RE: APPROVE CORRECTION TO RESOLUTION OF MAY 5, 1993, REGARDING RELEASE OF CASH
COLLATERAL - TIRE MOUNTAIN, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board did, by Resolution dated May 5, 1993, approve the
release of $19,517.91 being held in the Reclamation Surcharge Fund to Tire
Mountain, Inc. , and
WHEREAS, the Board has been advised that said Resolution should be
corrected to read said Reclamation Surcharge Fund has accumulated $13, 653.49
which was paid by Tire Mountain, Inc. , with an additional $405.41 interest
earned, making a total of $14,058.90 (underlining denotes corrections) , as shown
on Exhibit "A" attached hereto and incorporated herein by reference, and
WHEREAS, after review, the Board deems it advisable to release $14, 058.90
presently being held in the Reclamation Surcharge Fund to Tire Mountain, Inc. ,
and
WHEREAS, after study and review, the Board deems it advisable to correct
said Resolution as abovementioned.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Resolution dated May 5, 1993, approving the release
of cash collateral to Tire Mountain, Inc. , be, and hereby is, corrected as
hereinabove stated.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following Agla
