined by the City of Greeley,
and that said taps shall be made under the supervision of the superintendent of the water department, or such other official as
the City may designate.
2. That applicant will pay for and install a water meter of such size and at such place as may be required by the City.
3. That if the premises to be serviced by said taps shall ever be embraced or included witldn the boundaries of a tract or
plat which is sought to be annexed to the City of Greeley, either by individual petitions or by the City itself, then and in
that event the applicants specifically agree that they will consent to join in the annexation of such territory by the City of
Greeley, subject only to the compliance by any such petitioners with all of the legal requirements pertaining to the annexation of
territory to a municipality. Furthermore, that applicant does hereby empower and Irrevocably authorize and appoint the City
Clerk of the City of Greeley, Colorado, his lawful attorney in fact, for him and in his place and stead to sign any such annexation
petition as may be presented to and approved by the City Council, or as may be initiated by the City Council itself, embracing
the above described land within territory to be annexed to the City of Greeley, Colorado, and applicant does hereby grant
said City Clerk full power and authority to sign his name to such petition, thereby binding sold petitioner to all of the terms
and provisions of said petition as fully as he might do himself and for all intents and purposes es If he himself had signed
said petition, it being thoroughly understood by the applicant that the primary consideration for the granting of the petition
is applicant's covenant and promise that he will consent to the annexation of said territory to the City of Greeley, Colorado.
Applicant further covenants and agrees for himself, his successors and assigns [lint, if he fails to sign any such annexation
petition when requested by the City, or falls to abide by each and every covenant herein contained, then and in that event
this permit or right to use water may be terminated by the City of Greeley, Colorado, upon the giving of thirty days' notice in
writing of his intention so to do. Further, the requirements herein stated shall be considered as covenants running with the land.
4. That the applicant agrees that no building or other improvement shall he constructed width shall interfere with the
future widening or extending of streets as proposed or may hereafter be proposed in the Street and Highway Plan on file in
the County Clerk's Office, County of Weld, State of Colorado.
5. That the applicant agrees that where the major streets are not immediately necessary the applicant does hereby agree
to dedicate, authorize to be opened and improved the street or streets as required by the Greeley Planning Commission. (Plat
attached).
6. That the applicant agrees that grant of the streets for future use at the request of the Greeley Planning Commission
as herein recited shall run with the land and does hereby authorize this Agreement to be placed of record in the Clerk and
Recorder's Office, Weld County, State of Colorado.
7. That the applicant agrees that no building or other improvement or plan of subdivision shall be constructed or
planned which interferes with the necessary drainage required by the Greeley Planning Commission.
8. That the applicant agrees to comply with all ordinances and other regulations adopted by City Connell and Greeley
planning Commission concerning subdivision, zoning, building construction, fire, safety. health, traffic and other applicable
matters.
9. That the applicant agrees to obtain and pay for the necessary building and other permits and to be governed by the
required inspections in same manner as if the area were within the City limits.
10. That the applicant agrees that if the area herein described shall become a pert of another Town or City, the City of
Greeley shall have the right to terminate the water service to said area and individual or individuals.
11. That the applicant agrees to pay all costs for water extensions as may be required by the Director of Water unless
specifically exempt from certain costs by utility policies approved by the City Council.
12. That the applicant agrees to pay the regular rates now established or that may in the future be established for tin
class of water service furnished.
13. That applicant agrees to abide by all of the rules, regulations and ordinances of the City of Greeley, Colorado,
and the lawn of the State of Colorado pertaining to the use of said water as fully as if said premises were located within the
corporate limits of the City of Greeley, Colorado.

