RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1044 FOR AN ACCESSORY STRUCTURE OVER 1500 SQUARE FEET IN AN AGRICULTURAL SUBDIVISION AND A HORSE TRAINING FACILITY - DONALD L. AND JOANN K. HARMON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 1st day of June, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Donald L. and Joann K. Harmon, 2631 West 175th Avenue, Erie, Colorado 80516-7902, for a Site Specific Development Plan and Special Review Permit #1044 for an accessory structure over 1500 square feet in an Agricultural Subdivision and a horse training facility on the following described real estate, to-wit: Lot 10, Ranch Eggs, Inc. , First Filing, Weld County, Colorado WHEREAS, Donald and Joann Harmon, said applicants, were present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies because productive farmground will not be removed from production and is provided for as a Use by Special Review. This proposal is also consistent with the Comprehensive Plan's Urban Growth Boundary Area Goals and Policies. The proposed land use is located within the Urban Growth Boundary area of the Cities of Broomfield, Northglenn, and Thornton, and the Towns of Erie and Dacono. The uses which would be permitted will be compatible with the existing surrounding land uses which include an irrigation ditch, dryland crops, rural residences, pasture and a llama farm. The uses which would be permitted will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. c. No overlay districts affect the site. d. Special Review Permit Development Standards will provide adequate protection for the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Donald L. and Joann K. Harmon, 2631 West 175th Avenue, Erie, Colorado 80516-7902, for a Site Specific Development Plan and Special Review Permit #1044 for an accessory structure over 1500 square feet in an Agricultural Subdivision and a horse training facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the plat: a. The derelict vehicles, second-hand building materials, and old concrete shall come into compliance with the Weld County Zoning Ordinance noncommercial junkyard definition. b. The Site Specific Development Plan and Special Review Permit is for an accessory structure over 1500 square feet in a platted subdivision and a horse training facility in the A (Agricultural) Zone District as submitted in the application materials on file and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The uses of the property shall be limited to a horse training facility for no more than 30 horses. No commercial, roping, or rodeo events shall be allowed on site. 4. No construction business shall be operated from this site. 5. Manure from the livestock area shall be removed, handled, and stockpiled in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 6. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7. No permanent disposal of wastes shall be permitted at this site. 8. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 11. No more than five riders may utilize the special use facility at any one time. 12. The arena shall have a minimum of 60-foot area on all sides, defined as "yards" in the 1991 Uniform Building Code. 940509 DEVELOPMENT STANDARDS - HARMON PAGE 2 13. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 14. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 17. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 18. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 940509 HEARING CERTIFICATION DOCKET NO. 94-43 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN ACCESSORY STRUCTURE OVER 1500 SQUARE FEET IN AN AGRICULTURAL SUBDIVISION AND A HORSE TRAINING FACILITY - DONALD L. AND JOANN K. HARMON A public hearing was conducted on June 1, 1994, at 10:00 a.m. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated May 11, 1994, and duly published May 19, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Donald L. and Joann K. Harmon for a Site Specific Development Plan and Special Review Permit for an accessory structure over 1500 square feet in an Agricultural Subdivision and a horse training facility. Lee Morrison, Assistant County Attorney, made this a matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Mr. Schuett requested the Board take separate action to vacate SUP #467 on this property, which would eliminate Condition of Approval #3c. He explained SUP #467 was for a chicken manure processing facility; however, it has not been used for several years. Donald and Joann Harmon, applicants, were present and stated they breed, break, and race quarter horses and need an arena to train. They also stated the indoor arena will prevent dust and the manure will be disposed of; therefore, there should not be a problem with runoff. In response to questions from the Board, Mr. Harmon stated a 350-foot long building on the property was torn down about three years ago, and their building will be 300 feet by 100 feet. He reiterated that runoff should not be a problem because horse manure is solid, unlike chicken manure, and the size of the building is necessary to break and train