RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT
FOR A FREIGHT RELAY TERMINAL IN THE A (AGRICULTURAL) ZONE DISTRICT -
CONSOLIDATED FREIGHTWAYS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 6th
day of January, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for
the purpose of hearing the application of Consolidated Freightways, Inc. , 2303
East Dartmouth Avenue, Englewood, Colorado 80110, for a Site Specific
Development Plan and Amended Special Review Permit for a freight relay terminal
in the A (Agricultural) Zone District on the following described real estate, to-
wit:
Part of the N;, Section 19, Township 11
North, Range 67 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was represented by Michael Nelson, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Amended Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposed use is consistent with the intent of the A
(Agricultural) Zone District and is provided for in the Weld
County Zoning Ordinance as a Use by Special Review.
b. The proposed use is consistent with the Weld County
Comprehensive Plan's Agricultural Goals in that no use of
prime agricultural land will be required.

c. It 1s the opinion of the Department of Planning Services that
Conditions of Approval, Development Standards, and nature of
this proposal will make it compatible with the existing and
future land uses in the area.
d. No overlay districts affect the site.
e. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and
Amended Special Review Permit for a freight relay terminal in the A
(Agricultural) Zone District on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. The site reclamation plan approved by the Department of
Planning Services and the West Greeley Soil Conservation
District for the removal of all improvements and the
revegetation of the site shall be incorporated into the
application materials.
4. A performance guarantee to ensure implementation and
completion of the approved reclamation plan shall be filed
with the Clerk to the Board for the approved amount. The
guarantee shall be returned to the applicants or released
after the reclamation plan has been satisfactorily completed.
If the plan has not been completed within 180 days from
abandonment of the site, the County shall take corrective
action to ensure compliance with the approved plans and the
guarantee shall be forfeited.

SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS
CONSOLIDATED FREIGHTWAYS, INC.

1. The Site Specific Development Plan and Amended Special Review Permit is
for a Freight Relay Terminal in the A (Agricultural) Zone District as
submitted in the application materials on file in the Department of
Planning Services and subject to the Development Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. The Use by Special Review Permit shall not be transferable to any
successors in interest to the prescribed property and shall terminate
automatically upon conveyance or lease of the property to others for
operation of the facility.
4. Sources of light shall be shielded so that light rays will not shine
directly onto the property outside of the Special Review Permit area.
5. Waste oil, anti-freeze, and other associated liquid and solid wastes shall
be stored and removed for final disposal in a manner that protects against
surface and groundwater contamination.
6. No permanent disposal of wastes shall be permitted at this site.
7. Fugitive dust shall be controlled on this site.
8. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
9. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
10. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
11. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
12. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated herein and all
applicable Weld County Regulations.

13. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
14. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

A public hearing was conducted on January 6, 1993 at 10:00 A.M. , with the
following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 7, 1992, and
duly published December 24, 1992, in the Windsor Beacon, a public hearing
was conducted to consider the request of Consolidated Freightways, Inc. ,
for a Site Specific Development Plan and Amended Special Review Permit for
a freight relay terminal in the A (Agricultural) Zone District. Lee
Morrison, Assistant County Attorney, made this a matter of record. Lanell
Swanson, Planning Department representative, entered the favorable
recommendation of the Planning Commission into the record as written.
Michael Nelson represented the applicant and stated the company intends to
stop using triples as soon as they can close their Wyoming facility;
however, they need the use of this facility in the mean time. He noted
that there is a reclamation bond posted at this time, and that no
complaints have been received. There was no public testimony offered
concerning this matter. Commissioner Webster moved to approve the request
of Consolidated Freightways, Inc. , for a Site Specific Development Plan
and Amended Special Review Permit for a freight relay terminal in the A
(Agricultural) Zone District, based on the recommendations of the Planning
staff and the Planning Commission, with the Conditions of Approval and
Development Standards as entered into the record. The motion was seconded
by Commissioner Kirkmeyer, and it carried unanimously.
This Certification was approved on the 11th day of January, 1993.

