RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL USE PERMIT FOR
A RECREATIONAL FACILITY TO INCLUDE A RIFLE RANGE, ARCHERY RANGE, TRAP,
SKEET, AND SPORTING CLAYS IN THE A (AGRICULTURAL) ZONE DISTRICT - WELD
COUNTY FISH AND WILDLIFE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 4th
day of September, 1991, at the hour of 10:00 a.m. in the Chambers of the Board
for the purpose of hearing the application of Weld County Fish and Wildlife, P.O.
Box 300, Greeley, Colorado 80632, for a Site Specific Development Plan and
Amended Special Use Permit for a recreational facility to include a rifle range,
archery range, trap, skeet, and sporting clays in the A (Agricultural) Zone
District, on the following described real estate, to-wit:
Part of the NEB, Section 19, Township 7
North, Range 64 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was represented by Ronald Collins, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Amended Special Use Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposed use is consistent with the Weld County
Comprehensive Plan's goals and policies for the location of
recreational facilities. The application is for the expansion
and modification of an existing use. No additional land is
required for the proposal and no prime agricultural land will
be taken out of production.
b. The proposed use is consistent with the intent of the
Agricultural Zone District. Recreational facilities such as
gun clubs and shooting ranges are provided for as a Use by
Special Review in the Weld County Zoning Ordinance.

c. The attached Development Standards and Conditions of Approval
will make the proposed use compatible with the existing
surrounding land uses which include irrigated and non-
irrigated agricultural production and rural residences. No
public inquiries have been received by the Department of
Planning Services' staff regarding this request.
d. The uses permitted will be compatible with the future
development of the area. The Special Use area is not located
in the comprehensive planning area of any municipality.
Therefore, uses in the area are expected to remain
agricultural.
e. No overlay districts affect the site.
f. Special Use Development Standards and Conditions of Approval
will ensure compliance with Section 45.3 of the Weld County
Zoning Ordinance and will provide adequate protection of the
health, safety and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and
Amended Special Use Permit for a recreational facility to include a rifle range,
archery range, trap, skeet, and sporting clays in the A (Agricultural) Zone
District, on the hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1. The attached Development Standards for the Amended Special Use
Permit shall be adopted and placed on the Special Use plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the Board
of County Commissioners.
2. The Special Use activity shall not occur nor shall any building or
electrical permits be issued on the property until the Special Use
plat is ready to be recorded in the office of the Weld County Clerk
and Recorder.
3. The applicant shall submit a letter requesting to delete the
proposed future skeet shooting facility or submit a revised Special
Use Permit map demonstrating how the skeet shooting facility
complies with Section 45.3 of the Weld County Zoning Ordinance.
4. The applicant shall submit a letter requesting to delete the
proposed 600 yard rifle range facility or submit a revised Special
Use Permit map demonstrating how the 600 yard rifle range complies
with Section 45.3 of the Weld County Zoning Ordinance.

5. Within 30 days of approval of this request by the Board of County
Commissioners, an I.S.D.S. evaluation on any existing septic systems
shall be completed prior to issuing the required septic permits on
the existing systems.
6. Within 180 days of approval of this request by the Board of County
Commissioners, a restroom with adequate toilet facilities serviced
by an individual sewage disposal system, shall be constructed for
the proposed facility and the system shall be installed according to
the Weld County Individual Sewage Disposal Regulations.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 4th day of September, A.D. , 1991.

