NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is subject to the following conditions: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. Within 30 days of approval by the Board of County Commissioners, an ISDS evaluation by the Weld County Health Department will be performed on all existing septic systems, prior to issuing the required septic permits on the existing systems. 3. The parcel of land is described as part of the NW4 of Section 23, T1N, R68W of the 6th P.M. , Weld County, Colorado; Lot B of RE-45. The property is located south of Weld County Road 8, East of I-25 Frontage Road. The original recorded exemption created a 5 acre parcel and a 146.6 acre parcel, more or less. Because the 146.6 acre parcel is legally divided by the Bull Canal right-of-way, the Commissioners are also requested to vacate the portion of the original Lot B which is east of the Bull Canal. This request is to divide the remaining 39 acre parcel, which is west of the canal, into two lots of 38.5 acres and 1 acre, more or less. There are two existing homes on the property which both utilize Left Hand Water District as their water source. Both homes are served by septic systems. If this request is granted, each created lot would contain one single family dwelling unit. The Town of Erie and the Cities of Broomfield, Northglenn, and Thornton have no objections to this request. The staff has concerns that the proposed division will be inconsistent with efficient and orderly development. In 1976, a nine-lot commercial subdivision was created in the quarter section immediately south of this property. Five of those lots access directly onto the frontage road. There are also four other accesses onto the frontage road in this mile section in addition to the two existing accesses on the property in question. The level of development and the potential for continued divisions on this parcel and the other parcels in this half section warrants concern. Residential development in rural areas necessitates an increased demand for road maintenance, police and fire protection, school busing, snow removal, utilities, and other urban services. The property consists of approximately 150 acres devoted to haying and cattle raising, a permanent residence for the owner, Mr. Roland Bury, and a mobile home currently occupied by his daughter Caroline. Mr. Bury has had knee replacement surgery on both knees and requires the help of his daughter Caroline for his care and the care of the cattle. Mr. Bury wishes to break off a one acre parcel ,for Caroline to build a permanent dwelling to reside in while she helps maintain the operations of the farm and aids in the care of her father. 5. The proposal is consistent with the Weld County Comprehensive Plan policy 7.C (page 27) in that it will enable the property owner to provide a residence for a direct member of the farm family. 6. The property is in the Agricultural Zone District, in which the intent is to keep productive agricultural land in productive use. None of the hay land and very little of the pasture ground will be removed from production as a result of this proposal. Without Caroline's ability to reside on or near the farm, however, the farm's operation is in jeopardy due to the owner's inability to maintain it himself. Therefore, the proposal is conistent with the intent of the zone district in which the property is located. e l (±(7° ) ?. The only difference in use will be a permanent detached residence replacing a nobile home which will maintain the overall density on the property. This is clearly an agriculture/rural type density and is consistent with the existing agricultural and relatad residential land uses which surround the property. 8. As we understand it, there are no plans for future development of this area. Thus the proposal is as compatible with the projected future as the actual present. q. The proposal will be consistent with efficient and orderly development because no development is anticipated. If and when the area over does begin to urbanize, any other dwellings will interfere very little with development on most of the property since the two homes will be relatively close to each other and served by the existing frontage road. 10. Water is provided by Left Hand Plater Supply Company through an existing tap on the property. Sewage disposal will be by an on-si to septic system. The systen has an existing permit and is being inspected by the Weld County Health Department. The new proposed dwelling will not change in the number of bedrooms from the existing mobile home, therefore, the current system should be sufficient for the proposed dwelling. 