Brian Grubb, representative, Consolidated Freightways, explained Consolidated
Freightways is asking for an indefinite extension of time for the existing
Special Review permit. The original application lists a time-frame for
operation.
Judy Yamaguchi asked if there had been complaints from surrounding property
owners. Brian Grubb said no. Keith Schuett said he had received a call from a
surrounding property owner by the name of Gary Wilson who said he had no time to
write a letter but would possible write to the Board of County Commissioners.
Brian Grubb asked for an extension of time on Condition of Approval Number 4 to
allow for a growing season. Keith Schuett said this would not be a problem.
The Chairperson asked if there was anyone in the audience who wished to speak for
or against this application. No one wished to speak.
Don Feldhaus moved Case Number Amended USR-933 , Consolidated Freightways, be
forwarded to the Board of County Commissioners with the Planning Commission' s
recommendation for approval with the amendment to Condition of Approval Number
4 to read "180 days" and the Development Standards . Richard Kimmel seconded the
motion.
The Chairperson asked the secretary to poll the members of the Planning

materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. The site reclamation plan approved by the Department of Planning
Services and the West Greeley Soil Conservation District for the
removal of all improvements and the revegetation of the site shall
be incorporated into the application materials.
4. A performance guarantee to ensure implementation and completion of
the approved reclamation plan shall be filed with the Clerk to the
Board for the approved amount. The guarantee shall be returned to
the applicants or released after the reclamation plan has been
satisfactorily completed. If the plan has not been completed
within 180 days from abandonment of the site, the County shall take
corrective action to ensure compliance with the approved plans and
the guarantee shall be forfeited.

1. The Site Specific Development Plan and Amended Special Review permit is
for a Freight Relay Terminal in the A (Agricultural) zone district as
submitted in the application materials on file in the Department of
Planning Services and subject to the Development Standards stated
hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. The Use by Special Review permit shall not be transferable to any
successors in interest to the prescribed property and shall terminate
automatically upon conveyance or lease of the property to others for
operation of the facility.
4. Sources of light shall be shielded so that light rays will not shine
directly onto the property outside of the Special Review permit area.
5. Waste oil, anti-freeze, and other associated liquid and solid wastes
shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
6. No permanent disposal of wastes shall be permitted at this site.
7. Fugitive dust shall be controlled on this site.
8. The maximum permissible noise level shall not exceed the industrial
limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
9. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
10. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24. 5 of the Weld County Zoning
Ordinance.
11. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
12. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards stated
hereon and all applicable Weld County Regulations.

Dear Mr. Nelson:
Your application and related materials for the request described above are in order
at the present time. I have scheduled a meeting with the Weld County Planning
Commission for December 1, 1992, at 1:30 p.m. This meeting will take place in the
County Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915
10th Street, Greeley, Colorado. It is recommended that you and/or a representative
be in attendance to answer any questions the Planning Commission members might have
with respect to your application.
It is the responsibility of an applicant to see that a sign is posted on the property
under consideration at least 10 days preceding the hearing date. Sometime prior to
November 20, 1992, you or a representative should call me to obtain a sign to be
posted on the site no later than November 21, 1992. The sign shall be posted
adjacent to and visible from a publicly maintained road right-of-way. In the event
the property under consideration is not adjacent to a publicly maintained road right-
of-way, the applicant shall post one sign in the most prominent place on the property
and post a second sign at the point at which the driveway (access drive) intersects
a publicly maintained road right-of-way. Your sign posting certificate must be
returned to the Department of Planning Services' office on or before the date of the
hearing.
The Department of Planning Services' staff will make a recommendation concerning this
application to the Weld County Planning Commission. This recommendation will be
available twenty-four (24) hours before the scheduled hearing. It is the