SITE SPECIFIC DEVELOPMENT PLAN
AMENDED SPECIAL USE PERMIT
DEVELOPMENT STANDARDS
WELD COUNTY FISH AND WILDLIFE
AMENDED SUP-215
1. The Site Specific Development Plan and Amended Special Use Permit is for
a recreational facility to include a rifle range, archery range, trap,
skeet, and sporting clays as submitted in the application materials on
file in the Department of Planning Services and subject to the Development
Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. The Amended Special Use Permit shall not be transferable to any successors
in interest to the described property and shall terminate automatically
upon conveyance or lease of the property to others for the operation of
the facility.
4. The permitted uses shall be conducted during daylight hours only. This
restriction shall not apply to the maintenance of the facility.
5. Signs shall be posted and maintained to clearly identify the boundaries of
the Special Use area to the users and the surrounding inhabitants. These
signs shall be at least one square foot and a maximum of five square feet.
The signs shall be posted at intervals of no more than 200 feet along the
perimeter of the Special Use area. Each sign shall identify the potential
danger and shall not be used for the purpose of advertising.
6. The applicant shall be responsible for complying with the standards for
outdoor shooting ranges set forth in Section 45.3 of the Weld County
Zoning Ordinance.
7. The 200-meter and 300-yard rifle ranges, shall not be used simultaneously
with the sporting clays course. Signs shall be posted in the parking area
of the rifle range and the sporting clays course to inform the users of
this condition.
8. The trap shooting facility shall not be used simultaneously with the
sporting clays course. Signs shall be posted in the parking area of the
trapshooting course and the sporting clays course to inform the users of
this condition.
9. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
10. The Amended Special Use Permit is issued for a period of five years.
After the completion of five years, the Permit may be reviewed at any time
and may be revoked when a substantial change has occurred regarding
compatibility with surrounding land uses. Revocation proceedings shall
follow the procedures set forth in the Weld County Zoning Ordinance.

11. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
12. No permanent disposal of wastes shall be permitted at this site.
13. All waste materials shall be handled, stored, and disposed of in a manner
that controls fugitive dust, blowing debris, and other potential nuisance
conditions.
14. Fugitive dust shall be controlled on the site.
15. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
16. The facility shall be operated and maintained in compliance with the
requirements of the Galeton Fire District.
17. All shooting shall be supervised by a range officer or instructor
qualified by the National Rifle Association or military service or other
similar training.
18. The property and the uses permitted shall be maintained in compliance with
the requirements of the National Sporting Clays Association.
19. All interior roads, parking lots, trails, and other heavy use areas shall
be graveled or hard-surfaced. All other areas disturbed by construction
or without adequate cover shall be seeded to adaptive grasses.
20. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
21. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
22. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated herein and all
applicable Weld County Regulations.

23. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.

24. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit

facilities. Bud Clemons asked if U.S West/NewVector Group had a lease
Montgomery Force said the lease was included in the Subdivision Exemption
application. Jean Hoffman wanted to know how this tower would affect non-cable
television reception. Montgomery Force said it would not affect it at all. If
problems arise in the future U S. West/NewVector Group will work to relieve them

Montgomery Force said there were 2 or 3 operational at this point. Ann Garrison
asked if there were any potential problems operating this number of towers.
Montgomery Force said no. Jean Hoffman wanted to know what basic service these
towers supplied. Montgomery Force replied cellular telephones.

APPLICANT. Phil B and Maryanne Pennock
REQUEST: A Site Specific Development Plan and a Special Review permit for a
livestock confinement operation (80,000 turkey brooding facility and
a 150 head dairy) in the A (Agricultural) zone district
LEGAL DESCRIPTION Part of the E2 SW4 of Section 18, T4N, R68W of the 6th
P.M. , Weld County, Colorado.
LOCATION. North of Colorado Highway 56, approximately 25 miles east of Weld
County Road 1
Phil and Doug Pennock, applicants, explained this would be a turkey brooding
facility. The young turkeys would range from 1 day to 5 weeks old and then be
removed. They want to stay agricultural and the turkeys would be in addition to
the dairy they already own and operate. Ann Garrison asked if they had contacted
people in the vicinity Phil Pennock said they spoke with all of the surrounding
property owners who had sent letters and explained they were not increasing the
dairy, just adding the turkeys Shirley Camenisch asked how the turkeys would
be housed. Phil Pennock said they would be totally confined in a low nice
looking building so there would be no noise and the flies would be controlled
Bud Clemons asked Lanell Swanson to explain how animals per acre was figured
Lanell Swanson said a cow was considered 1 animal unit, whereas turkeys are
considered .02 of an animal unit. 200 turkeys per acre is allowed if no other
livestock is on the property Jean Hoffman asked what preparations the Pennocks
were making for the handling of the turkeys Phil Pennock said they had been
raising animals all their lives. They have been working closely with Longmont
Foods and have hands on experience and have the approval from the Weld County
Health Department and Highway Department. Bud Clemons asked if they had
contracted with Longmont Foods Phil Pennock said yes
Doug Pennock explained the turkeys would produce 1/4 of the manure the cows do
Farmers in the area would take alot of it but they would have to stockpile it at
certain times of the year They have worked with the Health Department on this
issue. Bud Clemons asked about access onto the property. Lanell Swanson
explained there were three access roads but only the road to the dairy would be
used by the semi-trucks Development Standard #9 was changed because restroom

