RE: APPROVE PARTIAL RELEASE OF COLLATERAL - EATON LANDFILL, C/O AL MILLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 12, 1994, the Board entered into an
agreement concerning Conditions of Closure and Vacation of Certificate of
Designation for a Solid Waste Disposal Site and Facility for McMill, Inc. (Eaton
Landfill) , and
WHEREAS, in furtherance of that Resolution, the Board retained collateral
which was already being held by the Board for use in removal of tires at said
landfill, and
WHEREAS, pursuant to said agreement, Eaton Landfill, c/o Al Miller, has
presented an invoice from D-Caton Excavation, Inc. , in the amount of $1,615.00
for moving tires at said landfill, and
WHEREAS, the Weld County Health Department has inspected the Eaton Landfill
and found the tires to have been moved to the northwest corner of the previously
excavated gravel pit, and
WHEREAS, the Board deems it advisable to release collateral, in the amount
of $1, 615.00, for said project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that pursuant to the Board's Resolution dated January 12, 1994,
collateral in the amount of $1, 615.00 be, and hereby is, released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and
hereby is, directed to process payment of said collateral, payable to D-Caton
Excavation, Inc. and Al Miller.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 8th day of June, A.D. , 1994.

suelect:Request for release of collateral - Eaton Landfill/Miller
Al Miller, Eaton Landfill, is asking for release of $1, 615.00 for moving
of the tires into the storage area. This move has been accomplished
according to Trevor Jirecek, Health Department. The mesh has not been
installed nor has the cover over the landfill been improved, but the
deadline has not yet passed. Mr. Jiricek notes two other concerns which
need correction.
The escrow has $4, 025.30, and this release would leave $2,410.30.

Dear Mr. Miller:
A portion of the collateral currently held by the Weld County Board
of Commissioners has been released based upon the invoices
submitted and an inspection of the Eaton Landfill which indicates
that the tires have been moved in accordance with the Agreement
adopted by Resolution of January 12 , 1994 . A copy of the memo from
Mr. Jiricek regarding his inspection has been enclosed for your
reference. The memo notes that the wire mesh and fence have not
been installed, the holes and sink holes in the existing landfill
have not yet been repaired and, further, that some refuse has been
exposed by gravel excavation and refuse deposited in the extreme
southeast corner of the landfill .
This letter is to remind you of your obligation pursuant to the
Agreement to complete the work within the required 150 days, which
time is rapidly approaching. You are also advised that the refuse
needs to be covered in the far southeast corner and on the west
side of the gravel pit as soon as possible. Compliance with the
Agreement will be considered and any additional requests for
release of collateral will take into consideration your efforts at
compliance.

On Friday, June 3, 1994, I inspected the Eaton Landfill. The purpose of the
inspection was to observe the facility's compliance with item numbers 1 and 2 of
the Resolution of January 12, 1994. On this date I observed that the tires have
been concentrated in the northwest corner of the previously excavated gravel pit.
However, the wire mesh and six (6) foot fence described in exhibit A of the
Resolution was not installed as of this date. In addition, the holes, divots,
and sink holes on the existing landfill have not yet been repaired.
On this date I also observed two (2) additional items of concern. They are as
follows:
1) It appears that gravel has been removed on the west side of the previously
excavated gravel pit exposing refuse. This should be repaired immediately
to prevent additional erosion, etc.
2) Refuse has recently been disposed in the extreme southeast corner of the
landfill footprint. This refuse has yet to be covered.