11. The map shall be prepared at a 1" Q 100' scale and shall include the parcel in question, as well as features within 500 feet of the parcel boundaries. The scale of the map may be reduced or enlarged upon approval of the Department of Planning Services. Such map shall also include: a. A certified boundary survey of the property for which application is made. Bearings and distances of all perimeter boundary lines shall be indicated outside the boundary lines. b. The topography of the area at ten (10) foot contour intervals or at intervals as determined by the Department of Planning Services. c. Existing structures and landscape features, including the name and location of all watercourses, ponds, and other bodies of water. d. Proposed building locations and arrangements. e. Legend including a complete and accurate legal description as prescribed by the development permit application form. The description shall include the total acreage of the surveyed parcel. f. Engineer's Certificate and Surveyor's Certificate. g. Title, scale and north arrow. h. Date, including revision dates, if applicable. i. Such additional information as may be required by the Board of County Commissioners or Department of Planning Services. 1. A geologic report explaining the above maps with particular emphasis on evaluating and predicting the impact of such geologic conditions on the proposed land-use changes and developments. The report shall also include recommended mitigating procedures to be employed in meeting the intent and purposes of this regulation. Applications for development in ground subsidence areas shall include, but not be limited to, the following information or data, where applicable: a. Amount of material removed or materials subject to volume decrease. b. Interval between the ground surface and the location of void space or materials subject to volume decrease. 2 c. In poorly consolidated aquifers, the effect of pore fluid withdrawal. d. In wind deposited silt (loess) areas, and areas of predominantly fine-gralned colluvial soils, the amount of wetting the area is subject to and its effect. e. In areas of soluble materials, the effect of wetting. f. In areas of underground mining, date regarding air shafts, haulage ways, edits, faults, rooms and pillars, and final mine maps. g. Building type and proportion. II. Pertinent geologic and hydrologic factors of the area. I. Test hole and well log data. j. Mitigation techniques that will be employed, including effectiveness and estimated cost of such techniques. k. Pertinent historic factors including, but not limited to, part occurrences of ground subsidence in the area proposed for development. STANDARDS The Department of Planning Services shall not issue a Geologic Hazard Overlay District Permit until it has been determined that all applicable standards specified in the Veld County Zoning Ordinance have been met by the Applicant. 1. Applicants seeking a permit to develop in a regulated geologic hazard area must demonstrate to the Department of Planning Services through required maps and reports that all significant geologic hazards to public health and safety and to property shall be minimized by using mitigating techniques. These maps and reports shall be certified by registered professional engineer who shall certify that the design ol: the proposal ensures the protection of human life and property from the adverse impacts of geologic hazards to the greatest extent possible. 2. Any construction approved by the Department of Planning Services within a regulated geologic hazard area shall be supervised by a qualified professional engineer. SITE CONDITIONS: The site is presently occupied by a camper trailer (a mobile home occupied the site until recently) , covered in native grasses, and slopes approximately 2 % to the East. The lot appears to be in its natural condition. Lot features and profile / boring locations are shown on Appendix sheet A-1 . SUBSOIL CONDITIONS: Two 4 inch diameter exploratory holes were drilled to a depth of. 10 and 14 feet at the locations shown on sheet A- 1 . Samples of the soil material was taken at approximately 3, 5, 9, and 12 feet. These samples were analyzed in the field and the laboratory to determine the characteristics of the soil for foundation purposes. Soil testing was performed on the soil depths of concern for shallow strip footing construction, since the owner and builder expressed a preference for this approach. His intentions have been to raise the first floor elevation several feet above existing grade. Density / unit weight was determined to be slightly more than 102 pounds per cubic foot, at natural moisture content. Dry weight tested to 84. 