RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1043 FOR STORAGE AND MAINTENANCE OF DELIVERY TRUCKS FOR AN AIR FREIGHT BUSINESS WITH LIMITED STORAGE, TRANSFER, LOADING, OR UNLOADING OF FREIGHT ON SITE - GREGORY B. AND KRISTIE KAY BEMENT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 1st day of June, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Gregory B. and Kristie Kay Bement, 8402 Weld County Road 62, Windsor, Colorado 80550, for a Site Specific Development Plan and Special Review Permit #1043 for storage and maintenance of delivery trucks for an air freight business with limited storage, transfer, loading, or unloading of freight on site on the following described real estate, to-wit: Part of the E; NW,' of Section 4, Township 5 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, Greg Bement, said applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: PL0957 940508 pLo957 c7e : Pe /EA/r SPECIAL REVIEW PERMIT #1043 - BEMENT PAGE 2 a. The proposal is consistent with the Agricultural Goals and Policies and the Urban Growth Boundary Areas Goals and Policies of the Weld County Comprehensive Plan. The proposed Special Use Permit area is not located on productive farm ground and is within the Urban Growth Boundary Area of the Town of Windsor and the City of Greeley. The Town of Windsor reviewed this request and indicated no objections. b. The proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The proposed use will be compatible with the existing surrounding land uses which include rural residences, dryland pasture, and agricultural production. This proposed use will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. Conditions of Approval and Development Standards will ensure compatibility. d. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection for the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Gregory B. and Kristie Kay Bement for a Site Specific Development Plan and Special Review Permit #1043 for storage and maintenance of delivery trucks for an air freight business with limited storage, transfer, loading, or unloading of freight on site on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Site Specific Development Plan and Special Review Permit is for storage and maintenance of delivery trucks for an air freight business with limited storage, transfer, loading, or unloading of freight on site in the A (Agricultural) Zone District as submitted in the application materials on file and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. Fugitive dust shall be controlled on this site. 7. The maximum permissible noise level shall not exceed the residential limit of 55 db(a) as measured according to 25-12-102, Colorado Revised Statutes. 8. Trees and bushes adjacent to the east and west of the entrance of this property shall be trimmed along Weld County Road 62 on a regular basis to ensure site distance for ingress and egress to the facility. 9. The Use by Special Review Permit shall not be transferable to any successors in interest to the described property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 10. No outside storage of materials or equipment associated with this operation shall be allowed on site. No more than one truck may be stored outside the building during daylight hours. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 940508 DEVELOPMENT STANDARDS - BEMENT PAGE 2 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 14. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. AND KRISTIE KAY BEMENT A public hearing was conducted on June 1, 1994, at 10:00 a.m. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated May 11, 1994, and duly published May 19, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Gregory B. and Kristie Kay Bement for a Site Specific Development Plan and Special Review Permit for storage and maintenance of delivery trucks for an air freight business with limited storage, transfer, loading, or unloading of freight on site. Lee Morrison, Assistant County Attorney, made this a matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. In response to a question from Commissioner Kirkmeyer, Mr. Schuett stated Condition of Approval #3 and Development Standard #9 concern a culvert and indicated Greg Bement, applicant, would probably request removal of said Condition and Development Standard. Mr. Bement was present and stated he is a contractor for Airborne Express for the northern region. He explained a maximum of four or five delivery trucks and some freight would be stored on the site, and some transferring would take place on the site; however, no business would be conducted at the site, and there should not be much additional traffic. Mr. Bement said he has cleaned out the west end of the culvert which runs under the driveway on Weld County Road 62; however, he could not find the east end of the culvert. He indicated there is no runoff or water in the ditch. Mr. Bement stated restrooms will not be necessary because there will be only four or five employees on the site on Saturday mornings for approximately one hour and no customers will be at the site. In response to questions from the Board, Mr. Bement stated a maximum of twelve trucks per day would arrive and depart from the site. Mr. Schuett indicated the Engineering Department had reviewed this matter and the traffic counts and had no concerns. Mr. Bement stated most of the vehicles would be half or three-quarter ton vans, with one larger truck going in and out two to four times per day. He stated larger trucks already travel that road. In response to a question from Commissioner Hall, Mr. Schuett referenced a memo dated May 12, 1994, from Donald Carroll, Public Works Department, confirming the culvert could be removed. Mr. Bement reiterated there is no