RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1579 - FIOLKOSKI WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1579, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1579 was submitted by Frank Fiolkoski, et al. , for property which is located in part of the SWI of Section 26, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 23 acres and 83 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The Recorded Exemption plat shall show a 50-foot right-of-way reservation east of the centerline of Weld County Road 45 and north of the centerline of Weld County Road 52. 2. Any existing septic system(s) which is not currently permitted through the Weld County Health Department shall require an Individual Sewage Disposal System (ISDS) evaluation prior to the issuance of the required septic permit(s) . 3. Any ISDS shall be located at least 100 feet from any well. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. Dear Commissioners: This request for a Recorded Exemption is submitted by Frank Fiolkoski, et al. The parcel of land under consideration is described as part of the SW4 of Section 26, T5N, R65W of the 6th P.M. , Weld County, Colorado. The property is located approximately two miles southeast of the City of Evans at the northeast intersection of Weld County Roads 45 and 52. The parcel of ground is the total contiguous land holdings of the applicant. Recorded Exemption 189 created this 106 acre parcel, more or less, in 1975. The applicants wish to further divide Lot A of RE-189 into two parcels of 83 and 23 acres, more or less. Mr. Fiolkoski wishes to retire on the 23 acre parcel, which contains his residence and an outbuilding; he proposes to use the balance of his land for crop production or pasture. The application states that the proposed 83 acre parcel will be sold and a center pivot sprinkler system installed, enabling more efficient management of the farm. The subject site is served by Central Weld County Water District and an individual sewage disposal system. The Water District and Weld County Health Department have indicated service can be provided to the larger lot, should a residence be located there in the future. According to the City of Evans and Town of La Salle, the property is not located in their planning areas; however, they have no objection to the request. The Department of Planning Services' staff has concerns in recommending approval of a 23 acre parcel for rural residential use. The applicants propose retaining one share of Union Ditch water for maintenance of the lot as an agricultural unit. It is the staff's opinion that 23 acres may not be a manageable-sized farm, if used for crop production. The Board is being asked to approve the smaller lot with no assurance that there will be changes to the existing irrigation system on the larger lot. It is the staff's opinion that a reduction in size of the 23 acre lot, allowing the cropland to remain intact, is a preferable alternative to this request. The staff requests that the Board consider the above-stated concerns and determine whether this request meets the criteria for review as set forth in Section 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance. Our son was operating the farm for us until his death 8 years ago. Since that time I have not been able to find an acceptable tenant to operate the farm to my liking. In other words they usually can ' t generate enough revenue to service the landlords share of expenses. I have an opportunity to sell the East 80 acre portion of our farm to a neighbor who intends to develop it with a 1 ,000 foot sprinkler system. Therefore, we desire to sell the East 83 acres which does meet the minimum lot size requirements of the County to minimize my exposure and retain the balance of 23 acres. The water rights associated with the farm consist of 3 shares of the Union Ditch and one 700 G.P .M. irrigation well . Typically one share of this water is adequate to irrigate a 20 acre parcel . I will retain one share of water and the other two shares together with the well will be utilized to irrigate the 83 acre parcel . This is ideal since the well will only back up in the ditch to about the point where the property will be split . The use of the subject property will remain un-changed as we reside on what will be the 23 acre parcel and it will continue to be operated for crop production while the remaining large parcel will be utilized for crop production and hopefully developed into a more productive parcel by the means of a sprinkler. The current zoned district is agricultural and the split will not affect the use of the property. 6. Explain how the proposal is consistent with efficient and orderly development. The proposal is consistant with orderly development as it is consistant with the description of the recorded exemption process as defined in the subdivision. 7. Explain how adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the County will be accomplished. Please note that UPRC owns all of the minerals that underlie the railroad right of way.