their own horses. Mrs. Harmon explained they need an arena big enough to condition and train their horses, and Mr. Harmon further explained the training process and needs. He noted the previous building was only 20 feet from the road on the south property line, and runoff problems were created by the liquid manure. Mr. Harmon indicated the new building would be 50 or 60 feet from the north property line. Responding to further questions from the Board, Mr. Harmon said a 287-foot long, 16-foot high, barn exists on the property and has been converted into stalls, and the proposed building will be 20- feet high. Mrs. Harmon stated the surrounding properties include farm ground, a llama farm, and the Community Ditch, and the properties contain 200- to 250-foot long chicken house buildings. Mr. Harmon stated the maximum number of horses allowed is 30 head. He explained he used to be in the construction business, and there are three construction vehicles parked on his property; however, the business is not operated at the site. In response to a question from Commissioner Kirkmeyer, Mr. Schuett indicated Development Standard #1 is a general standard which limits the uses to the plans submitted in the application materials. Commissioner Kirkmeyer stated concerns about the facility becoming commercial. Mr. Schuett answered further questions for Commissioner Kirkmeyer and confirmed the maximum number of riders allowed in the arena would be five. Commissioner Baxter confirmed the roping arena use was removed from the 940509 Pt .0n JU RE: HEARING CERTIFICATION - HARMON PAGE 2 application. Donald Falagrady, David and Sharon Schulz, Ed Cox, and Marvin and Millie Hanel, all surrounding property owners, spoke in opposition to the proposal, answered questions from the Board, and stated various concerns including decreased property values; operation of a commercial business; increased traffic; location, size, compatibility, and future utilization of the proposed building; enforcement of regulations; problems with bugs, flies, and dust; the number of horses allowed; disposal of manure; elimination of open space; consistency with the Comprehensive Plan and future development; and lack of vegetation. Mr. and Mrs. Hanel submitted "Opposition to USR #1044" as Exhibit F during their presentation, which included overheads and photographs of the area. Staff answered various questions for Mr. Hanel. Mr. Harmon stated there are neighbors in the area which support the proposal and he has increased the condition and value of his property by $100,000 in 2z years. He reiterated there would be no rodeos or events other than training their race horses at the site, clarifying this proposal is a family affair. Mr. Harmon stated he plans to retire on this property, and it will be a show place. He said the dust in the area is created on the road by the residents and confirmed the road is about six inches above the barrow pit and maintained by Weld County. Mr. Harmon noted the race track could be built outside without a building to keep the dust inside the arena. He estimated the proposed building to be 300 feet from the Falagrady's property and 100 to 125 feet from the Schulz's property. Mr. Harmon stated there are several properties with horses in the area and reiterated that only family members would be participating in this operation; therefore, traffic and dust would not increase. In response to questions from the Board, Mr. Harmon stated he has 15 head of horses now, and he plans to control the dust by watering and spreading manure on the ground. He confirmed that he would comply with all Conditions of Approval and Development Standards. Mr. Morrison clarified that manure is not considered a solid waste, and the disposal methods are outlined in Development Standards #4, #5, and #6. In response to further questions from the Board, Mr. Harmon explained he presently hauls his horses to a training farm, at a cost of $15 per day plus bills for vet, shoeing, etc. ; therefore, his training bill will pay for the building and allow him to do his own work. He indicated he is boarding and breeding brood mares in the stalls and runs in his existing barn, with three yearlings and mares in pens. Mr. Harmon stated the rest of his property is knee-deep in grass except for the dirt on the driveway around the house and around the pens. Responding to further questions from the Board, Mr. Harmon explained the horses are trained for 120 days before they race. At the request of Commissioner Hall, Mr. Schuett further clarified Development Standard #4 stating the manure could be incorporated into the soils so long as it does not create nuisance conditions and any excess is removed. Mr. Harmon confirmed he has already made arrangements for the manure to be spread on farm land away from his property. In response to questions from Commissioner Kirkmeyer, Mr. Harmon explained quarter horses must be trained to run straight, long, distances and are not supposed to turn like thoroughbreds. He stated he would prefer a 350- to 500-foot-long building and reiterated a 350-foot building previously