APPLICATION PROCESS FOR OUTSIDE OF GREELEY WATER TAPS
Requests for water taps outside the city limits must always be brought to the
attention of the Director of Water and Sewer by letter. The director will
then review each request on an individual basis. Request letters should state
the size of tap requested and the reasons for the tap request, in addition to
addressing the following items:
1 . If the property is found to be contIquy s to the city limits, for the most
part, it is understood that ann4dflon to the city may be required before
the applicant is granted water service, particularly if annexation is
within the city's long-range growth plan established by the Planning
Department.
2. Enclose with the tap request letter a signed and notarized Outside of City
Water Agreement, which is available from the Water and Sewer Department.
3. Enclose with the tap request letter a surveyor 's map or a copy of the
recorded plat showing the actual acreage of the parcel which must
include easements or right of ways. This is necessary so that an exact
determination can be made of where the property is located in relation to
the city's water main lines and the existing city boundaries.
4. It is understood that raw water will have to be turned over to the city
as a requirement for water service, in addition to payment of all license
fees and costs for installation and a water meter. The raw water
requirement for residential development is three acre feet of water per
acre of developed land or the cash equivalent. The cash equivalent is set
monthly by the Water and Sewer Board, and the current cash equivalent is
$950 per acre foot. The raw water requirement for nonresidential service
Is based upon the size of the service and an annual allotment of water
assigned to that service. A raw water surcharge will be assessed on the
volume of water used in excess of the annual allotment.
5. If the parcel is under a Greeley-Loveland Shareholders' Agreement or a
Right of Way document, please advise the director in your request letter.
6. Requests for water service larger than one-inch must be approved by the
Water and Sewer Board, which meets the first Thursday of each month.
These requests must be received at least 10 days prior to the day of the
board meeting to allow for review and placement on the agenda.

Enclosed please find the final drafts of the Condominium
Declaration , Articles of Incorporation , and Bylaws for the Ridge
West Commercial Condominiums . I have enclosed three sets for
your review, and I would assume that you might want to meet
once jointly to discuss any questions or modifications that you
might have concerning those documents . I apologize for the delay
in providing these documents to you. During your review of the
documentation, I would suggest that you pay careful attention to
paragraphs 11 , 19 , 20 , and 22 , to make sure that those paragraphs
accurately reflect your intent .
In order to complete the condominium process , it will be
necessary to sign the original Declaration and Condominium Map
which I have in my office . Hopefully we can sign the documentation
at the same time that we hold our meeting in reference to the
condominium regime documents .
I have also enclosed the statement from McRae $ Short for
engineering services as well as my statement for the balance of
my professional fee together with costs incurred to date. Please
contact me with a time that is convenient for your group to get
together to review the documentation . The only night that is not
available on my calendar is Tuesday, because I teach an evening
course at the University.

Applicant submits herewith for the consideration and approval of the Division a sketch (or blueprint) of the proposed
installation showing all necessary specification detail including (1) frontage of lot along highway, (2) distance from center-
line of highway to property line, (3) number of driveways requested, (4) width of proposed driveway(s) and angle of approach,
(5) distance from driveway to road intersection, if any, (6) size and shape of area separating driveways if more than one
approach, and (7) setback distance of building(s) and/or gasoline pump island(s).
The applicant binds and obligates himself to constrict and maintain the driveway approach(es) in accordance with the
provisions, specifications, and conditions enumerated in this document.
GENERAL PROVISIONS
FIRST: The Applicant represents all parties in interest, and affirms that the driveway approach(es) is to he constructed by
him for the bona fide purpose of securing access to his property and not for the purpose of doing business or servicing
vehicles on the highway right.of-way.
SECOND: The applicant shall furnish all labor and materials, perform all work, and pay all costs in connection with
the construction of the driveway(s) and its appurtenances on the right-of-way. All work shall he completed within 30
days of the Permit date.
THIRD: The type of constniction shall he as designated and/or approved by the Division of Highways and all materials
used shall he of satisfactory quality and subject to inspection and approval by the Division.
FOURTH: The traveling public shall he protected during the installation with proper warning signs and signals and the
Division of Highways and its duly appointed agents and employees shall he held harmless against any action for personal
injury or property damage sustained by reason of the exercise of the Permit.
FIFTH: The Applicant shall assume responsibility for the removal or clearance of snow, ice or sleet upon any portion of
the driveway approach(es) even though deposited on the driveway(s) in the course of the Division's snow removal operations.
SIXTH: In the event it becomes necessary to remove any right-of-way fence, the posts on either side of the entrance shall be
securely braced before the fence is cut to prevent any slacking of the remaining fence, and all posts and wire removed
shall be turned over to the District representative of the Division of Highways.
SEVENTH: No revisions or additions shall he made to the driveway(s) or its appurtenances on the right-of-way without the
written permission of the Division of Highways.
EIGHTH: On those highways along which access rights are restricted or for which service roads have been constructed,
driveways shall connect only to the service roads and not to the main traveled highways. 9(33138
NINTH: Provisions and specifications outlined herein shall apply on all highways under the jurisdiction of the Division of
Highways, except that on highway connecting links within the corporate limits of municipalities operating under home rule

