HomeMy WebLinkAbout830644.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT NO. 748 - GEORGE SPILMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado on the 27th day of July, 1983, considered the request of George Spilman to place a second mobile home to be used as an accessory to a farm and to be occupied in an A-Agricultural Zone District, on a parcel of land more particularly described as follows : Part of the SE4, Section 2, T1N, R66W of the 6th P .M. , Weld County, Colorado. WHEREAS , the Board of County Commissioners, having heard the testimony, finds that said request should be granted sub- ject to the following conditions: 1) the applicant shall obtain a separate septic system permit for this mobile home from the Health Department; and 2) the applicant shall apply for and receive a building permit for the mobile home within thirty (30) days from the date of approval by the Board of County Commissioners. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the request of George Spilman to place a second mobile home to be used as an accessory to a farm on the above described parcel of land, which was found to be in compliance with the Weld County Zoning Ordinance, Section 43, be, and hereby is, granted subject to the conditions as above listed. Lupton; south of Highway 52 and west of Weld County Road 35 The Department of Planning Services staff has reviewed this request and recommends that the request be denied for the following reasons: The Department of Planning Services staff is concerned that the conditions required for a second mobile home on a farm are not being met in this particular situation. As stipulated and acknowledged in the Certification of Compliance, mobile homes as an accessory use on a farm are to be occupied by persons principally employed full-time by said farm. Staff is curious as to how 19 acres and twenty-three (23) livestock can require the services of an additional laborer. A mobile home violation was recently resolved on this parcel. Mobile home #3 was cited as a violation (VI-327:83:6) on May 9, 1983 and was finally removed by the July 22, 1983 field inspection. To date, there are three dwellings on the 19 acre parcel, five sheds, a horse training arena and one water well.