5 pcf. Natural moisture content - as found in the field from boring 2 at 5 feet - was 21%. (See sheets A-2 and A-3) This is the expected range for soft clays. We noted that the soil extracted was very wet and plastic (soft and extremely moldable) . Flood irrigation of adjacent fields was ongoing at the time. We understand this is a continuous practice. We would suggest this may be one causation of the softness of the clay soils; it can lead to problems as detailed below. Of significance were the results of Atterberg limits tests for water interaction with the soil (Sheet A-4) . The liquid limit (percent of water added to the soil wherein the soil begins to flow) tested to 48%. The plastic limit (percent water which makes the soil moldable) measured 15%. The plastic index (the range between these extremes) was 33. Although this index does not suggest a high sensivity to water, the high liquid limit implies high water capacity. In turn, with the addition of the proposed home loading, this water is s / gradually squeezed out. This can cause disturbing settlements of the foundation over time. Soils were classified using American Society of Testing Materials (ASTM) procedures. The soils were classified through these field and laboratory procedures to be ASTM classification "CL" , a "lean" clay, with medium to high plasticity (see charts, p. A-4 and A-5) . This soil profile continued to a depth of 9 feet where a transition to an ASTM "GC" (clayey gravel) was encountered. This soil was extremely well saturated, with free water present. This too may be the result of the flood irrigation practice. Swell-consolidation test results are shown on sheets A-6 and A-7. With applied pressures under lab conditions replicating residential foundation loading of 500 psf for slabs and 1000 psf for footings, a 3%. shrinkage occurred. No swelling was evident, although shrinkage was expected at a plastic index of 33. Based on these consolidation results, a mathematical settlement calculation was performed. (See sheets A--B through A-12) . This modeling correlates the Compression Index of the soil (related to its liquid limit) , the clay's void ratio, and the existing versus post - construction loading (due to the home construction) . Testing the clay layer with the footing depth contemplated by_the owner projects a potential settlement of 4 inches. Although not likely to occur immediately, this is more than the tolerable 3 inch or less settlement for residential construction. FOUNDATION RECOMMENDATIONS: The results of the testing reveal the soil to be "borderline" for moderate to heavy foundation loading on continuous concrete footings and columns on simple bearing pads. However, a conventional design can be acceptable if precautions in construction - and homeowner practices - can be taken. Careful attention should be given to the details of reinforcing steel, footing or pad size, and especially drainage, since water affects settlement and strength. See details on sheets A-13 and A- 14, as well as the accompanying foundation design sheets. Most important, the drainage details and ongoing watering irrigation practices should be halted. Recommendations include: 1 . The basement should have the protection of a carefully placed perimeter drainage system. This system should prevent an accumulation of water adjacent to the foundation walls sufficient to cause seepage into or below grade areas. It is critical that the drain piping be channeled to an outfall or sump pit to provide for continuous drainage. Without attention to this detail, a "locally high water table" can develop adjacent to the building walls. At the time of site borings, such a water table existed. 2. Surface drainage near the foundation walls is equally critical. Mechanical compaction next to the walls should meet 90% standard Proctor density. Site grading should drain for at least 10% for the first 10 or 15 feet away from the walls to provide rapid runoff before infiltration next to the walls. 3. Roof downspouts and sillcocks should discharge into long concrete splash blocks or metal gutter extensions 5 feet in length. 4. Irrigation systems should not be installed - nor hand sprinkling of shrubs or grass occur - within 5 feet of the foundation walls. The nearby flooding for irrigation of nearby fields must be diverted further from the home site. SLAB ON GRADE CONSTRUCTION: The natural soils are suitable for the support of garage and basement slabs. Although some slab movement can occur, experience with similar soil conditions has shown that the following details will help prevent wetting of the soils under the slabs and will minimize damage when wetting does occur. 