RE: APPROVE CERTIFICATE OF DESIGNATION - WASTE SERVICES
CORPORATION
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 27th day of June, 1990, a public hearing was
held in the Chambers of the Board of County Commissioners of Weld
County, Colorado, for the purpose of considering whether to grant
a Certificate of Designation to Waste Services Corporation, 6037
77th Avenue, Greeley, Colorado 80634, said site to be located on
the following described property:
SWi of Section 7, Township 7 North, Range 66
West of the 6th P.M. , Weld County, Colorado
WHEREAS, said applicant was represented by Brad Keirnes,
president of Waste Services Corporation, and John Houtchens,
Attorney, and
WHEREAS, this request for a Certificate of Designation was
submitted in conjunction with a request for a Site Specific
Development Plan and Special Review Permit for a solid waste
disposal site and facility located in the A (Agricultural) Zone
District which was approved by the Board, and
WHEREAS, Section 30-20-104, CRS, as amended, requires the
Board to take into account certain factors to approve a Certificate
of Designation and, having taken into account said factors, finds
as follows :
1 . The Conditions of Approval and Development Standards
included in USR-895 will minimize the impacts on the
surrounding property and the area to the greatest extent
possible. The Conditions of Approval and Development
Standards will also provide adequate protection of the
health, safety, and welfare of the inhabitants of the
area and the County.

2. The location of the solid waste disposal site will be
convenient and accessible to potential users. Access to
the site is proposed from State Highway 14 to Weld
County Road 25 . The representatives of the Colorado
Division of Highways have reviewed the application and
recommended approval subject to constructing a
right-turn deceleration lane , increasing right-of-way
width, and protecting the highway drainage system. The
County Engineer has reviewed the application and
recommended approval subject to a Road Improvement and
Maintenance Agreement for Weld County Road 25 . The
applicant has agreed to meet these requirements.
3. The applicant has demonstrated in the submitted
application materials an ability to comply with the
health standards and operating procedures of the Solid
Waste Disposal Site and Facilities Act, Title 30-20,
Part 1 , C.R.S.
4 . The Colorado Department of Health and Weld County Health
Department have reviewed this request and have
recommended conditional approval of the proposed solia
waste disposal site and facility.
5 . The submitted application materials are in compliance
with the goals and policies of the Weld County
Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Certificate of
Designation for Waste Services Corporation, c/o Brad Keirnes, 6037
77th Avenue, Greeley, Colorado 80634 , on the hereinabove described
real property be, and hereby is, granted subject to the following
conditions:
1 . The property shall be maintained in compliance with
USR-895, all submitted application materials on file
with the Department of Planning Services, and all
requirements of the Weld County Health Department and
the Colorado Department of Health.

In accordance with the provisions of Sections 30-20-101 through
30-20-115, CRS, as amended, the Board of County Commissioners of
Weld County, Colorado, hereby grants a Certificate of Designation
for a solid waste disposal site and facility:

This Certificate of Designation may be temporarily suspended or
revoked, after reasonable notice and public hearing, for cause as
outlined in Section 30-20-112 , CRS, as amended.