drainage problem, and the culvert could remain or be removed. No public testimony was offered concerning this matter. Mr. Schuett suggested Condition of Approval #3 and Development Standard #9 be removed and Development Standard #17 replace Development Standard #9. Judy Yamaguchi asked if Mr. Bement had any concerns about the staff comments. Mr. Bement stated that he talked to the Health Department about putting bathrooms in but they felt it was unnecessary. He also had concerns over Development Standard #9 that limited outdoor storage. He stated that one medium duty truck mus.t stay outside. The building is not large enough to store both medium duty trucks. The Chairperson asked if anyone in the audience would like to speak for or against the application. Laurie Staley, surrounding property owner, stated that her main concern is growth. She does not mind what is being proposed but does not want this to grow. Freight is not stored, transferred, loaded or unloaded on site in large quantities. The vast majority of that kind of thing is done elsewhere. One exception is Saturday morning when four or five drivers are on site for about 1 1/2 hours to sort through a truckload, separate the Saturday deliveries, and start their delivery routes. 2 - Need for use -- The two-fold need for use is primarily economic. The profit margin of the business does not provide the owner with sufficient resources to maintain both a place of business and a residence at separate locations. If both cannot be maintained on the same property, the business will be forced to close. This would result in 1) the loss of jobs for 17 people -- 5 in Weld County, and 2) the disruption in air freight pick-up and delivery service for approximately 75 companies in Weld County as well as hundreds in the Fort Collins, Loveland, Cheyenne, and Laramie areas. 3 - Uses on surrounding properties -- primarily agriculture. The property across CR 62 to the north is farmed -- sugar beets in the summer of 93 . There is no residence there. The property to the west has a residence and the acreage appears to be used to graze horses for personal use. The property to the east has a residence and the owners have hogs, chickens, horses, etc. 4 - There are no structures to the north. There is a residence with out-buildings located approximately 30O yards SW, and another residence and out-buildings about 300 yards to the east. 5 - There are no users, patrons, members, or buyers. This is not a place where business is transacted. Customers are not even aware of its existence. The main purpose is storage, and maintenance of trucks as explained in item #1. 6 - There are 17 people employed by the business. None of them work on site regularly. Very few work on site at all . The maximum number of employees on site at one time is 5. This occurs once a week on Saturday mornings for 940508 page 2 about 1 1/2 to two hours . There are no scheduled shifts on site. There are no specific hours of operation on site. The first truck generally leaves the yard at about 0400 Monday thru Friday, and sometimes on Saturday. The last truck returns at about 2130 Monday thru Friday, and 1600 on Saturday. 7 - A water source is not needed for the operation. Future plans include a restroom in the shop for convenience. If the proper permits can be acquired, the water source will be an underground cistern. If the proper permits cannot be acquired, the restroom will have to wait for the availability of public water. The water source for the residence is an underground cistern, which is properly permitted. 8 - Access to the property is from CR 62 about . 4 miles east of CR 17. 9 - The business operates sixteen 1/2 and 3/4 ton vans and two medium duty straight trucks. When not in use the vehicles are kept at the drivers residences. The vans weigh about 2 1/2 tons empty, and have GVWs of about 3 1/2 tons. The two straight trucks have empty weights of 9,500 and 17 , 000 lbs. and GVWs of 15,500 and 55 ,000 lbs. As mentioned above, the first truck leaves the yard at about 0400 Monday thru Friday and some Saturdays. The last truck returns at about 2130 Monday thru Friday and 1800 Saturday. Between 0700 and 1900 individual trucks arrive and depart at most a dozen times per day Monday thru Friday, and less on Saturday. Operations on Sunday are almost nonexistent. Other arrivals and departures associated with the residence occur. The number of business vehicles on site at one time (when not in use) is generally four or five -- two straight trucks and two or three vans. The exception to this is Saturday morning when an additional four or five vehicles are on site for about one 1/2 to two hours. Other vehicles stored on site are a personal car, a recreational boat, an eighteen foot flatbed trailer, and a water truck. There is a 40' X 60' shop on the site in which most of the vehicles are parked while there. 10 - No sewage is required for the operation. If, as mentioned in item #7 above, a restroom is installed in the shop for convenience, application will be made for the proper permits for a septic tank. The residence uses a septic tank which is properly permitted. 940508 page 3 11 - The shop is a steel building, which minimizes the fire hazard. Fire extinguishers are conveniently located inside. The closest fire station is in Windsor about three and 1/2 miles away. 12 - No animals are involved. 13 - Waste is stored in a dumpster outside the SW corner of the shop on a concrete pad. The waste is primarily paper products, small amounts of construction debris, and normal household waste. No hazardous waste other than automotive lubricants are generated. Waste automotive lubricants are stored short term inside the shop in five and fifteen gallon containers. Long term storage of the waste automotive lubricant is outside in a 500 gallon storage container. The container is located in a containment pit with a capacity exceeding 1000 gallons. The pit is lined with three layers of 8 mil plastic which is covered with clay. The tank is pumped out as needed about every two years. 