1 . Do not place a gravel layer beneath the concrete slab. The slab should be placed directly on the undisturbed natural soils, or well compacted fill soil. 2. Separate the slab from all load bearing members and utility lines to allow for independent movement of the slab. Provide a positive control or slip joint at the construction joint between the foundation walls or column bearing pads. 3. Provide frequent scoring of the slabs to provide control joints for possible cracking of the slab. Control joints should be placed to provide approximate slab areas of 100 square feet. 4. In the event a hot water heating system is used, the piping should not be placed beneath the concrete floor slab. 5. A foundation drain around the perimeter of the house is required. This drain must be drained into a basement sump unless a "daylight' drain can be incorporated at the site near the house construction. OPEN HOLE INSPECTION: In any soil investigation, it is necessary to assume that the subsurface soil conditions do not vary greatly from the conditions encountered in the field and laboratory testing. Our experience has been that at times more details of the soil conditions may become apparent at the time of excavation for the foundation. For this reason, it is recommended that a qualified engineer inspect the open excavation. These services are offered by this office but are not included as part of this report. The re- port presents a description of geologic conditions, existing mine conditions, and recommendations for the construction of the proposed residence which are influenced by geologic conditions. The report was prepared on the basis of data developed during research and field investigation, as well as our experience with similar conditions. CONCLUSIONS 1. The near surface soil and bedrock consists of clay and clay- stone of the Cretaceous Laramie Formation. There are scattered sandstone and lignite beds the claystone. The lower 80 to 125 feet of the Laramie Formation, which occurs at depths of 275 to 4O0 feet, consists of sandstone, shale and several coal beds. The Fox Hills Formation, which is the primary aquifer in the underlies the Laramie Formation with wells penetrating typically to depths ranging from 400 to 600 feet in the vicinity. 2. Potential geologic hazards in the area include near surface expansive clay and claystone bedrock and a subsidence hazard associated with underground coal mine operations. A subsurface investigation by Alpha Engineering found the expansive materials due not occur within the influence of the proposed residence. 3. We believe a single family residence may be constructed at this site with a low risk of damage. The residence should be constructed with a foundation which will span an unsupported distance of 14 feet. SITE CONDITIONS - The investigated site is an approximate 1 acre parcel which is currently used as agricultural land. The site slopes gently to the east at grades ranging from 2% to 5%. At the time of our investigation the site was vacant of structures. There is no evidence of subsidence from underlying mine working such as potholes or depressions, although due to farming, possible evidence of subsi- dence would be masked. 2 PROPOSED CONSTRUCTION - A single family residence with onsite sewage disposal system (OSDS) is proposed at locations indicated on Figs. 1 and 2. The proposed residence is to be a one story ranch style struc- ture with a full basement. There has been a mobile home at the site so that the OSDS was previously installed. Public water will be pro- vided by the Left Hand Water District. GEOLOGIC SETTING - The investigated 1 acre site is located east of the Front Range of the Rocky Mountains in an area which subject to slow erosion. There is a thin mantle of eolian silt and sand deposits underlain by stiff residual clay soils and claystone bedrock. The claystone bedrock is interlayered with sandstone and lignite of the Cretaceous Laramie Formation underlain by sandstone of the Fox Hills Formation at depths of 400 to 500 feet. Of specific concern at this site is the coal which occurs in the lower 80 to 120 feet of the Laramie Formation. The coal underlying the site has been mined by underground methods which will be discussed later in the report. Literature indicates that approximately 80 feet above the coal seams is a relatively competent sandstone layer which is used as a marker bed in the formation. GEOLOGIC HAZARDS - There are two primary geologic hazards which exist and include: 1. a potential for subsidence due to underground coal mining and 2. expansive soils. A Soils investigation and Foundation Investigation was performed by ALPHA Engineering Co. , their File: 23- INB-09 dated September 3, 1991. No expansive soil was found within the influence of the proposed residence. The potential subsidence hazards will be discussed below and recommendations will be presented later in this report. Our investigation of the coal mining included a review of literature and acquisition of data including: 1. COAL MINE SUBSIDENCE AND LAND USE OVER THE BOULDER-WELD COAL FIELD, BOULDER AND WELD COUNTIES, CO, Colorado Geological Survey, Engineering Geology Publication Number 9 by Amuedo and Ivey, 2. Geologic Map of Boulder, Fort Collins, Greeley Area, USGS Map I- 855-G by Roger B. Colton, and 3. review of 1"=200' aerial photographs with a mining overlay at the