SPECIFICATIONS
Section I A driveway approach is understood to be that portion of the highway right-of-way between the pave-
Definition ment edge and the property line which is designed and used for the interchange of traffic between the

roadway pavement and the abutting property.
Section 2 At any intersection of a State Highway with another highway, road, or street, where right-of-way has
Intersection been acquired to provide sight distance, no driveway approach shall be permitted within the frontage
Clearance thereof. At any other intersection, a driveway shall be restricted for a sufficient distance from the
intersection to preserve the normal and safe movement of tragic. (ft is recommended for rural residence
entrances that a minimum intersection clearance of 50 feet be provided and for rural commercial entrances
a minimum of 100 feet be provided. For similar installations in urban or suburban areas, a minimum of 20
feet for both residence and commercial entrances is recommended.)
Section 3 All entrances and exits shall be so located and constructed that vehicles approaching or using them will
Sight be able to obtain adequate sight distance in both directions along the highway in order to maneuver

Section 4 Driveway locations for ingress and egress must be reasonable from the viewpoint of the traveling public
Traffic in that no unusual hazard to pedestrians or motorists shall be created, nor shall the driveway(s) invite

or compel vehicular movements in directions or locations contrary to those for which the highway was
designed, neither shall they invite or compel illegal or unsafe traffic movements.
Section 5 No entrance or approach shall be located or constructed so as to interfere with or prevent the proper
Control location or functioning of any traffic regulating device. The Applicant shall not be permitted to erect
Devices any sign or display material, either fixed or movable, on or extending over any portion of the highway
right-of-way.
Section 6 Generally, no more than one approach shall be allowed any parcel of property the frontage of which

ence and necessity.
Section 7 All driveways shall be so located that the flared portion adjacent to the traveled way will not encroach

Section 0 No commercial driveway shall have a width greater than thirty-five (35) feet measured at right angles

Width shall have a width greater than twenty-four (24) feet measured at right angles to the centerline of the
driveway, except as increased by permissible radii.
Section 9 The axis of an approach to the highway may be at a right angle to the centerline of the highway and of
Approach any angle between ninety (90) degrees and sixty (60) degrees but shall not be less than sixty (60)
Angle degrees. Adjustment will be made according to the type of traffic to be served and other physical
conditions.
Section 10 Permissible radii on driveway returns shall be governed by such factors as width of drive and angular
Curb Return placement. Where the flared edge of an approach controls the tin nine radius of a vehicle entering a
Radii property by a right turn from the adjacent outside traffic lane of the roadway, the radius of that edge
shall be not less than twenty (20) feet, where the approach is to be used by pay�-enger cars and single-
unit trucks and not less than fifty (50) feet where all types of vehicles may he expected.
Section II A safety island or buffer zone shall be constructed and maintained between adjoining driveway approaches

line shall be required for the island separator. Curbs or posts, or other suitable methods of island desig-
nation and protection as approved by the Division, shall be provided to prevent vehicle parking
and access in the restricted island area.
Section 12 The construction of parking or servicing areas on the highway right-of-way is specifically prohibited.
Parking Off-the-road parking facilities should be provided by commercial establishments for customers' vehicles.
Section 13 The grade of entrance and exit shall slope downward and away from the road surface at the same rate

Dear Mr. Schuett:
We have reviewed the application from Aman Partnership and Ridge West
Commercial Condominiums for a Recorded Exemption, and we have the fol-
lowing comments:
Projected traffic on State Highway 34 indicates the need for a 120-foot
total right of way, 60 feet on each side of the highway centerline.
Since the existing width along this property is approximately 43 feet
south of the centerline, additional width to meet the projected need
should be protected by reservation or, preferably, dedication, as per-
mitted by County regulations.
The permitted common access for these properties will remain as con-
structed until such time that it can be determined that a change of
use requires further review.

