HomeMy WebLinkAbout900576.tiff RESOLUTION RE: DENIAL OF RECORDED EXEMPTION NO. 1281 - PETE GALLEGOS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners , pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, at a public meeting held in the Chambers of the Board, considered the request of Pete Gallegos for Recorded Exemption No. 1281 , and WHEREAS, the request for Recorded Exemption No. 1281 was to divide property which is located in part of the NW* of Section 10 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado, into parcels estimated to be approximately 15 acres and 5 acres , and WHEREAS, after reviewing the recommendation of the Planning staff and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons : 1 . The applicant has failed to explain how this application is consistent with the Weld County Comprehensive Plan and how the land split is consistent with efficient and orderly development. This Recorded Exemption would create the 10th parcel in this quarter-section. Parcel splits in this area are reaching a level where further divisions would evade the purpose of the Weld County Subdivision Regulations as defined in Section 1-3 . Residential development in rural areas necessitates an increased demand for road maintenance, police and fire portection, school busing, snow removal , utilities , and other urban services. As density increases, so do service demands. 2. The applicant has failed to explain how the intent of this application is consistent with the guidelines outlined in Agricultural Policy #7 of the Weld County Comprehensive Plan which allow an agricultural lot to be divided into two separate lots. Enable the property owner to provide a residence for direct members of the farm family and also for workers employed at the £arm. 3 . The intent of the Recorded Exemption process is not to provide rural residential homesites for uses that are unrealted to farm activity, neither is the process to be used to meet a water tap commitment before it expires. The application is not consistent with the established policies and approval criteria in the County' s land-use regulations . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Pete Gallegos for Recorded Exemption No. 1281 be, and hereby is, denied. The parcel of land on which this request is being made is described as part of the NW} of Section 10, T3N, R68W of the 6th P.M. , Weld County, Colorado. The property is located south and adjacent to Weld County Road 36 between Weld County Road 7 and I-25. The request is to divide a 20 acre parcel into 2 parcels of 15 acres and, 5 acres, more or less. This is not the total contiguous land holdings of the applicant. The Department of Planning Services' staff recommends this application be denied. Development in this quarter-section has reached a level where continued divisions should be discouraged. In its letter of June 5, the Town of Mead recommended denial of this request and expressed concerns about the potential impacts on roads in and around Mead, which are used by the residents of this quarter-section to access major highway systems such as Colorado Highway 66 and Interstate 25. The applicant has failed to explain how this application is consistent with the Weld County Comprehensive Plan and how the land split is consistent with efficient and orderly development. This Recorded Exemption, if approved, would create the 10th parcel in this quarter-section. This recorded exemption is requested to enable the fee owners to sell a portion of their land to provide a rural residential homesite for their purchaser . 5. The proposed exemption will in no way adversely affect the Weld County Comprehensive Plan , which is intended to preserve the agricultural nature of the county . The entire parcel has never had a home site, and the smaller0 acre parcel being divided from the larger will continue to preserve the agricultural flavor of the county , and more particularly , the area . 6. Present zoning of the parcel is agricultural . The split-off parcel will continue to function within the parameters set forth for this type of zoning . 7 . As explained in the above paragraphs, the intended use will be compatible with existing zoning . A home will be erected , with the existing hay and pasture for grazing . 8. The parcels will be very compatible with the surrounding area . The property in located approximately 1 1/2 miles Northeast of Mead , with frontage on Weld County Road 36 . The smaller parcel will be used as rural home site similar , to several existing properties in the immediate area. The properties along WCR-36 immediately to the West to WCR-7 consist of several 5 and 10 acre parcels with pasture land and other crops. 9. As stated in #8 above, this recorded exemption will simply add one more compatible property to the several already in the area . A like property is contiguous. It would seem this parcel will blend in an organized and proper fashion . Due to the desirability and market value of the land , it is very unlikely that it would sell for the purpose of a strict- ly agricultural use, as sufficient income cannot be derived from the land to warrant such an investment . It would seem that this recorded exemption would facilitate the controlled growth of the area , while staying in keeping with the exist- ing properties. 10. Domestic water will be brought into the smaller parcel by way of a Little Thompson water tap. A septic system will be installed per the guidelines and inspections of the Weld County Environmental Health Dept . Box o 8 Mead, Colorado 80542 (303) 535-4477 W June 5 , 1990 Department of Planning Services Weld County 915 10th Street Greely, CO 80631 RE: Application for Recorded Exemption Case # RE-1281 TO WHOM IT MAY CONCERN: While the Town of Mead has no specific objection to this type of development , we do have some overall concerns that need to be addressed before the County allows further development to the North of our Town. With the advent of the expansion of Little Thompsons water line, this area will be prime for development requests , and it seems that all objections , brought forth by the County Commissioners in the Towns past annexation proceedings , are being allowed in these types of requests . The Town also has some strong objections to further use of it 's roadways by County residents , to access the major highway systems around Mead. As you are aware, we have sent a proposal to the Commissioners addressing the problems with WCR 7 and possibly WCR 34 , but have received no reply as of this date in regards to the Intergovernmental Agreement . We feel that the continued development of plats North of our community, will become an ever increasing burden to our taxpayers and must ask that we be considered in a joint planning effort with the county in addressing these concerns . If the Town and County cannot come to an agreement over the aforementioned, I must strongly protest any further requests as this and recommend disapproval to our Board and the Board of County Commissioners .