Colorado Geological Survey. Our review of literature and maps indicates the Eagle Mine which was operated by the Imperial Coal Company (a subsidiary of Sunflower Energy Company) undermined the western portion of Section 23 . The specific area of the proposed residence was entirely under- mined using the room and pillar mining method. Approximately 10 feet of coal was removed at a depth of 400 feet below the proposed resi- dence, although there are reports of deeper mining. The map indicates that pillars were removed. As indicated on Fig. 1B, the property to the north was not undermined. The records indicate that the mining beneath the proposed residence was done in 1948. Results of the Amuedo and Ivey investigation indicate there are low risk hazards areas within the property. The Amuedo and Ivey report indicates sub- sidence at the Eagle Mine was relatively rapid. The subsidence at the Eagle Mine is anticipated to move upward to an "ironstone" layer of quartzite sandstone 12 to 80 feet above the mine workings. The potential for subsidence at the area of the proposed residence was analyzed by several methods which indicate there is a low subsidence 3 hazard risk at the proposed structure location. The first method assumes a 10% bulking in material which subsides indicates that for an extracted coal layer of 10 feet subsidence will progress only 100 feet above the extracted coal seam. Considering that mining was done at a depth of 400 feet, this method indicates that there should not be surface subsidence at the proposed residence location. A second method is a method established by the British National Coal Board. As discussed in the Amuedo and Ivey report, the National Coal Board analysis does not give irrefutable results because this method is based on the ^Longwall^ method of mining rather than the room and pillar method utilized in the Boulder-Weld coal field. The National Coal Board method indicated a strain of 0.9E in the compression pro- file of the subsidence curve, as presented on Figs. 2 and 3. The strain, when analyzed with respect to the size of proposed structure indicate a slight potential for problems. When considering: 1. the unadjusted maximum extracted coal seam thickness was used in the anal- ysis, and 2. room and pillar mining rather than Longwell mining was utilized, we believe there is only a slight potential for damage to the proposed residence. CONSTRUCTION RECOMMENDATIONS - Our investigation that the proposed single family residence can be constructed with a low risk of damage to the residence. Design and construction recommendation are given below for residence. There are two possible construction methods generally acceptable in areas of potential subsidence which include: 1. a flexible foundation, and 2. a rigid foundation. A rigid foundation system is recommended. The rigid foundation system would be a reinforced footing foundation system as recommended by the Alpha Engineering report, although addi- tional reinforcement may be required. We recommend that the founda- tion be able to span an unsupported distance of 14 feet. A basement with minimum 4 foot concrete walls is proposed. The structure is to be modular structure to be set on the concrete foundation. If the services go through foundation walls, we recommend a minimum of 4 inches of space for movement in all directions where the utility passes through the wall. If utilities go through a floor slab, dif- ferential movement between the utility and the slab must be possible. LIMITATIONS - Our investigation was based on a review of published literature and data available through public and private concerns. The proposed residence is to be a one story ranch style strut- • tune with. a full basement. There has been a mobile home at the site so that the OSDS was previously installed. Public water will be pro- vided by the Left Hand Water District. GEOLOGIC SETTING - The investigated 1 acre site is located east of the Front Range of the Rocky Mountains in an area which subject to slow erosion. There is a thin mantle of eolian silt and sand deposits underlain by stiff residual clay soils and claystone bedrock. The claystone bedrock is interlayered with sandstone and lignite of the Cretaceous Laramie Formation underlain by sandstone of the Fox Hills Formation at depths of 400 to 500 feet. Of specific concern at this site is the coal which occurs in the lower BO to 120 feet of the Laramie Formation. The coal underlying the site has been mined by underground methods which will be discussed later in the report. Literature indicates that approximately BO feet above the coal seams is a relatively competent sandstone layer which is used as a marker bed in the formation. GEOLOGIC HAZARDS - There are two primary geologic hazards which exist and include: 1. a potential for subsidence due to underground coal mining