RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NO. 1408 - IANNACITO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a request for Recorded Exemption No. 1408, submitted by Damian C. and Mary June Iannacito for property which is located in part of the SW* of Section 6, Township 3 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 37 acres and 3 acres. WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Regulations as defined in Section 1-3. 2. It is the opinion of the Board that any further division of these lots will create additional accesses onto Weld County Road 13 and will increase the density of the existing linear subdivision. 3. The Board feels this division would be inconsistent with efficient and orderly development. 4. The Board feels this proposal increases the need for more urban-type services in the area. The parcel of land is described as part of the SW4 of Section 6, T3N, R67W of the 6th P.M. , Weld County, Colorado. The property is located east of Weld County Road 13, approximately .5 miles north of Weld County Road 36. This request is to divide a 40 acre parcel, which is the total contiguous land holdings of the applicants, into two lots of 37 acres and 3 acres, more or less. The property is currently served by Little Thompson Water District and a septic system. The applicants propose serving the 37 acre parcel with the same type services. The staff has concerns that the proposed division will be inconsistent with efficient and orderly development. Within this .25 mile section, there are currently four possible accesses from the east side of Weld County Road 13, and one existing access on the west side of Weld County Road 13. The parcels as they exist are shown on the attached aerial photograph. The existing parcels were all created prior to the effective date of the Weld County Subdivision Regulations. The configuration of these lots on the county road constitutes a linear subdivision. Any further division of these lots will create additional accesses onto Weld County Road 13 and will increase the density of the linear subdivision. Continued divisions may evade the intent and purpose of the Weld County Subdivision Regulations. Increased residential development in rural areas requires more urban-type services such as road maintenance, snow removal, utilities, police and fire protection and school busing. IANNACITO AND MARY JUNE IANNACITO Application for Recorded Exemption STATEMENTS SUPPORTING APPLICATION FOR RECORDED EXEMPTION Purpose. The purpose of the Iannacitos ' request is to separate the residence from the rest of the farm so that they may continue to live in the residence and sell the balance of the farm. For health reasons , the Iannacitos are no longer able to farm their property. Proposal is Consistent with Weld County Comprehensive Plan. This proposal is consistent with the policies of the Weld County Comprehensive Plan. None of the historical land uses of the two Lots will be changed. Lot A will continue to be a residence. Lot B, containing the vast majority of the property, will continue to be used for agricultural purposes . Proposal is Consistent with Intent of the Zoning District . This proposal is consistent with the Intent of the Agricultural Zoning District in which the subject property is located . Under the proposal the uses of the subject property will not change with more that 92. 5% of the property continuing to be used for agricultural purposes . The only difference is that the Iannacito ' s residence will be separated from the rest of the property. Compatability of Uses . Both Lots will continue their historical use. All of the surrounding land is used for agricultural purposes with the majority of farms apparently consisting of 160 acres and having owner-occupied residences . Compatability with Future Development. The subject property appears to be more than three miles east of the center of Mead, Colorado. The residential use of Lot A and the agricultural use of Lot B will be compatable with future development of the surrounding agricultural area as well as the continued agricultural nature of that area and the future plans of Mead , Colorado. Proposal Consistent with Efficient Orderly Development . This recorded exemption will not make any change in the efficient and orderly development of the surrounding area and its present and future intended use for agricultural purposes . Iannacito whom I represent. Unfortunately, the Iannacito ' s health problems were not explained to you as fully as I would have liked them to have been, as I myself was unaware of the severity of these problems until after the hearing. Following the hearing, Mrs . Iannacito explained that it was her health problems more than her husband ' s health problems that were causing them to request the Recorded Exemption. At the time the Iannacitos purchased the subject farm in June , 1990 , in an exchange transaction, Mrs. Iannacito was the principal farmer of the couple . In May of 1991 , she suffered a series of little strokes which required her hospitalization. She was not able to plant the crop herself and had to hire someone to do it for her. Mrs . Iannacito has taken steps to improve her health , but she continues to have flareups similar to hot flashes and she fears that the condition may reoccur. For that reason, she feels it is unwise for her to continue farming - her health is just not dependable enough . Prior to purchasing the subject farm, the Iannacitos had farmed for their entire adult lives . Mr. Iannacito has been involved in agriculture from the time he was a child when he helped on his parents farm. He has done contract farming and has also been a tenant farmer. In fact , prior to the traffic accident in 1985 in which he broke both of his legs , he was farming for three different people for a total of over 600 acres in Boulder County. In 1985 , neither of the Iannacitos was able to farm because of Mr. Iannacito ' s accident. However, in 1986 , Mrs. Iannacito took over her husband ' s tenant farming and continued doing that through the 1990 crop season. Clearly, the Iannacitos ' lives have been agricultrual and they would like to continue them that way as much as possible , although neither of them is able to farm themselves at the present time. From talking with Lanell Swanson after the hearing, it is my understanding that the Planning Department staff was quite surprised by your decision with regard to this Recorded Exemption. I also spoke with Lee Morrison after the hearing and explained the new information which I had received to him. I asked if it would be possible to request a rehearing and he referred me to the provision in Robert ' s Rules of Order which allows for the reconsideration of a motion at the next meeting following the original vote on the motion. The purpose of my letter is to specifically request that any or all of you move the County Commissioners as a whole to reconsider the vote on the Iannacitos ' Recorded Exemption No. 1408 . As all of you voted for the motion to deny the Recorded Exemption, it is my understanding that any one of you could bring the motion up for reconsideration at your meeting on Monday, April 20 , 1992. I would ask that each of you consider the additional information which I have provided and move for such a consideration at Monday ' s meeting. I am sorry that Wednesday ' s presentation was not as clear as I would have preferred it to have been. I did discuss the health problems with the Iannacitos, but sometimes clients are reluctant to provide as clear a picture of personal problems such as those , even when asked.
