RESOLUTION
RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING SPECIAL REVIEW PERMIT
#793 - GATES
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, on March 2, 1994, a Show Cause Hearing was conducted to consider
revocation of Special Review Permit #793, originally issued to John E. and
Carolyn J. Fitch, for a greyhound dog kennel (20 dog maximum) , and
WHEREAS, at said hearing on March 2, 1994, the Planning staff advised the
Board that Development Standard #7 states the permit is not transferable upon
conveyance or lease of said property to others, and
WHEREAS, Shirley L. and Jerrilyn J. Gates are the current owners of the
facility located on property described as Lots 1 and 2, Block 46, Aristocrat
Ranchettes, Weld County, Colorado, and
WHEREAS, after hearing all testimony presented, the Board deemed it
advisable to revoke Special Review Permit #793.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Special Review Permit #793, originally issued to John E.
and Carolyn J. Fitch for a greyhound dog kennel (20 dog maximum) be, and hereby
is, revoked.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 2nd day of March, A.D. , 1994.

The following business was transacted:
I hereby certify that pursuant to a notice dated February 16, 1994, and
duly published February 24, 1994, in the Windsor Beacon, a public hearing
was conducted to consider the revocation of USR #793, which was originally
issued to John E. and Carolyn J. Fitch for a greyhound dog kennel (20 dog
maximum) . Lee Morrison, Assistant County Attorney, made this a matter of
record and noted the property is now owned by Shirley L. and Jerrilyn J.
Gates. Keith Schuett, Planning Department representative, noted
Development Standard #7 does not allow the Special Review Permit to be
transferred upon conveyance or lease of the property to others. Mr.
Schuett was notified by phone the attorney representing Shirley and
Jerrilyn Gates would not be present today; however, they are applying for
a Special Review Permit for said property. He recommended revocation of
said permit. At the request of Mr. Morrison, Mr. Schuett reviewed the
other items that are not in compliance with said permit. No public
testimony was offered concerning this matter. Commissioner Hall moved to
find cause and revoke Special Review Permit #793, originally issued to
John E. and Carolyn J. Fitch for a greyhound dog kennel (20 dog maximum) ,
which property is now owned by Shirley L. and Jerrilyn J. Gates, based on
the recommendations of the Planning staff. The motion was seconded by
Commissioner Kirkmeyer, and it carried unanimously.
This Certification was approved on the 2nd day of March, 1994.

dogs permitted is 20.
The property is not being maintained in compliance with the application materials as
submitted and on file in the Department of Planning Services. The application was
fox a greyhound kennel. Many other types of dogs were observed at the windows of the
mobile -home while knocking at the door to obtain permission to inspect the property.
Development Standard Number 7 stat-es:
The Use by Special Review permit shall not be transferable to any successors
in interest to the described -property and shall terminate automatically upon
conveyance or lease of the property to -others.
The property has been transferred from John E. and Carolyn J . Fitch, to Shirley L.
Gates, and Jerrilyn J . Gates. Tte warranty deed for thin transfer of ownership is
recorded in Book 1407, -Reception 02355691. A copy of this warranty deed is attached
to this case file.

SUBJECT: USR-793, located on Lots 1, and 2, Block 46, Aristocrat Ranchettes,
Weld County, Colorado.
A Special Review permit (USR-793) was approved by the Board of County
Commissioners on August 19, 1987. The permit was for a greyhound kennel for a
maximum of 20 dogs. At the hearing the board added Development Standard Number
7, that made this Special Review permit nontransferable.
A detailed inspection of the property was not accomplished due to the fact that
no one has been home at the time of the inspections. Notices and business cards
have been left on the property requesting inspections .
Based on the visits to the property and what was observed while knocking at the
door requesting permission to inspect, letters that have teen returned,
observation of the property from the -public rights-of-way, and Warranty Deed
recorded in Book 1407, Reception Number 02355691, the following report is made.
The property is not in compliance with the fallowing development standards.
Development Standard Number 1 states:
