RESOLUTION
RE: ACTION OF THE BOARD CONCERNING PETITION FOR LOCAL IMPROVEMENT
DISTRICT ALONG 71ST AVENUE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a Petition for a Local Improvement District along
71st Avenue was submitted by owners of property which is more
particularly described in said Petition, and
WHEREAS, after review, the Board deems it advisable to accept
said Petition and schedule a Preliminary Hearing concerning this
matter for June 6, 1990, at 10: 00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that a Preliminary Hearing
to consider the aforementioned Petition for a Local Improvement
District along 71st Avenue be, and hereby is , scheduled for June
6, 1990, at 10 :00 a.m.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
May, A.D. , 1990 .

We, the undersigned, citizens of Weld County, who are owners
of record of real property proposed to be assessed a portion of
the costs for the entire project, and which property will benefit
from improvements in the area of (describe general area to be
improved) :
71st Avenue between U.S. 34 Business Route (also known as
West 10th Street) and U.S. 34 Bypass;
situated in Weld County, Colorado, do hereby petition the
Honorable Board of County Commissioners of the County of Weld,
State of Colorado, for the formation of a local improvement
district pursuant to CRS, S30-20-601 , et seq. We represent that
the real property listed in this petition (s) will be assessed more
than one-half of the $74 , 250 .00 in costs proposed to be assessed
to the local improvement district. Such improvement district is
for the purpose of (may include road improvements, street
lighting , or drainage) :
Road improvements and drainage incident to road improvements.
The specific improvements we wish to have constructed are as
follows (designation of specifics, optional) :
Shape, grade, drain, and pave the above-described road.
We request that the following materials be used:
Six inches of aggregate basecourse and three inches of
asphalt pavement on 71st Avenue, and culverts necessary to
accomplish drainage.
The specific time and manner of assessments we recommend is as
follows:
The property owners be assessed $350 .00 per lot for all lots
within Knaus Subdivision 2nd, and 3rd Filings, and Peterson-
Alexander Subdivision, excepting Lot 5 , Block 1; and
$1,900.00 per each individual parcel of land adjoining 71st

Avenue between U.S. 34 Business Route and U.S. 34 Bypass,
including lots 1 and 2 of Bird Subdivision 1st Replat, for
the cost of materials and labor for the installation of
asphalt.
The assessment shall be payable either in full, without
interest, or over a ten-year period at the rate of nine
percent (98) simple interest per annum.
We further understand and acknowledge that we are to be
responsible individually for any grading or other adjustments to
our driveways and culverts necessitated by such project.
Do not sign this petition unless you are an "owner" of real
property benefitting from the project and requesting to be
assessed costs of the improvements. An owner is a person holding
fee title to real property. You are an "owner" if you hold a
contract to purchase real property which obligates you to pay
general taxes on that property. In that instance, the seller may
not sign this petition. CRS, S30-20-602 (3) and 603 (3) .

Dear Sirs:
This letter is to notify you that we ABS NOT IN FAVOR of creating the
Local Improvement District which includes the pawing of 71st Avenue
between U.S. 34 Business Route (also known as West 10th Street) and U.S.
34 Bypass.
We own the property with the address and legal description as follows:
7413 West 11th Street; Lot six (6) , Block one (1) , Knaus Subdivision,
Third Filing; in the County of Weld; in the State of Colorado.
These are some of our concerns:
First and foremost, we believe this Local Improvement District is
NOT the wish of the majority of Knaus residents. We feel the
voting results are misleading. Here' s why:
* The First Filing residents of the subdivision WERE NOT polled.
Why? Because THEY WOULD VOTE NO?
* Why were property owners facing 71st avenue given 4 to 5 votes to
Knaus residents' one?
Yes, they would have to pay MORE. . .their property lines MORE
of the road! They should not be allowed to pad a vote(?) to
have others pay for it! !
To say that Knaus residents' usage of the road has caused the
inability to maintain it is, in our opinion, incorrect.
* What about the new businesses north of Business 34?
* What about all the Hewlett Packard employees using the road, even
coming from Loveland?
* What about the new City Golf course going in?
Let' s be honest, THEY are the reasons for increased traffic!
Please understand that money is not an issue here! We were more than
willing to pay our flare of paving our road. That comes with purchasing
any real estate. We are aaainst paving for others to pave their roads.
For the second consecutive year this issue has set our neighbors against
each other; in some cases, even husbands against wives. Can we get this
settled once and for all?
Last year it required a lawyer to get all the facts and vote this issue
down. This year you have simply changed the voters. Do what you must,
but get it settled!
We will, of course, adhere to your decision. We will also make our voice
heard in the form of votes against commissioners who don't truly
represent ALL, their constituents.

Dear Gene R. Brantner,
I am the owner of two farms on each side of 71st,
avenue at Greeley, Colorado. I am being plagued with
proposals to access the land owners on each side of 71st,
avenue to oil the road. This will be of no value to me
as agricultural land and I don't understand why the county
doesn't pay for oiling it if they want it oiled. We
already have proved that the majority of land owners do
not want it oiled.

such proposal with whatever measures it takes.

Dear Mr. & Mrs. Slemons:
As property owners you are probably aware that there are efforts to improve
71st Avenue between U.S. 34 Business Route (also known as West 10th Street)
and U.S. 34 Bypass.
This is to notify you that a meeting with the Board of County Commissioners
concerning the Local Improvement District will be held at 10:00 a.m. on
Wednesday, June 6, 1990, in the First Floor Hearing Room, Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado. The purpose of this
meeting will be to consider the adoption of a preliminary order and
preliminary plans and specifications, which would described the materials to
be used, the number of installments and the period of time in which the cost
of improvements shall be payable and the property to be assessed. The
preliminary order will also contain the cost estimates and approximate
amount to be assessed on each property. A great deal of this information is
now contained in your petition.
You are encouraged to make your feelings known either through your
appearance at the meeting, through a power of attorney to another person so
that he may testify on your behalf, or you may submit a letter, prior to the
hearing, to the Board of County Commissioners, P.O. Box 758, Greeley,
Colorado 80632.
