RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A DOG
KENNEL (MAXIMUM 20 ADULT DOGS) IN THE A (AGRICULTURAL) ZONE DISTRICT -
GREG AND MARY AUSTIN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the
18th day of December, 1991, at the hour of 10:00 a.m. in the Chambers of the
Board for the purpose of hearing the application of Greg and Mary Austin, 434
Weld County Road 16?, Longmont, Colorado 80504, for a Site Specific Development
Plan and Special Review Permit for a dog kennel (maximum 20 adult dogs) in the
A (Agricultural) Zone District on the following described real estate, to-wit:
Part of the SW;, Section 30, Township 2
North, Range 68 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicants were presented, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. This proposal is consistent with the Agricultural Goals and
Policies of the Weld County Comprehensive Plan. No prime
agricultural land will be taken out of production for the dog
kennel.
b. The proposed use is consistent with the intent of the
Agricultural Zone District and is provided for as a Use by
Special Review.
c. The uses permitted will be compatible with the existing
surrounding land uses which include: irrigated agricultural
production, rural residences, gravel mining and pasture.

d. The use will be compatible with the future development of the
surrounding area. This area is expected to remain
agricultural. A copy of this application was forwarded to the
Boulder County Planning Department for their review and
recommendation. In a telephone conversation on May 24, 1991,
a representative from Boulder County Planning indicated that
they have no conflict with the proposed use.
e. No overlay districts affect the site.
f. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application for a Site Specific Development
Plan and Special Review Permit for a dog kennel (maximum 20 adult dogs) in
the A (Agricultural) Zone District on the hereinabove described parcel of
land be, and hereby is, granted subject to the following conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the
Department of Planning Services and be ready for recording in the
Weld County Clerk and Recorder's office within 15 days of
approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any
building or electrical permits be issued on the property until
the Special Review plat is ready to be recorded in the office of
the Weld County Clerk and Recorder.
3. Prior to recording the Special Review Plat map the applicant
shall submit evidence that an I.S.D.S. evaluation has been
performed on all existing septic systems.
4. Prior to being heard by the Board of County Commissioners:
a. The applicant submitted proof that a noise abatement and
response plan has been approved by Weld County
Environmental Protection Services.
b. The applicant submitted evidence that the well water which
supplies the dogs is potable.
c. The applicant submitted evidence that a boarding kennel
application and plan review form has been completed and
approved by Weld County Environmental Protection Services.

5. Within 14 days of approval by the Board of County Commissioners,
the applicant shall submit a plan for a privacy fence and berm to
the Department of Planning Services for review and approval. The
approved plan shall be integrated into the submitted application
materials and shown on the Special Review plat map.
6. Within 150 days of approval by the Board of County Commissioners,
the applicant shall complete the approved plan for a privacy
fence and berm.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 18th day of December, A.D. ,
1991.

DEVELOPMENT STANDARDS

1. The Site Specific Development Plan and Special Review Permit is for a
dog kennel (maximum 20 adult dogs and 20 puppies) in the A
(Agricultural) Zone District as submitted in the application materials
on file in the Department of Planning Services and subject to the
Development Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. The applicant shall remove, handle, and stockpile manure from the
kennel area in a manner that will prevent nuisance conditions. The
manure piles shall not be allowed to exist or deteriorate to a
condition that facilitates excessive odors, flies, insect pests, or
pollutant runoff.
4. All liquid and solid wastes shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
5. No permanent disposal of wastes shall be permitted at this site.
6. Wood shavings, sawdust, and waste materials shall be handled, stored,
and disposed of in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions.
7. Fugitive dust shall be controlled on this site.
8. The maximum permissible noise level shall not exceed the light
industrial limit of 70 dB(A) , as measured according to 25-12-102,
Colorado Revised Statutes.
9. The kennel facility shall be maintained in compliance with the State of
Colorado Kennel and Animal Shelter Regulations.
10. A noise abatement and response plan shall be implemented at the request
of Weld County Environmental Protection Services in the event that
noise levels detected off-site of the facility meet or exceed the 70
dB(A) limit.
11. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
12. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.

13. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
14. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards
stated herein and all applicable Weld County Regulations.
15. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
16. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.
17. The Special Review Permit shall not be transferrable to any successors
in interest to the described property and should terminate
automatically upon conveyance or lease of the property to others for
operation of the facility.
18. The privacy fence and berm shall be maintained in a manner consistent
with the approved plans on file.

A public hearing was conducted on December 18, 1991, at 10:00 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 20, 1991, and
duly published November 27, 1991, in The New News, a public hearing was
conducted to consider the request of Greg and Mary Austin for a Site
Specific Development Plan and Special Review Permit for a dog kennel
(maximum 20 adult dogs) in the A (Agricultural) Zone District. Lee
Morrison, Assistant County Attorney, made this a matter of record. Brian
Grubb, Planning Department representative, recommended the Resolution of
the Planning Commission and the Planning staff's recommendation be entered
into the record as written. Mary Austin, applicant, was present and
stated they were agreeable to this. Ms. Austin spoke on her background
with dogs and the existing facilities on the property. She said they
intend to build a privacy fence with a berm and install concrete dog runs.
Ms. Austin answered questions of Chairman Lacy concerning water and
neighbors concerns. Commissioner Kirby stated concerns regarding the
definition of puppies and the transferability of the permit. Ms. Austin
said puppies are usually kept for only 7 to 12 weeks, and they normally
have only 1 litter at a time at said facility. Chairman Lacy asked Ms.
Austin if a limit of 20 adult dogs and 20 puppies would be acceptable.
She answered in the affirmative. Nancy Cole, Lynn Johnson, and Roger
Drotar, all surrounding property owners, stated their concerns about noise
and waste. Ms. Austin responded to their concerns by explaining the fence
would be approximately 8 feet high, and would be complete around the
perimeter of the kennels. She said the berm would consist of railroad
ties and would continue past the fence to the south. Mr. Grubb read two
additional conditions of approval and one development standard into the
record, concerning the completion and maintenance of the fence, for the
Board's consideration. Ms. Austin said the fence would be solid wood. In
response to a question from Commissioner Harbert, Ms. Austin said the
ground would be leveled and concrete runs would be poured. She said the
berm would be on the outside of the fence and approximately 4 feet tall.
After further discussion, Mr. Grubb read Condition of Approval 115 which
states: "Within 14 days of approval by the Board of County Commissioners,
the applicant shall submit a plan for a privacy fence and berm to the
Department of Planning Services for review and approval. The approved
plan shall be integrated into the submitted application materials and
shown on the Special Review plat map."; Condition of Approval 116 which
states: "Within 150 days of approval by the Board of County Commissioners,
the applicant shall complete the approved plan for a privacy fence and
berm. "; and Development Standard 1118 which states: "The privacy fence and
berm shall be maintained in a manner consistent with the approved plans on
file. " Ms. Austin said she was agreeable to all conditions of approval

Commissioner Kirby moved to approve the request of Greg and Mary Austin
for a Site Specific Development Plan and Special Review Permit for a dog
kennel (maximum 20 adult dogs) in the A (Agricultural) Zone District,
based on the recommendation of the Planning staff and the Planning
Commission, with the conditions of approval and development standards as
entered into the record. The motion was seconded by Commissioner Webster,
and carried unanimously.
This Certification was approved on the 23rd day of December, 1991.