facilities are not needed due to the fact this is a family owned business and
residences are located on the property If any outside employees are hired, who
do not live on the site, then restroom facilities would be required. Phil
Pennock agreed with this change.
The Chairman asked if there was anyone in the audience who wished to speak for
or against the application
Bob Ramsey, surrounding property owner, said they rent this property out to
tenants but they are concerned about problems with manure, feathers, and noise
levels. He said that even though the turkeys were contained indoors, the
building would have to be ventilated and at some point the manure brought
outside. If problems arise, what recourse do they have Judy Schmidt explained
they can file a complaint with the Weld County Health Department and the Health
Department will respond within 1 to 5 days
Anna Mary Hilton, surrounding property owner had no objections to this
application. She said the Berthoud area is a considered a depressed area and
subsidizing existing businesses is necessary.
Jean Hoffman asked if this Use by Special Review permit should be limited to the
Pennock's, rather than with the property. Phil and Doug Pennock said they would
prefer it with the property in case of illness, injury or health reasons they
were unable to continue to work the business and had to sell

Stan May, President, Weld County Fish and Wildlife, said the organization was
founded in approximately 1948. They have 600 members with annual dues of $25.00
and have had no gun related injuries for the past 50 years. The proposed
clubhouse will be a 36' x 60' modular building and the ranges will include, trap
skeet, sporting clays, and a 600 yard high powered rifle range He said he feels
Development Standard #4 was too restrictive. Ann Garrison asked what
specifically was too restrictive. Stan May quoted the 80 foot berming required
for the 600 yard high powered range. He said it would be too costly and was not
necessary. Bud Clemons asked what the National Rifle Associations requirements
are. Stan May said he didn't know off-hand but they would gladly comply with
whatever they were. He also had reservations about Development Standard #7. He
explained this is a "key club" and it would also be too costly to maintain a
certified instructor at all times. Brian Grubb explained that Section 45 3 of
the Weld County Zoning Ordinance states, if there are more than 4 individuals on
the premises on a regular basis, compliance is required
The Chairman asked if there was anyone in the audience who wished to speak for
or against the application.
Curtis Heinz, surrounding property owner, is concerned about the bind weed
growing on the gun club property. He is required to control it in his area.
Stan May responded the gun club would comply with the regulations regarding bind
weed.
Bob Horton, surrounding property owner wanted to know what direction the 600 yard
high powered rifle range would point Brian Grubb said north to northwest. Bob
Horton said that was aimed directly at his property and anyone tending cattle
could be in danger.
Fred Haumbaum, Board of Directors, Weld County Fish and Wildlife, explained that
in the past, policy had been first man on the range would act as range officer
and the position would be assumed by the next man when the first man left He
said he personally did not want to see the 600 yard range go in, due to the fact
that it drains funding to the other ranges because of upkeep
Stan May said he did not have the authority to remove the 600 yard range from the
request without first meeting with the members of the organization.

