Dear Loraine:
After our telephone conversation of October 19, 1992, I would like
to complete our adequacy responses. I will use the same numbering
system we have used previously and that was contained in your
October 7, 1992, letter.
1 . With this letter you will find enclosed a copy of an aerial
photograph were I have better delineated the Larson #7 and the
Rodman #6 property in relation to the permit area.
2 . With this letter you will find a copy of the compensation
agreement with the Elliott landowners to the west.
We also wish to reserve the option to include the Rodman
structures in the engineering soil stability analysis and mine
at 25 feet from the property if the results show no adverse
effects on the stability of structures.
3 (b) We will stake in the field metal T stakes, the limit of
disturbance from the pipelines, railroad, and the overhead
utility lines at the 200 foot limit prior to the review of our
engineering soils stability analysis.
6(b) In order to maintain hydrologic balance and quality of the
groundwater, the operator will install an eight to twelve inch
layer of compacted road base material underlying the entire
asphalt batch plant area.
8(b) The groundwater level temperature, and conductivity of each
monitoring well and the two private wells (if owner permission
is obtained) will be monitored quarterly and submitted with
each annual report. Baseline data monitoring will begin as
soon as possible prior to commence of mining and continue
concurrent with mining. If no significant differences occur
between the baseline data and the mining monitoring data for
a period of two years, the monitoring for temperature and
conductivity may be suspended based on review by Division
staff.

8(c) In order to clarify our response, we state that the
professional engineer will also locate the ponds on Exhibit C
and determine how these ponds might affect the stability of
dwellings.
Enclosed with this letter is a copy of the certified mailing
receipt showing proof of mailing of my October 15, 1992 letter to
the Weld Clerk to the Board. A copy of this letter will also be
sent by certified mail to the Weld County Clerk to the Board. A
copy of the proof of mailing is enclosed.

Dear Elmer and Cecil Elliott:
This letter is to inform you of the proposed specifics of the 83rd Joint
Venture mining operation northwest of Greeley in Section 35, Township 6
North, Range 66 West, Weld County, Colorado. This property is adjacent to
your property. Included with this letter are copies of the mining plan maps
(Exhibit C) and a written description of the proposed mining operation
(Exhibit D) .
The mining activities as proposed will not adversely affect the stability of
your structures. The operator will maintain a 50 foot setback (minimum) from
your property line. The slope of the mining pit will be 3H: 1V. Any damages
to your property caused by mining activities will be repaired or compensated
for by the operator.
Please acknowledge your understanding of these facts by countersigning below
and forwarding one copy of the signed page to our firm. We have enclosed a
self addressed, stamped envelope for your convenience in returning the signed
form. As required by the Mined Land Reclamation Act, a copy of this letter
will be included in our State mining application.
If you have any comments or questions, please let us know. Your timely
consideration of this letter is appreciated.