Pursuant to the zoning laws of the State of Colorado and the Weld County
Zoning Ordinance, a public hearing will be held in the Chambers of the
Board of County Commissioners of Weld County, Colorado, Weld County
Centennial Center, 915 10th Street, First Floor, Greeley, Colorado, at the
time specified. All persons in any manner interested in the Site Specific
Development Plan and Special Review Permit are requested to attend and may
be heard.
Should the applicant or any interested party desire the presence of a
court reporter to make a record of the proceedings, in addition to the
taped record which will be kept during the hearing, the Clerk to the
Board's Office shall be advised in writing of such action at least five

Dear Ms. Austin:
The plans for the Jamerlane Breeding Kennel located at 434 Weld County Road 16
1/2, Longmont, Colorado have been reviewed and approved with the following
additions required:
1. The outside dog enclosures shall be sealed so that they are impervious to
moisture.
2. A quarantine area that is physically separated from other animals and that
has a separate ventilation system is required.
3. A letter outlining the noise abatement plan must be submitted.
Please review the State of Colorado Kennel and Animal Shelter Rules and
Regulations (effective 1984) for all other requirements not mentioned in this
letter.
A pre-opening inspection is required prior to the operation of this facility.

LOCATION: South of and adjacent to Weld County Road 16 1/2 and approximately
1/2 mile east of Weld County Road 1.
Mary Austin, applicant, says they have raised Labrador Retrievers for 11 years
and they are AKC, UKC registered. They have 1 to 2 litters of puppies per year
and are vaccinated 2 times annually. Labradors are known to have medical
problems. , They are housed in a 60' x 60' enclosure with 9 dog runs that are 6'
x 22' . Plastic tarps are used for shading purposes. The dogs are moved to the
garage in the winter. This has a swamp cooler and furnace, sink facilities, and
floodlights. An outdoor feeder is used when the Austins are away. They plan to
build a privacy fence on the outside 2 perimeters and build concrete dog runs for
sanitation purposes.
LeAnn Reid asked on the average how many extra dogs would be housed including
puppies born and dogs brought in for breeding. Mary Austin explained they
averaged 7 puppies for about 8 weeks after the delivery and approximately 30 dogs
during the breeding process.. Shirley Camenisch asked why only 1 to 2 litters per
year. Mary Austin said puppies are alot of hard work and they are not the main
business.

Michael Cole, surrounding property owner, submitted a letter with 5 request the
neighborhood would like to see if the kennel is approved. Rod Allison reviewed
the letter and stated 4 of the request were included with staff comments and the
request about not being able to transfer the specail use permit upon sale of the
property was not included. Rod Allison presented a standard so the Special Use
permit could not be transferred if the property was sold.
Bud Clemons moved that Case Number USR-946 with the addition of Development
Standards #17 be sent to the Board of County Commissioners with the Planning
Commission's recommendation for approval. Motion seconded by Judy Yamaguchi.

recommendation. Barb Brunk showed on the map the proposed screening to include
Rocky Mountain Junipers and Russian Olives and explained when development occurs
they will discuss screening with the staff. This will include a 4 foot berm and
with the planting will achieve a mature height of 15 to 20 feet tall. Don
Feldhaus asked about the maturity time. Barb Brunk said 2 to 3 years for
density.

reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services' staff
that the applicant has shown compliance with Section 24.3 of the
Weld County Zoning Ordinance as follows:
This proposal is consistent with the Agricultural Goals
and Policies of the Weld County Comprehensive Plan. No
prime agricultural land will be taken out of production
for the dog kennel.
The proposed use is consistent with the intent of the
Agricultural Zone District and is provide for as a Use by

The uses permitted will be compatible with the existing
surrounding land uses which include: irrigated

review and recommendation. In a telephone conversation

Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of
the neighborhood and County.
This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
The Planning Commission recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Prior to recording the Special Review Plat map the applicant shall
submit evidence that an I.S.D.S. evaluation has been performed on
all existing septic systems.
4. Prior to scheduling this request before the Board of County
Commissioners:
a. the applicant shall submit proof that a noise abatement and
response plan has been approved by Weld County Environmental
Protection Services.
b. the applicant shall submit evidence that the well water which
supplies the dogs is potable.

