RE: CONTINUE HEARING CONCERNING ISSUANCE OF CERTAIN COUNTY
QUALIFIED PRIVATE ACTIVITY BONDS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on July 11 , 1990 , a public hearing was conducted to
consider the proposed issuance by the County of qualified private
activity bonds for Waste Services Corporation, and
WHEREAS, the Board was advised at said hearing that the
applicant does not yet have a statement from his principal banker
that the debt can be serviced as proposed, and
WHEREAS, the Board deems it advisable that said hearing be
continued to July 25 , 1990 , at 10:00 a.m. to allow the applicant
to obtain the necessary documentation.
NOW, THEREFORE, BE IT RESOLVED by the Board o£ County
Commissioners of Weld County, Colorado, that the hearing
concerning the proposed issuance by the County of qualified
private activity bonds for Waste Services Corporation be, and
hereby is, continued to July 25 , 1990 , at 10 : 00 a.m.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 16th day of
July, A.D. , 1990 .

RE: ISSUANCE OF COUNTY QUALIFIED PRIVATE ACTIVITY (SOLID WASTE
DISPOSAL REVENUE) BONDS
A public hearing was conducted on July 11, 1990, at 9:00 A.M. , with the
following present:
Commissioner Gene R. Brantner, Chairman
Commissioner George Kennedy, Pro-Tem
Commissioner Constance L. Harbert
Commissioner C.W. Kirby
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Tommie Antuna
Assistant County Attorney, Lee D. Morrison
Director of Finance and Administration, Donald D. Warden
The following business was transacted:
I hereby certify that pursuant to a notice dated June 27, 1990, and
duly published June 28, 1990, in The New News, a public hearing was
conducted to consider the issuance of County Qualified Private Activity
(Solid Waste Disposal Revenue) Bonds. Donald Warden, Director of
Finance and Administration, made this matter of record. The proposed
issuance of these Bonds is to be in an aggregate principal amount not
to exceed $3,500,000 to refund the County's Industrial Development
Revenue Bonds, Series 1980, and to finance the acquisition,
construction and installation of land and equipment for, and as an
additional solid waste disposal facility, for Waste Services
Corporation. He said this is being considered in accordance with
Ordinance No. 69-A, and this Ordinance contains three criteria. Mr.
Warden said the Planning criteria has been complied with; and the
proposal meets all of the legal criteria of the State and Federal
governments. He said the third criteria concerns the financial aspects
of the proposed issue. The applicant does not meet that criteria at
this time because it requires written documentation from the principal
banker of the applicant that the debt can be serviced as proposed. The
applicant has a statement from United Bank, but that has been
withdrawn. Mr. Warden said the applicant has requested a continuance
to July 25, 1990, so he can see if financing can be secured. Brad
Keirnes, president of Waste Services Corporation, said he has now
retained another investment banker, but negotiations have not been
concluded. Mr. Keirnes described the proposed facility to the Board.
There were no public comments offered concerning this matter.
Commissioner Lacy moved that this hearing be continued to July 25,
1990, at 10:00 A.M. Commissioner Kirby seconded the motion, and it
carried unanimously.
Mr. Warden stated for the record that the two things required are: a
commitment for purchase of the bonds; and a letter from the principal
banker indicating, with the terms of the purchase, that they can
service the debt.
