RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION NO. 1364 - PINEDA AND SONS FARMS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1364, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1364 was submitted by
Pineda and Sons Farms, Inc, c/o Manuel Pineda for property which is located in
part of the SW4 of Section 22, Township 7 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described in the plat which shall
be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 10 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
following:
1. A Weld County Septic permit is required for the proposed
home and its septic system shall be installed according
to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. An ISDS evaluation by the Weld County Health Department on all
existing septic systems will be necessary prior to issuing the
required septic permits on the existing systems.
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be drawn in accordance with the
requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

Dear Commissioners:
This request for a recorded exemption is submitted by Pineda and Sons Farms,
Incorporated c/o Manuel Pineda. The parcel of land is described as Lot A of
Recorded Exemption #869 located in the SW4 of Section 22, T7N, R67W of the 6th
P.M. , Weld County, Colorado. The property is located east of Weld County Road
19 and north of Weld County Road 78. This is the total contiguous land holdings
of the applicant.
The applicant proposes to use North Weld County Water District as a water source.
Individual septic systems will provide sewage disposal.
The Department of Planning Services' staff has concerns about the potential for
continued divisions in this section. Further divisions of this parcel will evade
the purpose of the Weld County Subdivision Regulations. The applicant split off
the subject parcel from a 160 acre tract in May of 1986. This is the second
recorded exemption that the applicant has applied for on this parcel. If this
application is approved, there will be three parcels where, prior to May of 1986
there was one.
The staff has concerns about the level of development in Section 22. There are
currently 14 parcels in this section. The subject parcel accesses on to Weld
County Road 19 which is a gravel road. Residential development in rural areas
necessitates an increased demand for road maintenance, police and fire
protection, school busing, snow removal, utilities and other urban level
services.
The staff requests the Board of County Commissioners consider the application and
determine if the standards of Section 9-2 E. (1) (a) through (m) of the Weld
County Subdivision Regulations have been met.

Ladies and Gentlemen;
We , Pineda & Sons Inc . are submitting an application for a Recorded
Exemption on approximately 15 acres , a tract of land in the Southern
portion of the SW%Z Sec . 22 , Twnshp 7 NR 67 in Weld County Colorado .
This letter and the attached letters , documents , and maps will address
all of the application requirements that are requested for the Recorded
Exemption.
The 15 acres is mainly used up in farm buildings , farm yard, cattle pens ,
and about 7 acres of dryland pasture . We are intending to sell off approx.
5 acres of the dryland grass acreage . There are no buildings on the 5 acre
tract . It can be serviced with domestic water by the North Weld County
Water District . (See attached letter . ) NOTE: The City of Thornton purchased
the other 145 acres of land in this quarter along with all the irrigation
water rights in 1985 .
I , Manuel Pineda., my wife Eva, and my son Joaquin, will live in the residence
on the 10 acre tract . In addition to the brick home there is a detached
2 car garage , a 30 x 60 wood frame equipment building, 2 granarys , an old
horse barn. , and 2 other small buildings . Also , included in this 10 acre
tract is a small 2 bedroom rental house with a 1 car garage to the north.
Both homes are served by the North Weld County Water District , and both homes
have operating septic systems . The address here is 38280 Weld County Road 19
Fort Collins , Colorado 80524 .
The 10 acre tract is proposed to be Lot A . The 5 acre dryland tract is
proposed to be Lot B .
The creation of the above described lots will not have any adverse effect
on any of the existing farming operations

The Recorded Exemption request for this tract is compatible with the ongoing
development in the immediate neighborhood, and is consistent with the Weld
County Comprehensive Plan . The area is agriculturally zoned and the uses
proposed will be permitted by the Agricultural Zone . The tract lies 5 miles
north of Windsor on Hiway 257 , 1 mile east on Road 78 , and 4 mile north on
Road 19 , or from the town of Severance , Colorado , 1 mile west on Road 74 ,
2 miles north on Road 21 , 1 mile west on Road 78 , and 4 mile north on Road 19 .
This proposal does not affect the existing infrastructure and would not have
any major impact on future development of the area .
The tract is not in a geologic hazard area , and is not located in the Weld
County Airport Overlay District . It is not in a flood plain as shown on the
Flood Insurance Rate Map , Community Panel Number 080266-0475-C , effective
date September 28 , 1982 , and prepared by the Federal Emergency Management
Agency.