1. The Site Specific Development Plan and Special Review permit is for a
dog kennel (maximum 20 adult dogs) in the A (Agricultural) zone district
as submitted in the application materials on file in the Department of
Planning Services and subject to the Development Standards stated
hereon.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. The applicant shall remove, handle, and stockpile manure from the kennel
area in a manner that will prevent nuisance conditions. The manure
piles shall not be allowed to exist or deteriorate to a condition that
facilitates excessive odors, flies, insect pests, or pollutant runoff.
4. All liquid and solid wastes shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
5. No permanent disposal of wastes shall be permitted at this site.
6. Wood shavings, sawdust, and waste materials shall be handled, stored,
and disposed of in a manner that controls fugitive dust, blowing debris,
and other potential nuisance conditions.
7. Fugitive dust shall be controlled on this site.
8. The maximum permissible noise level shall not exceed the light
industrial limit of 70 dB(A) , as measured according to 25-12-102,
Colorado Revised Statutes.
9. The kennel facility shall be maintained in compliance with the State of
Colorado Kennel and Animal Shelter Regulations.
10. A noise abatement and response plan shall be implemented at the request
of Weld County Environmental Protection Services in the event that noise
levels detected off-site of the facility meet or exceed the 70 dB(A)
limit.
11. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
12. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.

13. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
14. Personnel from the Weld County Health Department and Weld County
Department o£ Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards stated
hereon and all applicable Weld County Regulations.
15. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the office
of the Department of Planning Services.
16. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.
17. The special review permit shall not be transferrable to any successors
in interest to the described property and should terminate automatically
upon conveyance or lease of the property to others for operation of the
facility.

Environmental Protection Services has reviewed this proposal and recommends for
approval, subject to the following conditions:
1. The applicant shall remove, handle, and stockpile manure from the kennel
area in a manner that will prevent nuisance conditions. The manure piles
shall not be allowed to exist or deteriorate to a condition that
facilitates excessive odors, flies, insect pests, or pollutant runoff.
2. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
3. No permanent disposal of wastes shall be permitted at this site.
4. Wood shavings, saw dust, and waste materials shall be handled, stored, and
disposed in a manner that controls fugitive dust, blowing debris, and
other potential nuisance conditions.
5. Fugitive dust shall be controlled on this site.
6. The maximum permissible noise level shall not exceed the light industrial
limit of 70 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
7. An I.S.D.S. Evaluation on any existing septic systems will be necessary,
prior to issuing the required septic permits on the existing systems.
8. The Division requires that a noise abatement and response plan be
submitted prior to operation of the facility. This plan shall be
implemented at the request of the health department in the event that
noise levels detected off site of the facility meet or exceed the 70 dB(A)
limit. The plan shall also be implemented in the event that the Health
Department receives a significant number of noise complaints and in the
judgement of the Director of Public Health, there exists condition
requiring abatement.
9. Boarding kennel application and plan review form to be completed and
approved before construction commences.
10. It should be determined that the well water to be provided to the animals
is potable.
11. The kennel facility shall be in compliance with the State of Colorado
Kennel and Animal Shelter Regulations.

Please find attached a copy of our as--built map, which hi-lights
Panhandle Eastern's pipeline , 16-10-075-344-6" , located in or
near the property described as Lot A of Recorded Exemption #675 ,
located in part of the Southwest Quarter of Section 30, Township
North, Range 68 West of the 6th P.M. , Weld County, Colorado .
Panhandle does not foresee any conflicts with this request,
however, before approval is given we request that Mr. and Mrs.
Austin and/or representatives of any and all contractors involved
in the construction/excavation of this project , contact us prior
to plans of construction. At that time , we may discuss their
plans and interpret the following stipulations_
Panhandle Eastern maintains a 50-foot wide right-of-way on all
pipelines and will not allow any building within that easement
area.Utility lines, streets, sidewalks, and driveways may be
installed at approximate right angles to the pipeline herein
authorized, provided, however, that all utilities cross under our
pipeline with a minimum clearance equal to the diameter of the
larger utility or 18" , whichever is greater.No paved or traveled
portion of any street, sidewalk, driveway, road, alley, or
curbing will be placed substantially parallel to and within
fifteen ( 15" ) feet of the pipeline , provided adequate working
space is available on the other side of the pipeline.
In the event of a proposed crossing with a road or utility,
please contact Utility Notification Center of Colorado (UNCC) at
534-6700 (Lpcal & Metro Denver) , or 1--800-922--1987 (Outside the
Metro area) , with two (2) business days notice, and at no cost to
you, we will locate and mark our lines to eliminate accidents
that can occur from foreign forces_
We will be more than happy to work with everyone involved,
however, it must be noted that if for any reason our lines must
be moved, it will be at the expense of the developer or the