Ariel Sanstead said she was not opposed to this request but she was born in Keota
in 1923 and had questions. She wanted to know how Stoneham and New Raymer were
zoned. She is concerned with the title "abandoned" used in the newspaper and
said that a lot of people had property in Keota but live out of the State of
Colorado. Lee Morrison explained that the term "abandonment" was used at a
Federal level when a town no longer had a functioning municipal government

I hereby certify that pursuant to a notice dated July 31, 1991, and duly
published August 22, 1991, in The New News, a public hearing was conducted
to consider the request of Weld County Fish and Wildlife for a Site
Specific Development Plan and Amended Special Use Permit for a
recreational facility to include a rifle range, archery range, trap,
skeet, and sporting clays in the A (Agricultural) Zone District. Lee
Morrison, Assistant County Attorney, made this a matter of record. Brian
Grubb, Planning Department representative, recommended the Resolution of
the Planning Commission and the Planning staff's recommendation be entered
into the record as written. Ronald Collins, representing the applicant,
stated they were agreeable to this. Mr. Collins explained the request for
the expansion of the facility. In regards to the Planning Commission's
Condition of Approval 114, Mr. Collins said by letter dated July 1, 1991,
they requested to have a 300-yard range instead of a 600-yard range to
comply with the Zoning Ordinance. There was some discussion concerning
Development Standard 1117, which pertains to a range officer being on site.
Mr. Collins explained that all new members will be required to have
training. There was no public testimony offered concerning this matter.
Mr. Grubb requested that the Board consider including the 300-yard range
in Development Standard 117. Commissioner Webster moved to approve the
request of Weld County Fish and Wildlife for a Site Specific Development
Plan and Amended Special Use Permit for a recreational facility to include
a rifle range, archery range, trap, skeet, and sporting clays in the A
(Agricultural) Zone District based on the recommendation of the Planning
staff and the Planning Commission, with the Conditions of Approval and
Development Standards as entered into the record, with Development
Standard 117 to include the 300-yard range. The motion was seconded by
Commissioner Kirby, and carried unanimously.

Special Review Development Standards and Conditions of
Approval will ensure compliance with Section 45.3 of the
Weld County Zoning Ordinance and will provide adequate j
protection of the health, safety and welfare of the
neighborhood and County.

This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Prior to scheduling this request before the Board of County
Commissioners, the applicant shall submit a letter requesting to
delete the proposed future skeet shooting facility or submit a
revised Special Review Permit map demonstrating how the skeet
shooting facility complies with Section 45.3 of the Weld County
Zoning Ordinance.
4. Prior to scheduling this request before the Board of County
Commissioners, the applicant shall submit a letter requesting to
delete the proposed 600 yard rifle range facility or submit a
revised Special Review permit map demonstrating how the 600 yard
rifle range complies with Section 45.3 of the Weld County Zoning
Ordinance.
5. Within 30 days of approval of this request by the Board of County
Commissioners, an I.S.D.S, evaluation on any existing septic
systems shall be completed prior to issuing the required septic
permits on the existing systems.

Amended SUP-215
1 The Site Specific Development Plan and Special Review permit is for
a recreational facility to include a rifle range, archery range,
trap, and sporting clays as submitted in the application materials
on file in the Department of Planning Services and subject to the
Development Standards stated hereon.
2 Approval of this plan may create a vested property right pursuant
to Section 90 of the Weld County Zoning Ordinance
3. The Special Review Permit shall not be transferable to any
successors in interest to the described property and shall
terminate automatically upon conveyance or lease of the property to
others for the operation of the facility.
4 The permitted uses shall be conducted during daylight hours only.
This restriction shall not apply to the maintenance of the
facility.
5 Signs shall be posted and maintained to clearly identify the
boundaries of the special review area to the users and the
surrounding inhabitants. These signs shall be at least one square
foot and a maximum of five square feet. The signs shall be posted
at intervals of no more than 200 feet along the perimeter of the
special review area. Each sign shall identify the potential danger
and shall not be used for the purpose of advertising.
6 The applicant shall be responsible for complying with the standards
for outdoor shooting ranges set forth in Section 45.3 of the Weld
County Zoning Ordinance.
7 The 200 meter rifle range, shall not be used simultaneously with
the sporting clays course. Signs shall be posted in the parking
area of the rifle range and the sporting clays course to inform the
users of this condition.
8 The trap shooting facility shall not be used simultaneously with
the sporting clays course. Signs shall be posted in the parking
area of the trapshooting course and the sporting clays course to
inform the users of this condition.
9. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
10. The Special Review Permit is issued for a period of 5 years. After
the completion of 5 years, the permit may be reviewed at any time
and may be revoked when a substantial change has occurred regarding
compatibility with surrounding land uses. Revocation proceedings
shall follow the procedures set forth in the Weld County Zoning
Ordinance.

