HomeMy WebLinkAbout940239.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING MINOR SUBDIVISION FINAL PLAT (WHITETAIL #1) - IVAR AND DONNA LARSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of February, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Ivar and Donna Larson, 925 North County Road, Route 1, Berthoud, Colorado 80513, for a Minor Subdivision Final Plat (Whitetail #1) on the following described real estate, to-wit: Part of the Eq of Section 14, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, at said hearing on February 23, 1994, the Board deemed it advisable to continue said matter to March 9, 1994, at 10: 00 a.m. , to allow the applicants to post the necessary sign in a timely manner, and WHEREAS, at said hearing on March 9, 1994, John Chilson, Attorney, represented the applicants, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, and, having been fully informed, finds that this matter shall be continued to March 16, 1994, at 10:00 a.m. at the request of the applicants ' attorney. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Ivar and Donna Larson for a Minor Subdivision Final Plat (Whitetail 111) on the hereinabove described parcel of land be, and hereby is, continued to March 16, 1994, at 10:00 a.m. 940239 MINOR SUBDIVISION FINAL PLAT - LARSON (WHITETAIL /!1) PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 9th day of March, A.D. , 1994. Kirkmeyer 940239 HEARING CERTIFICATION DOCKET NO. 94-21 AND NO. 94-23 RE: A MINOR SUBDIVISION FINAL PLAT (WHITETAIL #1 AND WHITETAIL #2) - IVAR AND DONNA LARSON A public hearing was conducted on March 9, 1994, at 10: 00 A.M. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer - EXCUSED Also present: Acting Clerk to the Board, Shelly Miller County Attorney, Bruce Barker Planning Department representative, Monica Mika The following business was transacted: I hereby certify that pursuant to notices dated February 7, 1.994, and duly published February 10, 1994, in the Windsor Beacon, a public hearing was conducted on February 23, 1994, to consider the request of Ivar and Donna Larson for two Minor Subdivision Final Plats (Whitetail #1 and Whitetail #2) . At said hearing on February 23, 1993, the matters were continued to March 9, 1994, at which time Bruce Barker, County Attorney, made these a matter of record. Amended notices for said hearings on March 9, 1994, were mailed to surrounding property owners. John Chilson, Attorney, represented the applicants and indicated he had to leave to be in Larimer County Court. He stated he had no objection to allowing public testimony during his absence; however, he requested the Board continue the remainder of the hearing to a date when he could be present. He explained he thought this matter would be considered prior to Amended RE #1373 and apologized for the inconvenience; however, he must be present to present legal issues concerning the minor subdivisions. After various comments and discussion, Commissioner Hall moved, based on the applicants' request, to allow public testimony now and again on March 16, 1994, which is the date these matters are continued to for the applicants ' presentation. The motion was seconded by Commissioner Harbert, and it carried unanimously. Monica Mika, Planning Department representative, presented the Board with additional correspondence received since the Planning Commission' s hearing and a petition opposing the proposed development, which was received today. Ms. Mika entered the unfavorable recommendation of the Planning Commission into the record and stated staff also recommended denial. Ms. Mika answered various questions from the Board, and Mr. Barker reminded the Board that the applicant' s testimony would be heard on March 16, 1994. David Ostermiller, surrounding property owner, submitted several photographs of the area for the record, Exhibits I through P, and stated various concerns about the proposed development and answered questions from the Board. Gene Ostermiller, Evelyn Ostermiller, and Mike Soleta, surrounding property owners, also stated concerns and answered questions from the Board. Ms. Mika indicated Mark Zahn, Gerrity Oil and Gas, also had concerns, but had to leave; therefore, she will notify him of the March 16 continuance date. Chairman Webster indicated these matters were now recessed until March 16, 1994, at 10:00 a.m. Mr. Barker clarified for the record both Whitetail 111 and #2 would be heard on March 16, 1994, at 10:00 a.m. 940239 940240 L' 7J!