Following is a guideline for calculating the size of the ventilation exhaust
system for animal housing areas.
Colorado Kennel and Animal Shelter Regulations for indoor anial housing
requires a ventilation exhaust system having ten (10) or more fresh air changes
per hour for new or extensively remodeled facilities after March 1, 1984 .
1. To determine the exhaust air volume of a fan in cubic feet per minute
(cfm) when the air changes per hour is known: (Example: 10 air changes
per hour)
Room size - 9 ' wide, 20 ' long, 8 ' high ceiling
9 ' x 20 ' x 8 ' = 1440 cu. ft. of air in room.
14.40 cu ft air x 10 changes per hour = 14400 cu. ft. air/hr
14400 cu ft air * 60 min/hr = 240 cfm size exhaust fan needed
(*divided by)
2 . To determine air changes per hour when the exhaust air volume of a fan in
cubic feet per minute (cfm) is known: (Example: 240 cfm size exhaust fan)
Room size - 9 ' wide, 20 ' long, 8 ' high ceiling
9 ' x 20 ' x 8 ' = 1440 cu. ft. of air in room.

Introduction
We have owned Labrador Retrievers for eleven years. They are American
Kennel Club registered and just recently have been registered under the
rules and regulations of the United Kennel Club.
We presently own retired dogs, recent show champions, and potential started
field and obedience champions.
We currently have broad bitches and dogs standing at stud. We have one
litter of puppies every one to two years. We sell puppies as well as older
dogs. We do receive bitches flying into the Denver area to use our stud
dogs and we also ship fresh semen through the assistance of my veterinary.
The dogs we currently have all receive vaccinations twice a year. They
receive DHLP (Distemper, Hepatitis, Lepto, Parainfluenza) , Coronavirus,
Parvovirus, Intra-Trac II Canine Cough Vaccine and the Rabies vaccine is
given only once a year. At the present time I do veterinary business with
the following people: House Call for Animals - Dr. Judy Shoemaker,
Brighton, Colorado; Dr. Melissa Culver, Longmont, Colorado; Dr. Phyllis
Holst, Longmont, Colorado; and Colorado State University Vet Hospital , Ft.
Collins, Colorado.
All dogs are checked by the two years of age for Hip Dysplasia and eyes are
checked annually for hereditary defects such as Cataracts, Progressive
Retinal Atrophy, etc. and a Brucellosis test for VD is done prior to each
breeding for dogs and bitches.
The organizations we currently belong to are: Labrador Retriever Club,
Inc. which is our national organization, the Labrador Retriever Club of
Greater Denver where I am currently the co-editor of our newsletter and
have served in various other board positions over the years, and the Platte
Valley Hunting Retriever Club.
We currently have dogs that are working in the areas of avalanche rescue
and arson detection.

Outdoor Facilities
The exterior parameter of the kennel area is currently 60 foot by 60 foot
in size. Inside the dog area there are currently nine dog runs measuring 6
foot wide and 22 feet in length with plywood dog houses to protect them
from direct sunlight, wind, rain, and snow.
Plastic tarps are used in the summer to cover the dog runs for shade.

