HomeMy WebLinkAbout900244.tiff RESOLUTION RE: APPROVE CERTIFICATE OF DESIGNATION - LIQUID WASTE MANAGEMENT, INC. , AND MARIE LOUISE GOLLNER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 14th day of March, 1990 , a public hearing was held in the Chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of considering whether to grant a Certificate of Designation to Liquid Waste Management, Inc. , and Marie Louis Gollner, 900 Coffman Street, Suite D, Longmont, Colorado 80501, said site to be located on the following described property: Part of the N} and N§ SE$ of Section 27 , Township 4 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS , said applicants were represented by Roger Bohannan, of Liquid Waste Management, Inc. , and WHEREAS, this request for a Certificate of Designation was submitted in conjunction with a request for a Site Specific Development Plan and a Special Review Permit for land application of commercial sludge which was approved by the Board, and WHEREAS, Section 32-20-104, CRS, as amended, requires the Board to take into account certain factors to approve a Certificate of Designation and, having taken into account said factors, finds as follows: 1 . The Conditions for Approval and stated Standards of USR-904 will minimize the impacts on the surrounding property and the area to the greatest extent possible. The Conditions for Approval and stated Standards will also provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the County. 2 . The location for the commercial sludge application will be convenient and accessible to the potential users. 3 . The applicants have demonstrated in the application materials that there is a need for the commercial sludge disposal site. The applicants have demonstrated through the application materials that they have the ability to comply with the health standards and operating procedures of the Solid Waste Disposal Sites and Facilities Act, Title 30-20, Part 1 , C.R.S. , 1973. 5 . The Colorado Department of Health and the Weld County Health Department have reviewed this request and find, subject to conditions, that the proposal will comply with the standards of the Solid Waste Disposal Sites and Facilities Act, Title 30-20-100, et seq. , C.R.S. 1973, as amended, and with the regulations promulgated thereunder, 6 CCR 1007-2, known as the Regulations Pertaining to Solid Waste Disposal Sites and Facilities. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Certificate of Designation for Liquid Waste Management, Inc. , and Marie Louise Gollner, 900 Coffman Street, Suite D, Longmont, Colorado 80501 , on the hereinabove described real property be, and hereby is, granted subject to the following condition: 1 . The property shall be maintained in compliance with USR-904 , all submitted application materials on file with the Department of Planning Services, and all requirements of the Weld County Health Department and the Colorado Department of Health. Be it Resolved by the Weld County Planning Commission that the application for: NAME: Liquid Waste Management and Marie Louise Gollner ADDRESS: 900 Coffman Street, Suite D, Longmont, CO 80501 REQUEST: Certificate of Designation LEGAL DESCRIPTION: Part of the NI and the NW SEW of Section 27, T4N, R67W of the 6th P.M. , Weld County, Colorado LOCATION: South of and adjacent to the Town of Milliken, south of and adjacent to Weld County Road 42 and east of and adjacent to Weld County Road 19 be recommended favorably to the Board of County Commissioners for the following reasons: 1. The conditions for approval and stated standards of USR-904 will minimize the impacts on the surrounding property and the area to the greatest extent possible. The conditions for approval and stated standards will also provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the County. 2. C.R.S. 1973, as amended and with the regulations promulgated thereunder, 6 CCR 1007-2 known as the Regulations Pertaining to Solid Waste Disposal Sites and Facilities. Certificate of Designation Application Dear Commissioners: The Hazardous Materials and Waste Management Division (the Division) of the Colorado Department of Health has completed its technical review of the Certificate of Designation application from Liquid Waste Management, Inc. to land apply the Coors Bio-Tech sludge as submitted in November,1988 and revised in April, 1989. The site is located in the N 1/2 of NW 1/4, NE 1/4 and SE 1/4 of Section 27, Township 4 North, Range 67 West, about 5 miles southeast of Johnstown, and encompasses about 400 acres. The application was reviewed to determine if the site and operations could comply with the minimum standards of the Solid Wastes Disposal Sites and Facilities Act (the Act), 30-20-100, et seq, C.R.S. 1973 as amended, and with the regulations promulgated thereunder, 6 CCR 1007-2, known as the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (the Regulations). The following major facility commitments are agreed to by the applicant, Liquid Waste Management, as contained within the application: 1. Approximately 250 dry tons of sludge from Coors Bio-Tech's Johnstown's facility will be applied to approximately 400 acres of crop land. An irrigated feed corn will be grown on this land. The application rate will not exceed 1 dry ton per acre. 2. The sludge application will occur this Summer/Fall and in the Spring or Fall of 1990 and 1991. x 3. The sludge will be surface applied and incorporated into the soil within a 24-hour period. 4. The sludge will be applied during dry weather periods upon unsaturated, non-ponding land areas and no sludge will be applied to areas of the site having slopes exceeding 6%. 9..€ 244 Weld County July 6, 11)89 page 2 5. The sludge shall undergo a sludge application analysis for total solids, volatile solids, volatile solids reduction, DH, organic, ammonia, cod nitrate er lead inickel, zinctrogenj and phosphorus, andPCB's prior to application in cadmium, copp , , the 2nd and 3rd years. The soil shr'l he analyzed for pH, total ammonia, nitrate, total phosphorus, conductivity, cadmium, copper, lead, nickel, zinc, soil texture, cet,or exchange capacity, organic matter, and available phosphorus prior to sludge application in the 2nd and 3rd years and one year following the final sludge -application. Plant tissue monitoring shall be conductedlead, nickel, and for total nitrogen, Citrate, total phosphorus, cadmium copper, 1st, 2nd, a -zinc within one month following sludge application after the and 3rd years of sludge application. Results of these analyses shall le submitted to Weld County and the Division within 60 days following sampling. If the sludge analyses, soil analyses, or plant tissue analyses indicate significant adverse changes, the applicant will Contact the Weld County and State Health Departments to reevaluate the sate and frequency of sludge application. It is the assessment of this Division that the proposed facility can xomply with the minimum standards of the Act and with the Regulations: if the facility is constructed and operated as detailed in the submitted Certificate of Designation application, referenced correspondence and as summarized above; and if the construction and operation includes the listed recommendations of the Division. Based on this assessment, the Division recommends approval of the facility contingent upon the inclusion of the following recommendations as part of the Certificate of Designation, if issued: 1. No storage of sludges will occur at the sludge application site. 2. No livestock will graze on the field within 30 days of sludge application. 3. Due to the depth of groundwater, frequency and rate of sludge application, and quality of the sludge, Coors Bio-Tech has requested a variance from groundwater monitoring requirements. Ile Division believes that this variance request should be granted and should -remain in effect as long as the sludge, soil, and plant tissue monitoring results do not indicate any significant adverse changes or impacts. 4. No surface runoff shall occur during sludge application.