14 - There is no storm water retention needed on site. The site is located at the top of a hill . There is no significant run off. 15 - A trash truck comes once a week to empty the outside dumpster. When 50 to 60 gallons of automotive lubricants are accumulated in the cans in the shop they are emptied into the outside tank. 16 - Three rows of seedling bushes and trees (chokecherry, cedar, and ash) have been planted along the entire west edge of the property. Two rows of full grown Russian olives and cedars already exist along the north edge of the property. The purposes of the landscaping are privacy and wind erosion prevention. 17 - Reclamation procedures would be unnecessary for two reasons. 1) The proposed use is perpetual , and 2) If the business were closed no reclamation would be needed. Other than the shop, the residence, and the landscaping there is no impact on the property. Future owners would probably want to keep the residence and shop intact. 18 - There is no timetable for construction and start up. Although not completely finished, the shop already exists. The business has operated since Dec 1985. Operations on 940508 page 4 this site started in Sep 1992 . The operator of the business was unaware of the need for a special use permit. III -- WRITTEN STATEMENTS AND SUPPORTING DOCUMENTS 1 - Having read the Weld County Comprehensive Plan, paying special attention to the Agriculture, Farmland, and Environmental information, it is the opinion of the applicant that the proposed operation is consistent with the Plan, and will have no significant effect on agriculture or the ecology for the following reasons. -- There is no loss of productive farmland. The property is small - 2 . 3 acres. It does not appear to ever have been used as farmland, and probably never would have been because of topography, poor soil , and lack of water. A possible agricultural use might have been grazing, but it does not seem to be particularly well suited for that. -- The property is located within the Weld County Urban Growth Boundary. -- There is no significant impact to traffic on the adjacent county road -- a dozen or fewer arrivals or departures per day associated with the business. -- There will be no contamination of the soil, air, or ground water. There is no ground water. With one exception, the neighbors use underground cisterns for residential water sources. -- No wildlife is displaced. Not even prairie dogs were displaced for the construction of the house and shop. -- The business employs Weld County residents, provides services to Weld County businesses and individuals, and purchases goods and services from Weld County suppliers. 2 - Having read Section 30 (Zone Districts) of the Weld County Zoning Ordinance, and considering in particular items 31 . 4 . 12 , 15, 16, and 20, it is the opinion of the applicant that the proposed use is consistent with the intent of the district. 3 - The proposed use has no affect on surrounding agricultural land. 940505 page 5 4 - The operation does not effect the health, welfare, or safety of the inhabitants of the neighborhood or the county. 5 - The operation has no affect on existing surrounding land uses. 6 - The proposed use is compatible with future development of the surrounding area for the reasons listed in items 1 and 2 of this section. 7 - The property is not located in the Airport, Geologic Hazard, Flood Hazard, or Planned Unit Development Overlay Districts. 8 - No water supply is currently needed. As mentioned in the above section, if a restroom is installed in the shop, a permit will be secured for an underground cistern. 9 - Warranty Deed is attached. 10 - Noise report has been waived by Greg Thompson at the Department of Planning Services. The only noise generated by the operation is from automotive engines and an air compressor. 11 - When contacted for the preparation of this application, the Soils Conservation Service reported no moderate or severe limitations for the proposed use. She was at first reluctant to help because of the complicated nature of the task, but then agreed. He indicated that the only time that employees are on the site for any extended time is on Saturdays for a maximum of two hours. Four employees are engaged in sorting operations during this time. The employees have been using restroom facilities in the existing residence. The existing septic system (Permit G92160) is adequate for this incidental usage and meets the 200-foot proximity requirement for adequate septic facilities. The applicant has also indicated that this Saturday acitivity is temporary and is not expected to last more than one year. In addition, at the time of Our initial review of the referral, I was not aware that the existing septic system was permitted under the previous owner's name, VonTersh. Based on this recent information, I am requesting that you remove the following conditions stated in my memo, dated April 6, 1994; 6. Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require an I,S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. 8. An individual sewage disposal system, is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Access to the subject property is near the crest of a hill and curve. The additional traffic needed will increase the exposure for potential accidents . 3 ) The current use and business appears to be relative small , however, I have a concern about the County continously approving progressive expansion of the business , in the event the use of the subject property is approved.
