S3 � RESOLUTION RE: APPROVE RESUBDIVISION OF LOTS 1 AND 2, BLOCK 1, GEISERT SUBDIVISION - EUGENE REIBER/SHARP BROTHERS SEED COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on September 28, 1992, in a public meeting, the Board considered the request of Eugene Reiber/Sharp Brothers Seed Company, for the resubdivision of Lots 1 and 2, Block 1, Geisert Subdivision, Weld County, Colorado, in order to adjust lot lines and provide an access easement, and WHEREAS, the applicants were not present at said meeting, and WHEREAS, the Board reviewed the submitted evidence and heard the testimony of those present, and WHEREAS, the Board, having considered the recommendation of the Weld County Planning Commission, finds that the resubdivision request concerning Lots 1 and 2, Block 1, Geisert Subdivision, shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 6-4 B of the Weld County Subdivision Regulations. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 6-4 E of the Weld County Subdivision Regulations as follows: A. No lot or parcel of land shall be created that is less than the minimum requirements for area or dimension as established by these regulations or other applicable ordinances. This proposal is to exchange equal portions of land thereby leaving both parcels with the same acreage. B. Drainage easements will not be affected by the proposed resubdivision. The applicant has submitted a certified letter from an engineer stating that the road does not change the overall drainage of the subdivision. The Weld County Engineering Department has reviewed the proposal and did not indicate that the road will cause any drainage problems. C. The plat will not be altered in any way that will adversely affect the character of the plat filed. 3. The following referral entities have reviewed this request and set forth no objections: A. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The applicant has shown compliance with Section 6-4 E. of the Weld County Subdivision Regulations as follows: No lot or parcel of land shall be created that is less than the minimum requirements for area or dimension as established by these regulations or other applicable ordinances. This proposal is to exchange equal portions of land thereby leaving both parcels with the same acreage. Drainage easements will not be affected by the proposed resubdivision. The applicant has submitted a certified letter from an engineer stating that the road does not change the overall drainage of the subdivision. The Weld County Engineering Department has reviewed the proposal and did not indicate that the road will cause any drainage problems. The plat will not be altered in any way that will adversely affect the character of the plat filed. The Weld County Utilities Advisory Board reviewed this proposal on September 10, 1992 and recommended approval. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 6-1 of the Weld County Subdivision Regulations.
