HomeMy WebLinkAbout941430.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 31, 1994 TAPE #94-07 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the law and bylaws of said Board at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, January 31, 1994, at the hour of 9:00 A.M. ROLL CALL: The meeting was called to order by the Chairman and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Weld County Attorney, Bruce T. Barker Acting Clerk to the Board, Shelly Miller Finance and Administration Director, Don Warden MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of January 26, 1994, as printed. Commissioner Hall seconded the motion, and it carried unanimously. ADDITIONS: There were no additions to today's agenda. CONSENT AGENDA: Commissioner Baxter moved to approve the consent agenda as printed. Commissioner Harbert seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: No reports were given today. PUBLIC INPUT: There was no public input. WARRANTS: Don Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: General Fund $ 348,869.43 Handwritten Warrants: General Fund $ 10,250.04 Payroll Fund $1,367, 052.23 Commissioner Kirkmeyer moved to approve the warrants as presented by Mr. Warden. Commissioner Baxter seconded the motion, which carried unanimously. BIDS: PRESENT 1994 AERIAL MAPPING - ASSESSOR'S OFFICE: Mr. Warden read the names of the vendors that submitted bids into the record and indicated said bid would be considered for approval on February 14, 1994. 941430 BUSINESS: OLD: RECONSIDER SALE OF TAX SALE CERTIFICATE TO QUALITY DOOR, INC.. (ISSUE IN NAME OF DUANE AND DEBBIE BERTSCH) [01/26/94] : Bruce Barker, County Attorney, explained Tax Sale Certificate #87-01742/88 was approved for sale to Quality Door, Inc. , on January 26, 1994, by the Board. However, Mr. Barker received a call from Duane and Debbie Bertsch, sole stockholders of Quality Door, Inc. , who had been advised by their tax advisor that the certificate should be in their names rather than in the name of their company. Mr. Barker recommended approval of the certificate in the individuals' names as requested and indicated he would notify the necessary State Department of the change. Commissioner Harbert moved to approve the sale of said Tax Sale Certificate to Duane and Debbie Bertsch, and Commissioner Baxter seconded the motion which carried unanimously. NEW: CONSIDER 1994 DANCE LICENSE FOR RICE ENTERPRISES, INC. , DBA FORT 21: Mr. Barker explained this establishment holds a liquor license issued by the Board and is now requesting a dance license for 1994. Commissioner Hall moved to approve said dance license, and Commissioner Kirkmeyer seconded the motion which carried unanimously. CONSIDER 1994 DANCE LICENSE FOR RAFFERTY' S, INC. , DBA RAFFERTY'S: Commissioner Hall moved to approve said dance license, and Commissioner Kirkmeyer seconded the motion which carried unanimously. CONSIDER APPOINTING COMMISSIONER TO ATTEND ANNUAL MEETING OF RURAL DITCH COMPANY AND AUTHORIZE CHAIRMAN TO SIGN PROXY: Commissioner Kirkmeyer moved to appoint Commissioner Harbert to attend said annual meeting on February 14, 1994, at 2:00 p.m. , and to authorize the Chairman to sign said proxy. The motion, seconded by Commissioner Baxter, carried unanimously. PLANNING: CONSIDER VACATION OF RE #1017 - TROSTEL: Greg Thompson, Planning Department representative, indicated Recorded Exemption #1017 must be vacated to comply with Condition of Approval #1 of Recorded Exemption #1566 and Condition of Approval #4.a. of Special Review Permit #1036, which were both granted to Thomas and Beverly Trostel on January 12, 1994. He stated the applicants' representative, Steve Stencel of Intermill Land Surveying, has written a letter requesting the vacation and staff recommends approval. Commissioner Kirkmeyer moved to approve the vacation of Recorded Exemption #1017 for Thomas G. and Beverly Trostel. Commissioner Baxter seconded the motion, and it carried unanimously. CONSIDER RE #1577 - RICHARDSON: Mr. Thompson read staff's favorable recommendation into the record and indicated the request would divide a 155-acre parcel into parcels of 10 and 145 acres. He said four Conditions of Approval are recommended. Howard Richardson, applicant, was present and stated there are improvements on the proposed 10-acre parcel which are no longer used. He said the improvements have been rented out, which has caused problems, and they want to sell the 10-acre parcel since it is not used as part of the farm. In response to questions from the Board, Mr. Richardson indicated there is a house and a barn on the 10-acre parcel; the 145-acre parcel was planted in potatoes last year, with a pivot sprinkler; and he does not live on the property. Mr. Richardson said the Conditions of Approval are acceptable. No public testimony was offered. Commissioner Harbert moved to approve Recorded Exemption #1577 for Howard V. Richardson, with the four recommended Conditions of Approval. Commissioner Hall seconded the motion which carried unanimously. Minutes - January 31, 1994 Page 2 RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the, consent agenda. There were no Ordinances. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
