RE: ADOPTION OF ROAD AND BRIDGE POLICY NO. 12 CONCERNING EXPENDITURE OF WELD
COUNTY FUNDS FOR CONSTRUCTION, UPGRADING, PAVING, AND/OR MAINTENANCE OF
STREETS, ROADWAYS, AND/OR HIGHWAYS WITHIN INCORPORATED MUNICIPAL
BOUNDARIES AND INCORPORATION OF SAID POLICY INTO THE WELD COUNTY
ADMINISTRATIVE MANUAL
WHEREAS, the Board of County Commissioners of the County of Weld, State of
Colorado, pursuant to Colorado Statute in the Weld County Home Rule Charter, is
vested with the authority of administering the affairs of Weld County, Colorado,
and
WHEREAS, a municipality located within Weld County, Colorado, has requested
that Weld County expend funds for the construction, upgrade, paving, and/or
maintenance of certain streets, roadways, and/or highways located within its
incorporated municipal boundaries, and
WHEREAS, the Board deems it advisable to deny said request on the basis
that all County funds designated for construction, upgrading, paving, and/or
maintenance of streets, roadways, and/or highways should be used on such rights-
of-way located within Weld County but outside of the incorporated boundaries of
municipalities, and
WHEREAS, the Board adopted a set of eleven comprehensive Road and Bridge
policies on June 1, 1989, which are set forth in the General Administration
Section of the Weld County Administrative Manual, and
WHEREAS, the Board now deems it advisable to adopt a policy wherein it
states that no County funds will be spent for the construction, upgrading,
paving, and/or maintenance of streets, roadways, and/or highways located within
incorporated municipal boundaries and to incorporate said Policy into the General
Administration Section of the Weld County Administrative Manual as the twelfth
Road and Bridge policy.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the
County of Weld, of the State of Colorado, that the following Policy be, and
hereby is, adopted:
12. Expenditure of County Funds for the Construction, Upgrade, Paving,
and/or Maintenance of Streets, Roadways, and/or Highways located
within Incorporated Municipal Boundaries:
No Weld County funds shall be spent on the construction,
upgrade, paving, and/or maintenance of streets,
roadways, and/or highways located within incorporated
municipal boundaries, with the exception of funds which
are reimbursed to Weld County, Colorado, on a dollar-
for-dollar basis, and with the exception of funds
provided (or services in lieu thereof) to municipalities
by Weld County pursuant to Section 43-2-202, CRS.

BE IT FURTHER RESOLVED by the Board of County Commissioners that the above
stated policy shall be incorporated into the General Administration Section of
the Weld County Administrative Manual.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 12th day of February, A.D. , 1992.
