RESOLUTION
RE: APPROVE VACATION OF RE #1017 - TROSTEL
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute .and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, on January 12, 1994, the Board did, by Resolutions #940080 and
#940081, approve Special Review Permit #1036 and Recorded Exemption #1566,
respectively, for Thomas G. and Beverly Trostel for property which is located in
part of Section 9, Township 6 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, and
WHEREAS, Condition of Approval #1 of said Recorded Exemption #1566 and
Condition of Approval #4.a. of said Special Review Permit #1036 stipulated that
said applicants must obtain a resolution vacating Recorded Exemption #1017, and
WHEREAS, Steve Stencel, Intermill Land Surveying, has submitted a letter
on behalf of the applicants requesting said vacation of Recorded Exemption #1017,
and
WHEREAS, after study and review, the Board deems it advisable to vacate
Recorded Exemption #1017, based on the Planning staff's recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Recorded Exemption #1017 be, and hereby is, vacated,
satisfying Condition of Approval #1 of Recorded Exemption #1566 and Condition of
Approval #4.a. of Special Review Permit #1036 issued to Thomas G. and Beverly
Trostel.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 31st day of January, A.D. , 1994.

Subject:
Condition of Approval #1 for Recorded Exemption #1566 and Condition of Approval
#4.a. for Use by Special Review permit #1036 stipulated that a resolution
vacating RE-1017 needs to be obtained by the applicants. Representatives for the
applicant have submitted a letter requesting the vacation. Planning Staff
recommends approval of this vacation to satisfy this Condition of Approval for
both RE-1566 and USR-1036.

RE: Vacation of Recorded Exemption 1017
To Whom It May Concern;
This letter is to formally request the vacation of Recorded
Exemption 1017 located in Section 9, Township 6 North, Range
66 West of the 6th P.M. , Weld County, Colorado.
As per the Resolutions for Recorded Exemption 1566 and USR 1036,
the existing RE 1017 must be vacated prior to approval of the
aforementioned projects.