and 2. expansive soils. A Soils investigation and Foundation Investigation was performed by ALPHA Engineering Co. , their File: 23- INB-09 dated September 3, 1991. No expansive soil was found within the influence of the proposed residence. The potential subsidence hazards will be discussed below and recommendations will be presented later in this report. Our investigation of the coal nining included a review of literature and acquisition of data including: 1. COAL MINE SUBSIDENCE AND LAND USE OVER THE BOULDER-WELD COAL FIELD, BOULDER AND WELD COUNTIES, CO, Colorado Geological Survey, Engineering Geology Publication Number 9 by Amuedo and Ivey, 2. Geologic Map of Boulder, Fort Collins, Greeley Area, USGS Map I- 855-G by Roger B. Colton, and 3. review of 1"=200' aerial photographs with a mining overlay at the Colorado Geological Survey. Our review•of literature and maps indicates the Eagle Mine which was operated by the Imperial Coal Company (a subsidiary of Sunflower Energy Company) undermined the western portion of Section 23. The specific area of the proposed residence was entirely under- mined using the room and pillar mining method. Approximately 10 feet of coal was removed at a depth of 400 feet below the proposed resi- dence, although there are reports of deeper mining. The map indicates that pillars were removed. As indicated on Fig. iB, the property to the north was not undermined. The records indicate that the pining beneath the proposed residence was done in 1948. Results of the Amuedo and Ivey investigation indicate there are low risk hazards areas within the property. The Amuedo and Ivey report indicates sub- sidence at the Eagle Mine was relatively rapid. The subsidence at the Eagle Mine is anticipated to move upward to an "ironstone" layer of quartzite sandstone 12 to 80 feet above the mine workings. The potential for subsidence at the area of the proposed residence was analyzed by several methods which indicate there is a low subsidence l 0CT 1 ' 91 15: 04 303 866 2115 PAGE . 003 COLORADO DEPT OF NAT R TEL No .303-866-2115 Oct 1 ,91 15 :04 No .011 P .04 3 hazard risk at the proposed structure location. The first method assumes a 10% bulking in material which subsides indicates that for an extracted coal layer of 10 feet subsidence will progress only 100 feet above the extracted coal seam. Considering that mining was done at a depth of 400 feet, this method indicates that there should not be surface subsidence at the proposed residence location. A second method is a method established by the British National Coal Board. As discussed in the Amuedo and Ivey report, the National Coal Board analysis does not give irrefutable results because this method is based on the "Longwall` method of mining rather than the room and pillar method utilized in the Boulder-Weld coal field. The National Coal Board method indicated a strain of 0.9E in the compression pro- file of the subsidence curve, as presented on Figs. 2 and 3. The strain, when analyzed with respect to the size of proposed structure indicate a slight potential for problems. When considering: 1. the unadjusted maximum extracted coal seam thickness was used in the anal- ysis, and 2. room and pillar mining rather than Longwell mining was utilized, we believe there is only a slight potential for damage to the proposed residence. CONSTRUCTION RECOMMENDATIONS - Our investigation that the proposed single family residence can be constructed with a low risk of damage to the residence. Design and construction recommendation are given below for residence. There are two possible construction methods generally acceptable in areas of potential subsidence which include: I. a flexible foundation, and 2. a rigid foundation. A rigid foundation system is recommended. The rigid foundation system would be a reinforced footing foundation system as recommended by the Alpha Engineering report, although addi- tional reinforcement may be required. We recommend that the founda- tion be able to span an unsupported distance of 14 feet. A basement with minimum 4 foot concrete walls is proposed. The structure is to be modular structure to be set on the concrete foundation. If the services go through foundation walls, we recommend a minimum of 4 inches of space for movement in all directions where the utility passes through the wall. If utilities go through a floor slab, dif- ferential movement between the utility and the slab must be possible. LIMITATIONS - Our investigation was based on a review of published literature and data available through public and private concerns. We concur with the findings and recommendations presented by Mr. Church and if his foundation recommendations are followed, we believe there is very little chance of any appreciable subsidence impact to the proposed structure due to the underground coal mine beneath the site.