The gargage area serves a dual purpose. It is an oversized two car gargage
attached to the house. There are airline crates and wire crates (labrador
size) available to house dogs in extremely unfavorable weather conditions.
The gargage area is equipped with a swamp cooler for the spring and summer
months and a propane ceiling forced air heater for the fall and winter
months.
There is a double fiberglass sink located in the gargage area for all
cleaning of dog related feed bowls and water buckets.
General Information
There are two water hydrants in the exercise area and the water to that
area is supplied via the house from the water well .
Electrical power is supplied via the house to the exercise area. There are
three tall flood lights on the outer parameter of the dog area and one
flood light attached to the gargage side of the dog area. Electric power
is supplied by the Union Rural Electric Association.
All bulk feed is stored in the gargage. Two 30 gallon plastic garbage cans
are used to store food as it is being used. We currently use 6 pound
automatic feeders that help the feeding procedure when we are out of town.
At the present time the dog area has a base of squege to facilitate easy
cleaning and removal of dog waste. All areas are sprayed frequently with
adequate sanitizing and effective pest control products.

Improvements
A bark barrier or privacy fence will be installed on the two outer
parameters of the existing exercise area for privacy and dog
control .
Concrete is going to be poured for all dog runs to help cleaning procedures
and for adequate sanitizing.
Instead of using tarps as we have done in the past to cover the dog runs
for shade, fiberglass patio panels will be installed.

Application Requirements
2a. Proposed Use
The proposed use is a dog kennel and exercise area. The area set
aside is 60 foot by 60 foot of the total 8.79 acre tract. The area
set aside was not a useable yard or pasturing area. The dog exercise
area consists of individual dog runs for better dog control and with
plenty of exercising area.
2b. Need for Use
This area is proposed for our own personal use and security of our
dogs.
2c. Surrounding Uses
The area lies above the Gooding, Daley and Plumb Ditch and Boulder
Creek with a large portion of the surrounding lands being used for
pasturing, farming, hunting, excavation, and residential .
2d. Residential Proximity
There are four residential homes in the area within 500 ft. of the
property line.
2e. Users
There will be no special users. The special area being applied for is
for our own personnal use.
2f. Employees
There will be no employees working for us because this is a hobby
business and is only a part-time job.
2g. Water Source
Water is provided to the property by a well that is on the front side
of the property. We own one share of Boulder White Rock for
irrigational purposes only.
2h. Access
Approximately two miles north of Highway 52 on County Line Road to
Weld County Road 16 1/2. From Weld County Road 16 1/2 a gravel road
approximately 1/2 mile east to the property.
2i . Traffic
There will be need to be concerned about traffic control . Traffic
will be limited to the normal everday load with minimal deliveries
from Federal Express and UPS. Once or twice a month a trip to the
airport will need to be made to pickup or shipout dogs. With only
having a litter of puppies once every one to two years, occasional
puppy buyers will be out to possibly purchase.
2j . Sewage Facilities
This is not a concern for us because the use of the area being applied
for is for dogs, not humans. There is a septic tank for household use
only and because there are no employees no additional facilities are
needed.
2k. Fire Protection
Fire protection is provided by the Longmont Rural Fire Protection
District. Fire danger itsself will be minimal due to the type of
contruction. There are available household fire extinguishers for use
and also the availability of water from the outdoor hydrants located
in the dog exercise area.
21 . Animals
The maximum concentration of animals will not exceed 20, not
to include newborn puppies or adult bitches coming in
for stud services.
2m. Waste
All animal waste is collected daily and removed from all dog
areas. In addition, all animal waste is deposited in plastic
garbage bags and then deposed of in a mini dumpster provided by the
Rocky Mountain Dispose-All Company. The company picks up the dumpster
every two weeks. This will keep odors and potential disease to a bare
minimum.

2n. Storm Water Facilities
None are proposed because the area is zoned for agriculture.
20. Waste Removal
There is no need for trash receptacles because the area is for animal
use only. Any trash that might blow in will be disposed of properly.

