RESOLUTION
RE: ASSESSMENT OF COSTS OF IMPROVEMENTS FOR WELD COUNTY ROAD 38 LOCAL
IMPROVEMENT DISTRICT NO. 1992-4
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, in accordance with Section 30-20-607, Colorado Revised Statutes,
as amended, a Statement of Expenses and Apportionment has been filed with the
Weld County Clerk to the Board by the Weld County Engineer, which is attached
hereto as Exhibit A, and
WHEREAS, pursuant to Section 30-20-608, there has been proper notice of
this hearing and of the costs of the improvements, and the share to be assessed
to each lot, and
WHEREAS, the Board of County Commissioners finds that the properties
described herein, which includes those properties described as all lots in
Highland Estates Subdivision as recorded on September 11, 1974, under Reception
Number 1644478; and the Si of Section 34, Township 4 North, Range 68 West; and
the NE! of Section 3, Township 3 North, Range 68 West, as conveyed to the Margil
Loving Trust by Deed as recorded on May 29, 1991, under Reception Number
02251499, all in relation to the 6th P.M. in an unincorporated portion of Weld
County, Colorado, in an area generally known as Weld County Road 38 between Weld
County Road 7 and Interstate 25, have been specifically benefitted by the
construction of the improvements authorized under the Resolution of January 6,
1993, for the following reasons:
A. The market value of each of the properties will increase;
B. The proposed improvements will adapt the property to a more
profitable use;
C. The proposed improvements will facilitate access to the each of the
properties and thereby increase the convenience of use of said
properties;
D. There will be an alleviation of fugitive dust, eliminating the
health hazards to teh benefitted properties and to users of the
public roads to be improved; and
E. The alleviation of fugitive dust will reduce maintenance costs of
the subject properties and paving will lessen the maintenance
required for a public road.
WHEREAS, copies of the resolution creating this local improvement district
have been provided to the Division of Local Government and the Weld County
Treasurer and Assessor, and

WHEREAS, at the time and place set forth in the notice, the Board of County
Commissioners met in open session for the purpose of hearing and considering any
objections and protests that might be made against the proposed assessments by
the following property owner: Gilman Olson, and
WHEREAS, the Board has determined that the two parcels belonging to Gilman
Olson are benefitted in the amount of one assessment and that equity and justice
require the apportionment of only one assessment for both parcels, and
WHEREAS, this resolution shall be prima facie evidence of the fact that the
property assessed is benefitted, the amount of the assessment, and that the
assessment has been lawfully levied.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado:
A. That a local improvement district for the construction and
installation of street improvements, to include shaping, grading,
drainage, preparation of the base and grading, compaction, and
paving, together with any necessary incidentals on certain County
roads as hereinafter described, was created and established in
accordance with the laws of the State of Colorado, and is known as
"Weld County Road 38 Local Improvement District No. 1992-4." All
proceedings heretofore taken by the Board of County Commissioners
and the County staff and then adopted in connection with the
district are hereby ratified, approved and confirmed. This proposal
to create said district was initiated by the Board of County
Commissioners by Resolution of October 19, 1992, upon a petition,
proper in form, subscribed by a majority of the owners of property
who will bear the cost of more than one-half of the total proposed
assessment in the district and notice duly given as heretofore
stated.
B. That the property to be assessed for said improvements shall be the
properties specifically benefitted by said improvements and more
particularly described as follows:
All lots in Highland Estates Subdivision as recorded on September
11, 1974, under Reception Number 1644478; and the S; of Section 34,
Township 4 North, Range 68 West; and the NEt of Section 3, Township
3 North, Range 68 West, as conveyed to the Margil Loving Trust by
Deed as recorded on May 29, 1991, under Reception Number 02251499,
all in relation to the 6th P.M. in an unincorporated portion of Weld
County, Colorado, in an area generally known as Weld County Road 38
between Weld County Road 7 and Interstate 25. The District shall
also include the rights-of-way of the County roads described herein.

C. That the Statement of Expenses and Apportionment, attached hereto
and incorporated herein by this reference as Exhibit A, has been
submitted based upon the fact that there has been completion of the
entire local improvement as previously authorized.
D. That the assessment, as set forth in the attached Exhibit B, per lot
or parcel being levied for the improvements shall be due and payable
within thirty (30) days after the effective date of this assessing
resolution. However, all such assessments may be paid at the
election of the owner in ten (10) equal annual installments of
principal together with installments of interest on unpaid
installments at an interest rate of 8 percent (8%) simple interest
per annum. The first of said installments of assessment shall be
due and payable at the same time as ad valorem property taxes for
the year 1993, due and payable in 1994, and similarly in each
successive year thereafter until all are paid in full.
E. That cost of the improvements assessed to property within the
district is $55, 000.00.
F. That the Clerk to the Board shall prepare a local assessment roll,
in cooperation with the Weld County Treasurer and Accounting
Department, in a form showing in suitable columns, each parcel of
land assessed, the total amount of assessment, the amount of each
installment of principal and interest if, in pursuance of Part 6 of
Article 20 of Title 30, Colorado Revised Statutes, the same is
payable in installments, and the date when each installment will
become due, with suitable columns for use in case of payment of the
whole amount or of any installment or penalty, and shall deliver the
same, duly certified, under the County seal, to the County Treasurer
for collection.
G. That failure to pay the whole assessment prior to December 3, 1993,
shall be a conclusive determination and held to be an election on
the part of all persons interested, whether under disability or
otherwise, to pay in such installments. All persons so electing to
pay in installments shall be conclusively held and considered as
consenting to said improvements. Said election shall be
conclusively held and considered as a waiver of any right to
question the power or jurisdiction of the County to construct the
improvements, the quality of the work, the regularity or sufficiency
of the proceedings, the validity or correctness of the assessments,
or the validity of the lien thereof.

