RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR CONSTRUCTION OF WELD COUNTY BRIDGE
14.5/25A AND CITY OF FORT LUPTON BRIDGE FTL14TH-FULTON AND AUTHORIZE
CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement
for Construction of Weld County Bridge 14.5/25A and City of Fort Lupton Bridge
FTL14th-Fulton between the County of Weld, State of Colorado, and the City of
Fort Lupton, with the terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement for Construction of Weld
County Bridge 14.5/25A and City of Fort Lupton Bridge FTL14th-Fulton between the
County of Weld, State of Colorado, and the City of Fort Lupton be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 21st day of December, A.D. , 1992.

INTERGOVERNMENTAL AGREEMENT
FOR CONSTRUCTION OF WELD COUNTY BRIDGE 14 . 5/25A
AND CITY OF FORT LUPTON BRIDGE FTL14TH-FULTON
THIS AGREEMENT, made and entered into this 9TH day
of DECEMBER 1992 , by and between the COUNTY OF WELD, STATE
OF COLORADO, hereinafter called "County" , and the CITY OF FORT
LUPTON, Colorado, hereinafter called "City" .
WHEREAS, the City received a grant from the State Special
Bridge Fund to replace FTL14TH-FULTON in the amount of One
Hundred Ten Thousand, Seven Hundred Fourteen Dollars ($110, 714) ;
and,
WHEREAS, the County received a grant from the State Special
Bridge Fund to replace Bridge 14 .5/25A, in the amount of One
Million, Sixty-Seven Thousand, Two Hundred Dollars ($1, 067, 200) ;
and,
WHEREAS, the City and the County entered into an
intergovernmental agreement on the 4th day of December, 1991,
for the purpose of combining the administration, design and
construction of the two bridges in an effort to reduce costs;
and,
WHEREAS, the preliminary design for the two bridges has
been completed and the preliminary estimate for FTL14TH-FULTON
exceeds the grant amount and the preliminary estimate for
14 . 5/25A is less than the grant amount as shown on the attached
Exhibit A; and
WHEREAS, both projects are funded from the same State
Special Bridge Fund; and,
WHEREAS, combining the grant amounts will allow for the
completion of both bridges .
NOW, THEREFORE, in consideration of the mutual covenants
and conditions hereinafter set forth, the County and the City
mutually agree as follows :
1 . The mutal covenants and conditons as set forth in the
original agreement cited above are to remain in full force and
effect except as modified herein.
2 . The County will bill the City up to the total amount of
the State Special Bridge Fund Grant plus the twenty percent
entity match which totals One Hundred Thirty-eight Thousand,
Three Hundred Ninty-three Dollars ($138, 393) .
3 . When costs within the City Limit exceed One Hundred
Thirty-eignt Thousand, Three Hundred Ninety-three Dollars
($138, 393) , the County will include the remainder in its State
Special Bridge Fund Grant and bill the City for the required

twenty percent local match for construction cost only.
IN WITNESS WHEREOF, the parties hereto have duly executed
the Agreement in the day and year first-above written.