Application for a Use by Special Review Permit
Consolidated Freightways
This application is a request from Consolidated Freightways to renew an
existing use by special review permit (USR-933) on a parcel of land
described as part of the N2 of Section 19, T11 N, R67W of the 6th P.M. Weld
County, Colorado. CF currently operates the facility which is located
approximately 6 miles south of the Colorado/Wyoming border at the
Carr exit approximately 300 feet east of Interstate 25 and north of WCR 126
1/2.
The original permit was approved by the Weld County Board of County
Commissioners on January 30, 1991 . This permit is valid for a period of two
years from that date and will expire this January. During the initial review
of this facility, there was some concern by one of the residents in the
area that there would be an increase in traffic, trash and vandalism if the
permit were approved. CF agreed to the development standard that
terminates the permit because of the concerns of that citizen and
because at that time, the expected usefulness of the facility was about 1
1/2 years. The concerns of that citizen never materialized. CF has
demonstrated their ability to operate a clean, safe facility with almost no
impacts to the area. There is only one residence within view of the site
which is approximately 1/2 mile to the south. When there are no trucks on
the property (which is most of the time) the facility blends into the
landscape. The only structure is a 10`x10" brown storage shed. CF has
surrounded the special review area with a 4 strand barbed wire fence
and provided security gates at the entrance. CF has also paved WCR
126 1/2 from the 1-25 exit ramp to the entrance of the facility.
To our knowledge there have been no complaints about this property
since operations began. Because of economic conditions and
circumstances surrounding other CF terminals, it would now be beneficial
for the company to use this facility on an ongoing basis.
The property is used as a transfer station for trailers. State law in Wyoming
prohibits hauling more than 2 trailers at a time. The state of Colorado
allows triples to be hauled. CF shuttles the additional trailers to their facility
in Cheyenne. The use of this transfer site allows CF to increase efficiency
and decrease fuel consumption.
The transfer station is surrounded on all sides by dryland pasture. The
nearest residence is approximately 4,550 feet to the south. There are no
other residences within one mile. The facility is not manned. The only
employees on site are the truck operators and only while hitching or
unhitching from a trailer, so no water or bathroom facilities are necessary.
No cargo is transferred from trailer to trailer.

All truck traffic originates from 1-25. Weld County Road 126 1/2 is used only
from the exit/entrance ramps to the site, Truck traffic will consist of tractors
with double or triple 38' vans with a gross vehicle weight of 40,000 lbs. up
to 100,000 lbs. loaded. CFI paved the section of Weld County Road 126
1/2 that is used by the trucks. The work was done in the spring of 1991 so
the paving is in excellent condition.
Fire protection is not necessary since there is only one 10'x10" structure on
site. Each truck carries fire extinguishing equipment as required by state
and federal law. The use does not generate any waste. The site is
surrounded by a 4 strand barbed wire fence which will contain most
miscellaneous garbage that might fall from the cabs of the trucks. This
waste will be removed from the site as needed by CF employees. Any
waste blown into the fence from surrounding properties will also be
removed and disposed of in an approved sanitary landfill,
The site is flat and completely graveled so that blowing dirt and erosion is
not a problem. Since there are no permanent structures or impervious
surfaces on site, storm water retention facilities are not necessary.
In the event that the facility is no longer useful, reclamation will be
carried out as specified in the attached letter from Gateway
Development to the Department of Planning Services dated January
14, 1991 . This reclamation plan was prepared in accordance with the
previous recommendation of the West Greeley Soil Conservation District
and approved as part of USR-933,
This proposal is consistent with the Agricultural goals and policies of the
Weld County Comprehensive Plan in that no prime agricultural land will
be taken out of production. The facility is existing and no expansion is
planned.
This proposal is consistent with the intent of the A (Agricultural) zone district
and is provided for as a use by special review.
Adequate provision for the health, safety and welfare of the inhabitants
of the neighborhood and county has been made. The facility is lighted
according the Weld County performance standards and is enclosed by
a fence for security purposes. Road and other improvements have
been constructed to county standards and the facility has been
operated over the last two years without incident.
The use is compatible with existing surrounding land uses which include
dryland pasture and Interstate 25. The use will be compatible with the
future development of the area. This area is agricultural and is expected
to remain agricultural in nature. The small amount of traffic and impacts
created by this facility will ensure long-term compatibility with the
development of the area. Any future development at the intersection of

This site is not located in a floodplain, geologic hazard overlay zone or
the airport overlay zone.

may continue too erate in an efficient and resourceful manner.
