STAKLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 20th day of January, 1993, considered the request of John J. Stakley for a manufactured home to be used as a principal dwelling, and WHEREAS, said manufactured home is to be occupied in an A-Agricultural Zone District on a parcel of land being more particularly described as follows: SEISWLL of Section 12, Township 3 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted subject to the following conditions; 1) The applicant shall obtain a building permit for the manufactured home prior to locating the manufactured home on the property; 2) a septic permit shall be obtained prior to the issuance of the building permit for the manufactured home; 3) prior to the issuance of a building permit, the owner shall submit evidence that a domestic well is supplying water in such a manner as to be adequate in quality, quantity, and dependability for the proposed use; and 4) the manufactured home shall not be occupied until such time that the applicant has complied with the above mentioned conditions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of John J. Legal Description of Parcel: SE4 SW4 of Section 12, T3N, R65W of the 6th P.M. , Weld County, Colorado. Location: West side of Weld County Road 47 1/2, approximately 1,320 feet south of Weld County Road 34 1/2. The Department of Planning Services staff has reviewed this request and recommends that the request be approved for the following reasons: WILL WILL NOT X Be compatible with the Weld County Comprehensive Plan. X Be compatible with the surrounding area. X Be in harmony with the character of the neighborhood. X Adversely affect the immediate area. X Be adequately served by water and sewage disposal facilities. X Adversely affect the general health, safety, and welfare of the inhabitants of the area and the County. COMMENTS: The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The applicant obtaining a building permit for the manufactured home prior to locating the manufactured home on the property. 2. A septic permit shall be obtained from the Weld County Health Department prior to the issuance of a building permit. 3. Prior to the issuance of a building permit, the owner shall submit evidence that a domestic well is supplying water in such a manner as to be adequate in quality, quantity, and dependability for the proposed use. 4. Stakley The Department of Planning Services has received one letter requesting additional information regarding the zoning permit for a manufactured home for John J. Stakley. The writer, an adjacent property owner, indicated he would object to a "trailer" placed on the property. Staff has informed the adjacent property owner of what constitutes a manufactured home. The appearance of a manufactured home is similar to that of a conventional single family dwelling. In light of the information, staff is of the opinion that the adjacent property owner's concern has been satisfactorily addressed. 9.20994 I ••��. The issuance of the permit does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. 2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 17. 3) Approved pursuant to CRS 37-92-602(3)(b)(ll)(A) as the only well on a tract of land of 35.52 acres described as the SE 1/4 of the SW 1/4 of Sec. 12, Twp. 3N, Rng. 65W, 6th P.M., Weld County, except for the west 148 feet thereof. 4) The use of ground water from this well is limited to ordinary household purposes inside one single family dwelling, fire protection, the watering of poultry, domestic animals, and livestock on farms and ranches, and the irrigation of not over one acre of home gardens and lawns. -5) Production from this well is restricted to the Laramie-Fox Hills aquifer which corresponds to the interval between 225 feet and 580 feet below ground surface. Plain casing shall be installed and sealed to prevent production from other zones. 6) The maximum pumping rate shall not exceed 15 GPM. 7) The return flow from the use of the well must be through an individual waste water disposal system of the non-evaporative type where the water is returned to the same stream system in which the well is located. 8) This well shall be constructed not more than 200 feet from the location specified on this permit. Note: To insure a maximum productive life of this well,perforated casing should be set through the entire producing interval of the approved zone or aquifer indicated above.