2p. Landscaping
The site is surrounded by fields and/or pasture areas. Any specific
landscape areas are not being proposed for this special use.
2q. Reclamation Procedures
Procedures would be minimal as the area is already fenced off and
could be made into whatever the new owners would want.
2r. Timetable
The dog area is in place but only a few additional improvements remain
to be made. As soon as the necessary permit is obtained then we will
be in legal compliance with the zoning regulations.
3. Supplementary Information
3a. Comprehensive Plan
The applicant feels that the proposed use is consistent with the Weld
County Comprehensive Plan for the following reason(s) :
1 . The "use" does not remove "prime" agriculture land from use. The
dog exercise area is located on a piece of ground that was not
useable for any other purpose.

Zoning use is consistent with the intent of the Agriculture Zoning
District. The use is non-industrial and will have a no affect on the
agricultural area. There will be adequate controls through the
Special Review process.
3c. Preservation of Agricultural Lands
The area selected for the dog exercise area is on a area that can not
be irrigated or used for agriculture and is the least productive part
of the property.
3d. Protection of Health, Safety, and Welfare
There are no particular health hazards or polllution associated with
the proposed use.
3e. Compatibility with Existing Uses
The areas around are primarily agriculture and the adjoining uses are
either agriculture or residential lots in the agriculture zone.
3f. Compatibility with Future Uses
The use is not intensive and would be compatible with future uses of
the area.
3g. Overlay Districts
The area is not within any geological hazard area or airport overlay
district. The area does not lie within a flood plain due to its
location. Because of its location, the area may have gravel deposits,
but the proposed use is not intensive enough to preclude the removal
of gravel if otherwise economically feasible.
3h. Water Supply
The proposed use has a very low water demand. The water well that
supplies the property will suffice.

the surrounding area. This area is expected to remain
agricultural. A copy of this application was forwarded
to the Boulder County Planning Department for their
review and recommendation. In a telephone conversation
on May 24, 1991, a representative from Boulder County
Planning indicated that they have no conflict with the
proposed use.

No overlay districts affect the site.
Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of
the neighborhood and County.
This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
The Planning Commission recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder' s office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Prior to recording the Special Review Plat map the applicant shall
submit evidence that an I.S.D.S. evaluation has been performed on
all existing septic systems.
4. Prior to scheduling this request before the Board of County
Commissioners:
a. the applicant shall submit proof that a noise abatement and
response plan has been approved by Weld County Environmental
Protection Services.
b. the applicant shall submit evidence that the well water which
supplies the dogs is potable.
c. the applicant shall submit evidence that a boarding kennel
application and plan review form has been completed and
approved by Weld County Environmental Protection Services.

1. The Site Specific Development Plan and Special Review permit is for a
dog kennel (maximum 20 adult dogs) in the A (Agricultural) zone district
as submitted in the application materials on file in the Department of
Planning Services and subject to the Development Standards stated
hereon.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. The applicant shall remove, handle, and stockpile manure from the kennel
area in a manner that will prevent nuisance conditions. The manure
piles shall not be allowed to exist or deteriorate to a condition that
facilitates excessive odors, flies, insect pests, or pollutant runoff.
4. All liquid and solid wastes shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
5. No permanent disposal of wastes shall be permitted at this site.
6. Wood shavings, sawdust, and waste materials shall be handled, stored,
and disposed of in a manner that controls fugitive dust, blowing debris,
and other potential nuisance conditions.
7. Fugitive dust shall be controlled on this site.
8. The maximum permissible noise level shall not exceed the light
industrial limit of 70 dB(A) , as measured according to 25-12-102,
Colorado Revised Statutes.
9. The kennel facility shall be maintained in compliance with the State of
Colorado Kennel and Animal Shelter Regulations.
10. A noise abatement and response plan shall be implemented at the request
of Weld County Environmental Protection Services in the event that noise
levels detected off-site of the facility meet or exceed the 70 dB(A)
limit.
11. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
12. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.

13. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
14. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards stated
hereon and all applicable Weld County Regulations.
15. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the office
of the Department of Planning Services.
16. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.
17. The special review permit shall not be transferrable to any successors
in interest to the described property and should terminate automatically
upon conveyance or lease of the property to others for operation of the
facility.
