RE: APPROVE APPLICATION FOR EXISTING HOUSING SECTION 8 HOUSING ASSISTANCE
PAYMENTS PROGRAM AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application for Existing
Housing Section 8 Housing Assistance Payments Program between U. S. Department
of Housing and Urban Development and Weld County Housing Authority, with the
further terms and conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said
application, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Housing Authority Board, that the Application for
Existing Housing Section 8 Housing Assistance Payments Program between U. S.
Department of Housing and Urban Development and Weld County Housing Authority be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said application.

The proposed distribution is consistent with the most current Housing Assistance
Plan and also reflects the bedroom composition of our waiting list. Our recently
purged list consists of 304 applicants, with a bedroom composition as follows:

The Weld County Housing Authority has administered the HUD Section 8 Existing Program
since 1981. The Executive Director has administered Section 8 Programs since 1976.
Since 1985, the Housing Authority has administered the Section 8 Voucher Program.
The Weld County Housing Authority currently administers a combined program of 376
units of Section 8 Existing Housing.
There are no outstanding audit or management review findings. During the implementation
of our Section 8 Programs we continue to place our units under contract in a timely
manner and to maintain a 98.9% lease-up rate. Recent reviews of the program have con-
cluded that our Section 8 Program is administered in an efficient manner.

The Weld County Housing Authority understands and will adhere to the Housing Quality
Standards as set forth in 24 CFR 882. 109 and 24 CFR 887.251. No variation in the
Acceptibility Criteria .are proposed.

CERTIFICATIONS IN CONNECTION WITj1 THE OPERATION
OF A SECTION 8 EXISTING HOUSING PROGRAM
Instructions: The applicant agency must provide assurances and certify to all of the following items.
The applicant agency hereby assures and certifies that:
ti) It will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88—.352) and regulations pursuant thereto
(Title _; CFR Part 1)which states that no person in the United States shall, on the ground if race, color, or
national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to
discrimination under any program or activity for which the applicant receives financial assistance; and will
immediately take any measures necessary to effectuate this agreement. With reference to the real property
and structure(s) thereon which are provided or improved with the aid of Federal financial assistance extended
to the applicant, this assurance shall obligate the applicant. or in the case of any transfer of property, the
transferee. for the period during which the real property and structurefs) are used for a purpose for which the
Federal financial assistance is extended or for another purpose involving the provision of similar services
or benefits.
(ii) It will comply with Title VIII of the Civil Rights Act of 1968 (P.L. 90-284) as amended, which prohibits
discrimination in housing on the basis of race, color, religion, sex or national origin, and administer its
programs and activities relating to housing in a manner to affirmatively further fair housing.
(iii) It will comply with Executive Order 11063 on Equal Opportunity in Housing which prohibits discrimination
because of race, color. creed, or national origin in housing and related facilities provided with Federal
financial assistance.
(iv) In establishing the criteria for the selection of tenants, the PHA or Owner will not utilize preferences or pri-
• orities which are based on (1) the identity or location of the housing which is occupied or proposed to be
occupied or (2) upon the length of time the applicant has resided in the jurisdiction. The PHA or Owner
shall treat non-resident applicants who are working, or have been notified that they are hired to work,
in the jurisdiction as residents of the jurisdiction.
(v) If the proposed proiect is to be located within the area of a local Housing Assistance Plan (HAP), the
applicant will take affirmative action to provide opportunities to participate in the program to persons
expected to reside in the community as a result of current or planned employment.

Attached for Board approval is the FSS application for Section 8 Certificates
and Vouchers for FY 1993.
As discussed at the Housing Authority Work-Session of August 16th, HUD has
issued a Notification of Funding Availability for new Section 8 Certificates
and Vouchers for FY 1993. Applications will be accepted from housing
authorities until August 23, 1993.
Since enactment of the National Affordable Housing Act was adopted in 1991
all additional Section 8 units are now tied to the Family Self-Sufficiency
Program(FSS) .
Family Self-Sufficiency as operated through Weld County Housing Authority
will utilize the New Directions program as the delivery vehicle. Unlike the
Project Self-Sufficiency and Operation Bootstrap programs, HUD's FSS Program
requires that participants sign a Contract of Participation. This contract
details the responsibilities of the participating family; if they are
terminated form self-sufficiency, they can also be terminated from receiving
rental assistance. The term of the Contract is five years and may be extended
two additional years. The Contract of participation requires that the head
of household work and maintain suitable employment that reflects the person's
training and available opportunities, and also requires the housing authority
to escrow funds that reflect increases in income while they are a participant
of FSS.
The Weld County Housing Authority currently maintains an active waiting list
of 304 applicants. FSS participants would be selected from this waiting list.
Our recommendation is to apply for 25 Certificates with the following
breakdown: 14 two bedrooms 8 three bedrooms and 3 four bedroom units.

The Weld County Housing Authority is in the process of submitting an
application the U. S. Department of Housing and Urban Development (HUD) for
twenty-five (25) Vouchers through the Section 8 Existing Housing Program.
Pursuant to Section 213 (c) of the Housing and Community Development Act of
1974, HUD must determine whether or not there is a need for such housing
assistance, taking into account any applicable State Housing Assistance Plan
or any County plans.
HUD invites you to submit comments or information that you or the Board deem
relevant to their determination concerning our application. While they are
not bound by any comments or information, the material will be considered.
It should be noted that these comments will be considered final and that no
additional information will be submitted.
Attached is a sample resolution which would satisfy the Section 213
requirements. Our application is due in the HUD office by August 23rd. HUD
recommends that any comments and/or the Section 213 resolution be included in
the application package.

RE: APPROVE APPLICATION FOR EXISTING HOUSING SECTION 8 HOUSING ASSISTANCE
PAYMENTS PROGRAM AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
-- WHEREAS, the Board has been presented with an Application for Existing
Housing Section 8 Housing Assistance Payments Program between U. S. Department of
Housing and Urban Development and Weld County Housing Authority, with the terms
and conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said
application, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Housing Authority Board, that the Application for
Existing Housing Section 8 Housing Assistance Payments Program between U.S.
Department of Housing and Urban Development and Weld County Housing Authority be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said application.
The above and foregoing Resolution was, on motion duly made and seconded,