11. All liquid and solid wastes shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
12. No permanent disposal of wastes shall be permitted at this site.
13. All waste materials shall be handled, stored, and disposed of in a
manner that controls fugitive dust, blowing debris, and other
potential nuisance conditions.
14. Fugitive dust shall be controlled on the site.
15. The maximum permissible noise level shall not exceed the industrial
limit of 80 dB(A) , as measured according to 25-12-102, Colorado
Revised Statutes.
16. The facility shall be operated and maintained in compliance with
the requirements of the Galeton Fire District.
17. All shooting shall be supervised by a range officer or instructor
qualified by the National Rifle Association or military service or
other similar training.
18. The property and the uses permitted shall be maintained in
compliance with the requirements of the National Sporting Clays
Association.
19. All interior roads, parking lots, trails, and other heavy use areas
shall be graveled or hard-surfaced All other areas disturbed by
construction or without adequate cover shall be seeded to adaptive
grasses.
20. The property owner or operator shall be responsible for complying
with the Design Standards of Section 24 5 of the Weld County Zoning
Ordinance.
21. The property owner or operator shall be responsible for complying
with the Operation Standards of Section 24.6 of the Weld County
Zoning Ordinance.
22 Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.

23. The Special Review area shall be limited to the plans shown hereon
and governed by the foregoing Standards and all applicable Weld
County Regulations. Major changes from the plans or Development
Standards as shown or stated shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and
the Board of County Commissioners before such changes from the
plans or Development Standards are permitted. Any other changes
shall be filed in the office of the Department of Planning
Services.
24 The property owner or operator shall be responsible for complying
with all of the foregoing Development Standards. Noncompliance
with any of the foregoing Development Standards may be reason for
revocation of the Permit by the Board of County Commissioners.

Dear Mr. Grubb:
We would like to request the permission of the Planning Services to make the
following changes to our Trap Shooting Range:
1) • Move the existing Trap Shooting Range approximately 100 yards due
south of the present location (see attached drawing). The direction of
the shooting will change from due north to north-northwest. The reasons
for this are a) to keep lead shot on our property, and b) to protect the
Caretaker's residence. This move will not endanger any other residences
for there are none.
2) Erect a permanent warming house. We are currently operating out of
a temporary warming shelter which is too small. We need a permanent
building approximately 36' by 60' to accomidate our needs. The
construction of this building will be a concrete block footer and
a modular office unit.

Description of the proposed operation and use for the Weld County Fish and Wildlife
Assn. Sporting Clays Range.
1) The proposed use is to expand the scope of our existing special review permit to
include a Sporting Clays range on the North end of the club property. Sporting Clays is
a shotgun sport that is similar to trap and skeet, except that the shots are more difficult
to judge correctly making them more difficult to hit. Five separate stations are set up with
ten shots being fired at each station totalling 50 shots per round. Shooters are combined
into squads of five or fewer and proceed through the course together similar to the way
a golf course is run. it is also our intention to promote the purposes of this club in
general such as conservation of fish and wildlife, and to promote the practice of safe and
responsible firearms handling. And to encourage interest and knowledge of same.
2)The need for this facility is shown by the lack of such courses in North central and
North eastern Colorado and the flood of interest we've received concerning this sport.
Also the membership of this club showed a significant interest in providing a facility of this
type of our own.
3) The types of existing uses on surrounding properties include dry land farmmg and
some pasture land, but consists of mainly marginal agricultural land with a sparse rural
population from whom we have received no objections to the current activities of this club
so far as we know.
4) The distance to the nearest residences to the proposed range to the North and West
ore at least 2 miles respectively. to the South is approx. 2 miles. to the East With the
exception of the grounds caretaker is approx. 3/8 mile.
5) The total number of patrons and members for one day should be approx. 40 during
the course of an entire day. Shoots would be held every 1st and 3rd Sunday of each
month beginning at 9:00 am and ending at 4:00 pm. The club members will provide all
volunteer help for operating the course (2 to 3 persons including at least one board
member.) General range usage hours are from 7:00 am to sundown on weekdays and 8:00
am to sundown on weekends.
6) Water hydrants have already installed on the property for use by other club activities
and no additional water will be necessary.
7) The access route will be WCR 51, the same access os for the current club activities.
8) Vehicular traffic would be personal vehicles and would not involve any increase
commercial type traffic.