existed on the property, which is where the waste problems were created. He also reiterated his building will be at the back of the property by the Community Ditch and not by 175th Avenue. Mr. Harmon stated his horses are kept in pens and on pasture and are fed alfalfa and grain twice each day. He confirmed the property would not be run down and oats with nine different grass seeds could be planted if necessary. He further explained the training horses are home for the winter and taken to the race track after they are trained in the spring. They are then placed in claiming races where some are sold off the track for racing, and others are sold for barrels, pleasure, or cutting horses. He reiterated that he is limited to 30 head. Responding to questions from the Board, Mr. Schuett indicated the existing building on the site is 287 feet by 45 feet and stated there are two other buildings in the subdivision which are at least that long. After further 940509 RE: HEARING CERTIFICATION - HARMON PAGE 3 discussion, Commissioner Harbert suggested a Development Standard be added restricting other activities such as roping or rodeo events. Mr. Schuett read the proposed language into the record, and Commissioner Kirkmeyer requested the restriction of commercial uses be included. [Clerk's note: Development Standard #3 shall state, "The uses of the property shall be limited to a horse training facility for no more than 30 horses. No commercial, roping, or rodeo events shall be allowed on site." The remaining Development Standards shall be renumbered consecutively. ] In response to further questions from the Board, Mr. Schuett stated there is an existing retention area on the site, and the Engineering Department has indicated it is sufficient and there are no conflicts. Commissioner Hall stated it is not easy to determine whether the building is too big; however, he feels the building is somewhat compatible with the existing structures and the proposal is for an agricultural use. He then moved to approve the request of Donald L. and Joann K. Harmon for a Site Specific Development Plan and Special Review Permit for an accessory structure over 1500 square feet in an Agricultural Subdivision and a horse training facility, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and the additional Development Standard as entered into the record by Mr. Schuett. The motion was seconded by Commissioner Harbert, who indicated the proposal complies with the Special Review Permit standards and would be compatible in the area. Chairman Webster stated, after seeing the photographs with the numerous structured barns in the immediate area, that he, too, feels the proposed building would be a compatible type of structure. He reiterated he had no idea there were that many buildings in the area until he saw the pictures and overheads. Commissioner Kirkmeyer noted Development Standard was added restricting commercial uses and stated the applicants understand their neighbors concerns. She agreed a commercial use would not be compatible in the area; however, the Harmons are already allowed 30 horses on the property by right, and the building will help with dust control. Commissioner Baxter stated restrictions are important and he has confidence in the Planning Department's ability to enforce compliance of Special Review Permits. He indicated this site would be watched closely. On a roll-call vote, the motion carried unanimously. Commissioner Hall moved to vacate SUP #467, and Commissioner Kirkmeyer seconded the motion which carried unanimously. This subdivision is now in a period of transition . At one time there were 22 egg production barns , now there are only 5 . The area is zoned for agricultural use . At this time there have been a couple of zoning variances granted: 1 ) a machine shop , 2 ) a furniture factory . I would urge the planning department and the county commissioners to carefully evaluate the direction this community should take. Are we going to be a community of mixed use similar to Commerce City , or can we do better than that, or do you care? The work the Harmon' s have done to the old Rockwell place has improved their property value and the value of surrounding properties . I do , however, have several serious problems with the Harmon ' s site development plan . 1 . A 30 , 000 square foot building on a nine acre lot in a subdivision is not only over building--it is non-conforming . This is to be used for training race horses and that is not agricultural . 2 . The original site plan included using the building for horse roping events which for the present time has been withdrawn . Is there an ulterior motive here to get approval for the building, then get approval for the rodeo events??? If horse roping is still in the back of their minds and you grant the approval for this future warehouse, where will they park 50 to 100 pick-ups and cars , on the road? I think not ! 