Environmental Protection Services has reviewed this proposal and recommends for
approval, subject to the following conditions:
1. The septic system for the proposed units are required to be designed
by a Colorado Registered Professional Engineer according to the Weld
County Individual Sewage Disposal Regulations.
2. The existing septic systems are required to be reviewed by a Colorado
Registered Professional Engineer, and a copy of that review
submitted to this Division before the required I.S.D.S. Evaluation
can be performed.
3. It is the policy of this Division not to recommend for approval of
any lot size less than one (1) acre which will utilize an Individual
Sewage Disposal System. However special circumstances exist in this
case.

Concerning requirements for Recorded Exemption of our prop-
erty located at 6268 W 10th Street, Greeley, CO.
Item 1--Attached application form
Item 2--Attached Certificate of Conveyance
Item 3--Attached copy of Deed
Item 4--We would like to obtain a Recorded Exemption in order
for us to develop our property to its fullest poten-
tial and in order for the owner of the front property
to sell his land . Five years ago the property was
sold to two separate owners and both were given clear
title from Transamerica Title Company with separate
legal descriptions and surveys . Separate taxes have
been assessed on both properties for the past five
years and now Mr . Aman wants to sell his front prop-
erty and found out that a Recorded Exemption was
never completed on the property. The other owners of
the rear property would also like to build another
set of units on their property.
Item 5--The area involved is in an area where there has been
mostly commercial improvements . The residential
tracts have sold for the most part or converted to
commercial use and have been approved by the Weld
County Planning and Zoning and the Building and
Inspection Department .
Item 6--In the zone district in which the property is located
there are many other businesses . Across the road
there is a veterinarian's office, to one side there
is an irrigating supply firm and self-storage units
and on the other side there are two residential lots,
then some commercial units and various other types of
businesses .
Item 7--We have a set of By-Laws and a Declaration of Cove-
nants, Conditions and Restrictions for our commercial
condominiums that were recorded with the county and
are attached with this package . They were recorded

Item 8--As the City of Greeley continues to grow and in that
the property is located within an area where commer-
cial development has been going on for the past ten
to fifteen years, the surrounding area would benefit
from this exemption because it would allow us to
fully develop our properties to their full potential .
The front residential property would become a busi -
ness and the vacant lot would be developed into more
commercial condominiums . With the improvements we
could create more Jobs, more taxes for the county and
improve the existing lots .
Item 9--Since the lots in the area are changing from residen-
tial use to a commercial use our development would be
consistent with the development of the area . As more
businesses move into an area it helps the other
businesses and becomes a more efficient use of the
land, rather than having a mixture of different types
of uses of the lots .
Item 10-Both properties have septic systems located on their
own lots . The one system was on the property when it
was purchased in 1979 ( for the front property) . The
second system was installed when the condominium
units were constructed in 1979-80 . The system was
approved by Weld County Environmental Health and
installed as per their requirements . The reason for
dividing the lot as it is to insure that the septic
systems are located on their own properties . We have
shared a common water tap since 1979 . However, since
the City of Greeley, who is the supplier of the
water, wants each property to have its own tap. We
have applied for a separate tap for the front
property and they have already agreed to the tap.
All we have to do is pay for it and it will be
installed . (See attached copy of estimate )
Item 11-According to our surveyor, McRae and Short, our prop-
erty does not exist in a flood plain, geologic hazard
or Weld County Airport overlay district.
Item 12-Our properties have an existing paved road that has
been recorded as a general common element for both
properties . When we applied for a driveway permit
from Division of Highways, State of Colorado on Aug-
ust 22, 1979 they informed us that we needed one
common driveway for the property. We were granted
the application and installed the driveway as per the

state 's instructions so that we could exit West 10th
Street in a safe and orderly manner . (Our application
and it 's approval are attached . ) We have been using
this property since 1979 . When it was divided and
sold to two separate owners in 1984 we thought all
conditions had been met since clear title was given
to both owners . The owner of the front property
wants to sell his land . The owners of the rear prop-
erty want to finish the development of their lot .
Neither can be completed until a Recorded Exemption
has been granted .