9) There are currently no plans for sewage facilities for this course. The property is
already served by Slims Sanitation Inc. with porta-lets and will be serviced regularly by
same.

the Galeton Fire Department.

12) There will be no waste storage areas. 20 gal trash containers with plastic liners will
be used to collect trash and empty shells after each shoot. the patrons and management
will remove all waste from the grounds and dispose of properly.
13) There would be no need for storm water retention facilities. And this use will not
create any additional runoff.
14) Mineral rights are owned by Union Pacific Railroad.
15) A temporary 10x20 warming house would be moved from it,s current location on the
Trap range to the Sporting Clays range.
16) Three acres of fescue grass seed and 15 trees planted along dry ditch, and a split rail
fence erected along the North nm of the dry ditch.
17) Location is 7 mi. East of Ault on Hwy 14 and 1 1/2 mi. South on WCR. #51. Or 3
mi. North of Galeton on WCR. #51.
18) There are approx. 600 members on record to date. Only club members and their
immediate families are provided access with the use of a pass key during the week or
when there is not a scheduled shoot as indicated on the attached schedule. Average
usage during the week is approx 30 to 40 total in one week. Usage on the weekend is
approx 30 to 40 total for both days.

suNect Case Number: Sup 215 Name: Weld County Fish and Wildlife
Environmental Protection Services has reviewed this proposal and recommends for
approval, subject to the following conditions:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. All waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
6. An I.S.D.S. Evaluation on any existing septic systems will be necessary,
prior to issuing the required septic permits on the existing systems.
7. A bathroom with adequate toilet facilities serviced by an individual
sewage disposal system, is required for the proposed facility and shall be
installed according to the Weld County Individual Sewage Disposal
Regulations.

WELCOME TO THE HIGH PLAINS SHOOTING RANGE.
The aforementioned organization of Sportsmen and Sportswomen, was
organized as a non-profit conservation club over 40 Years ago.
The Association is still heavily involved in Conservation issues,
but has expanded its involvement into Legislative matters, education,
and Promotion of Shooting Sports. The Association owns a 123 Acre range
facility eight miles east and one mile south of Ault, Colorado
Organized activities include Bench-rest riflin, High-power rifle,
Black-powder rifle, Trap, Sporting Clays, Bulls-eye and Silhouette
Pistol, Archery, and a very act=ve Greeley Junior Shooting Club
The Range is open every day during daylight hours for PLINKING and
practice We are fortunate to have over 20 NRA certified Instructors .
They teach classes in Safety, Rifle, Pistol, & Shotgun Classes are
Family oriented and everyone is encouraged to attend
General Membership meetings are held at 7:30 p.m. on the Second
Thursday of the Months of February, May, September, & December, at the
Disabled American Veterans Home at 2407 5th Ave. Greeley, Co.
Board Members are elected at the December Meeting, and Board of
Directors Meetings are held on the Third Thursday of each Month at the
same location and Time.
Membership Dues at present are $35. 00 for New Members, and $25 00
for Renewals Memberships expire at Midnight on Dec. 31st of each year.
and may be renewed for the following year, starting at the General
Membership Meeting in September until Feb 28TH with no penalty A
$10 00 late fee is assessed on renewals paid on or after Mar. lst
Memberships are for one Family, which consists of Husband, Wife, &