940599 3 . The road at this time is 6" below the edge of the bar ditch and when it rains the water runs down the road and down driveways--not in the bar ditch . The road can be graded on Monday and by Wednesday be as rough as before with current traffic volume. What provisions have been made by the Harmon ' s and the county to improve the condition of the road as I assume there will be training of more than their . own horses being done in the barn and more traffic than we currently have. 4 . What plans have been made to control drainage which will run off the building during heavy rains? Now most can be absorbed into the. soil but if the building—were there onto whose property would it drain? What precautions are being taken for fly and insect control , manure removal and clean up? I would hope that the above information will be given careful consideration as the result will be setting a precedence for future planning . I would like to remind the commissioners that this is the same piece of property that was over-built once before. Is history going to repeat itself? LOCATION: Approximately 1300 feet west of Weld County Road 7; south of and adjacent to the Community Ditch, and north of and adjacent to 175th Avenue. Mr. and Mrs. Harmon, applicants, stated they raise and train racing horses. They have been boarding their animals at another location and it would be less expensive to train their own horses on-site. They have approximately 10 acres. This indoor arena would be used in the winter to break the horses. The manure created on site would be used for their own property and any extra would be sold to farmers. There would not be much traffic; only the family members that are involved. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. No construction business shall be operated from this site. 4. Manure from the livestock area shall be removed, handled and stockpiled in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No more than 5 riders may utilize the special use facility at any one time. 12. The code requirements vary considerably between the two uses, particularly when the occupant load exceeds 50 persons. At this time, I believe that the issue could be resolved by Weld County limiting the use of the building to use by Mr. Harmon, his family and employees. Mr. Harmon has told me that will meet his current needs. If in the future, he wants to expand the use to include events where others are invited, then he would need to return to Weld County and apply for a change of use. At that time, building and site plans would need to be submitted to the Fire District, and Mr. Harmon should anticipate making any changes to the building and site that are required by the codes then in existence for that new use of the building. Until then, Mr. Harmon does not need to submit plans to the District. This subdivision is now in a period of transition. At one time there were 22 egg production barns, now there are only 5 . The area is zoned for agricultural use . At this time there have been a couple of zoning variances granted: 1 ) a machine shop, 2 ) a furniture factory . I would urge the planning department and the county commissioners to carefully evaluate the direction this community should take. Are we going to be a community of mixed use similar to Commerce City , or can we do better than that, or do you care? The work the Harmon ' s have done to the old Rockwell place has improved their property value and the value of surrounding properties . I do, however, have several serious problems with the Harmon' s site development plan . 1 . A 30 , 000 square foot building on a nine acre lot in a subdivision is not only over building--it is non-conforming . This is to be used for training race horses and that is not agricultural . 2 . The original site plan included using the building for horse roping events which for the present time has been withdrawn. Is there an ulterior motive here to get approval for the building , then get approval for the rodeo events??? If horse roping is still in the back of their minds and you grant the approval for this future warehouse , where will they park 50 to 100 pick-ups and cars , on the road? I think not ! - EXHIBIT 9405 '9 3 . The road at this time is 6" below the edge of the bar ditch and when it rains the water runs down the road and down driveways--not in the bar ditch. The road can be graded on Monday and by Wednesday be as rough as before with current traffic volume. What provisions have been made by the Harmon' s and the county to improve the condition of the road as I assume there will be training of more than their own horses being done in the barn and more traffic than we currently have . 4. What plans have been made to control drainage which will run off the building during heavy rains? Now most can be absorbed into the soil but if the building were there onto whose property would it drain? What precautions are being taken for fly and insect control , manure removal and clean up? I would hope that the above information will be given careful consideration as the result will be setting a precedence for future planning . I would like to remind the commissioners that this is the same piece of property that was over-built once before. Is history going to repeat itself?