H. That failure to pay any installment, whether principal or interest,
when due shall cause the whole of the unpaid principal to become due
and collectible immediately, and the whole amount of the unpaid
principal and accrued interest shall thereafter draw penalty
interest at the rate of one percent per month from the first day of
May until the day of payment, or until the day of sale. In
computing the amount of penalty interest due under this section, any
portion of a month shall be counted a whole month.
I. That all resolutions or parts thereof in conflict with this
resolution are hereby repealed, but all portions of the resolution
indicating the intent to create the district not in conflict with
the provisions of this resolution are re-enacted as if set forth
herein.
J. That the effective date of the resolution shall be November 3, 1993.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 3rd day of November, A.D. , 1993.

Dear Property Owner:
A mistake was made by our office in the material sent to you on November 10,
1993. The cover letter inadvertently listed 9% interest instead of 8% as the
percentage of interest. It should have corresponded with the 8% interest listed
in the Resolution. All the numbers showing principal and interest were generated
correctly, so the other documents sent to you are correct.
I apologize for any confusion this mistake may have caused. Please remember you
have until December 3, 1993 if you choose to pay the assessment in full to avoid
interest being charged.

Dear Property Owner:
The Board of Weld County Commissioners, on November 3, 1993, approved the
assessment of costs for the Weld County Road 38 Local Improvement District No.
1992-4. Pursuant to the Resolution, your lot or parcel has been assessed
$1,964.29. You may pay this amount in full, to the Weld County Treasurer prior
to December 3, 1993. When making your payment, please advise the Treasurer's
Office that the payment is for the assessment concerning Weld County Road 38
Local Improvement District No. 1992-4. If paying by mail, please send your
payment to the following address:

Should you choose not to pay in full by December 3, 1993, you may pay in ten (10)
equal annual installments of principal, together with installments of interest
on unpaid installments at an interest rate of nine percent (9%) simple interest

will be billed separately to you after January 1, 1994, along with your property
taxes. Please note that the interest will accrue in full on January 1 of each
year.

RE: WELD COUNTY LOCAL IMPROVEMENT DISTRICT
Dear Property Owner:
As property owners, you are probably aware that there are efforts to improve Weld
County Road 38, between Weld County Road 7 and Interstate 25.
This is to notify you that a meeting with the Board of County Commissioners
concerning the Local Improvement District will be held at 10:00 a.m. on
Wednesday, November 18, 1992, in the First Floor Hearing Room, Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado. The purpose of this
meeting will be to consider the adoption of a preliminary order and preliminary
plans and specifications, which would describe the materials to be used, the
number of installments and the period of time in which the cost of improvements
shall be payable and the property to be assessed. The preliminary order will
also contain the cost estimates and approximate amount to be assessed on each
property. A great deal of this information is now contained in your petition.
You are encouraged to make your feelings known either through your appearance at
the meeting, through a power of attorney to another person so that he may testify
on your behalf, or you may submit a letter, prior to the hearing, to the Board
of County Commissioners, P.O. Box 758, Greeley, Colorado 80632.

Ali owners of real estate and property hereinafter described and all persons
generally, are hereby notified that the Board of County Commissioners of Weld
County, Colorado, has received a Notice of Completion, Statement of Expenses, and
Apportionment regarding the Local Improvement District within unincorporated Weld
County, Colorado, designated as Weld County Road 38 Local Improvement Diisrrict.
No,. 1992-4, all in accordance with the laws of the State of Colorado. The
property within the Local Improvement District is described as follows:
All lots in Highland Estates Subdivision as recorded on
September 11, 1974, under Reception Number 1644478; and
the Si of Section 34, Township 4 North, Range 68 West;
and the NE of Section 3, Township 3 North, Range 68
West, as conveyed to the Margil Loving Trust by Deed as
recorded on May 29, 1991, under Reception Number
02251499, all in relation to the 6th P.M. in an
unincorporated portion of Weld County, Colorado, in an
area generally known as Weld County Road 38 between Weld
County Road. 7 and Interstate 25. The District shall
also include the rights-of-way of the County roads
described herein.
1. All persons are further notified that the whole cost of the improvements
as has been completed is $60, 493.65 which excludes any costs which have
been assumed by the County in terms of engineering and administrative
fees. The costs to be apportioned to the landowners are the costs of the
labor and materials for installation of hot bituminous pavement and base
preparation, which is to be apportioned equally among the 28 lots,
parcels, and tracts in an apportionment of $1, 964.29 per lot or tract,
based upon the maximum allowed to be assessed to the District of
$55,000.00. No portion of the costs will be paid by a district-wide sales
tax.
2. Any owner of the affected lots may file a complaint or objection in
writing addressed to the Weld County Board of County Commissioners, 915
10th Street, P.O. Box 758, Greeley, Colorado 80632, which objection must
be filed within twenty (20) days from the publication date of this notice .
Any complaint or objection properly made will be heard and determined by
the Board of County Commissioners before the passage of any Resolut_' on
assessing the costs of the improvements.
3. The hearing where such complaints or objections will be heard will be on
the 3rd day of November, 1993, at or about 9:00 a.m. , in the First. Floor
Meeting Room of the Centennial Center, 915 10th Street, Greeley, Colorado.