facilities are not needed due to the fact this is a family owned business and
residences are located on the property. If any outside employees are hired, who
do not live on the site, then restroom facilities would be required. Phil
Pennock agreed with this change.
The Chairman asked if there was anyone in the audience who wished to speak for
or against the application.
Bob Ramsey, surrounding property owner, said they rent this property out to
tenants but they are concerned about problems with manure, feathers, and noise
levels. He said that even though the turkeys were contained indoors, the -
building would have to be ventilated and at some point the manure brought
outside. If problems arise, what recourse do they have. Judy Schmidt explained
they can file a complaint with the Weld County Health Department and the Health
Department will respond within 1 to 5 days.
Anna Mary Hilton, surrounding property owner had no objections to this
application. She said the Berthoud area is a considered a depressed area and
subsidizing existing businesses is necessary.
Jean Hoffman asked if this Use by Special Review permit should be limited to the
Pennock's, rather than with the property. Phil and Doug Pennock said they would
prefer it with the property in case of illness, injury or health reasons they
were unable to continue to work the business and had to sell.

Stan May, President, Weld County Fish and Wildlife, said the organization was
founded in approximately 1948. They have 600 members with annual dues o£ $25.00
and have had no gun related injuries for the past 50 years. The proposed
clubhouse will be a 36' x 60' modular building and the ranges will include, trap
skeet, sporting clays, and a 600 yard high powered rifle range. He said he feels
Development Standard #4 was too restrictive. Ann Garrison asked what
specifically was too restrictive. Stan May quoted the 80 foot harming required
for the 600 yard high powered range. He said it would be too costly and was not
necessary. Bud Clemons asked what the National Rifle Associations requirements
are. Stan May said he didn't know off-hand but they would gladly comply with
whatever they were. He also had reservations about Development Standard #7. He
explained this is a "key club" and it would also be too costly to maintain a
certified instructor at all times. Brian Grubb explained that Section 45.3 of
the Weld County Zoning Ordinance states, if there are more than 4 individuals on
the premises on a regular basis, compliance is required.
The Chairman asked if there was anyone in the audience who wished to speak for
or against the application.
: Curtis Heinz, surrounding property owner, is concerned about the bind weed
growing on the gun club property. He is required to control it in his area.
Stan May responded the gun club would comply with the regulations regarding bind
weed.
Bob Horton, surrounding property owner wanted to know what direction the 600 yard
high powered rifle range would point. Brian Grubb said north to northwest. Bob
Horton said that was aimed directly at his property and anyone tending cattle
could be in danger.
Fred Haumbaum, Board of Directors, Weld County Fish and Wildlife, explained that
in the past, policy had been first man on the range would act as range officer
and the position would be assumed by the next man when the first man left. He
said he personally did not want to see the 600 yard range go in, due to the fact
that it drains funding to the other ranges because of upkeep.
Stan May said he did not have the authority to remove the 600 yard range from the
request without first meeting with the members of the organization.
Jean Hoffman moved Case Number Amended SUP-215 be denied based on testimony heard

seconded the motion.

Ariel Sanstead said she was not opposed to this request but she was born in Keota
in 1923 and had questions. She wanted to know how Stoneham and New Raymer were
zoned. She is concerned with the title "abandoned" used in the newspaper and
said that a lot of people had property in Keota but live out of the State of
Colorado. Lee Morrison explained that the term "abandonment" was used at a
Federal Level when a town no longer had a functioning municipal government.

i This letter is in reference to items three and four of the
recommendations page of the SITE SPECIFIC DEVELOPMENT PLAN,
' SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS for the Weld County
Fish and Wildlife Association Amended SUP-215 . We respectfully
submit the following proposals .
In reference to item three , we have rotated the skeet houses
slightly to the northwest to provide the required 600 by 300 yard
safety zone required by section 45 . 3 of the Weld County Zoning
Ordinance . This change is noted in the new revised plat mat .
In reference to item four , we have decided to delete the 600 yard
range . To make use of this space on our range we would like to
put in a 300 yard range in the same area that complies .ith
section 45 .3 of the Weld County Zoning Ordinance .
We are hoping that these two changes are enough to allow us to
schedule our request before the Board of County Commissioners .
