RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NO. 1499 - YOUNG WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption No. 1499, submitted by Wallace G. Young, for property which is located in part of the SE,'- of Section 12, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 2 acres and 3 acres, and WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the folloiwng reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Ordinance #173 as defined in Section 1.3. 2. The Board feels this division would be inconsistent with efficient and orderly development. 3. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. 4. It is the opinion of the Board that any further division of these lots will create additional accesses onto Weld County Road 70 and will increase the density of the existing linear subdivision. 5. The Board feels this proposal increases the need for more urban-type services in the area. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Recorded Exemption No. 1499, submitted by Wallace G. Dear Commissioners: This request for a recorded exemption is submitted by Wallace G. Young. The parcel of land on which this request is being made is described as part of the SE4 of Section 12, T6N, R65W of the 6th P. M. , Weld County, Colorado. The property is located approximately two miles southwest of the Town of Galeton on Weld County Road 70. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of two and three acres, more or less. The applicant wishes to retain the larger parcel, build a house for himself and sell the smaller parcel which presently has a home upon it. The larger parcel would require an access permit from the Weld County Engineering Department for access from Weld County Road 70. The smaller parcel would have adequate access, and both parcels would have adequate frontage on Weld County Road 70. The application indicates the present use of the property is raising animals, and the use will remain the same after the split. The property is presently a dryland five acre farm. 930491 Recorded Exemption 1499 May 20, 1993 Page 2 Based upon the submitted information and policies of the county, the Department of Planning Services staff recommends the request be denied for the following reasons: The applicant has not demonstrated that the proposal is consistent with efficient and orderly development. The five acres under consideration are already 94% below the established minimum lot size of 80 acres. There is a high level of development in the area with 11 small acreages within 3/4 miles of the proposed recorded exemption. Within Section 12, T6N, R65W, there are presently 14 parcels. Section 11, 1/2 mile to the west of the applicant, has 16 parcels. Further divisions of the land in this area will create higher demand on county services. The staff is concerned about the level of development that has occurred in this area and the potential for continued divisions. The Board should consider whether it wants to allow this type of piecemeal development to continue. Continued divisions of this type may evade the intent and purpose of the Weld County Subdivision Regulations. The staff recommends the Board of County Commissioners deny this request. Sincerely, Greg ompson Current Planner GT/sfr 920191 BK: I guess . . . efficient and orderly development would be, just looking at your own map, all this development that has been occurred in this area has basically been piecemeal as you can tell by the different acres. It's not planned, it's not orderly because you have piecemealing all over the whole, all three sections, which makes it not very efficient because we have accesses, well as you stated one even accesses onto both roads, 49 and 17. It makes it harder for the county to provide services. Also, recorded exemptions are a process in the agricultural district for 3 reasons. The intent is: 1. To provide the property owner who is retiring an opportunity to live on the existing farm. enable the property owner to sell off agricultural land that is non-productive enable the property owner to provide residence for direct members of the farm family. Those are the, that is the intent of the policy for recorded exemption in an agricultural district. WY: This piece of property we're talking about is non-productive and can't be used for anything else. BK: I believe that's probably correct, and that's why the first exemption with the five acres was recorded back in 1968. BK: Madame Chairman, I would make a motion that we deny Recorded Exemption 1499 because, again, I cannot, I can only speculate as to what the actions of the past Board of County Commissioners has been, or why they've done things. But, I cannot feel that this type of development, all the piecemealing that is going on in these 3 sections that we have here in front of us is efficient or orderly and it just provided a higher demand upon services from the county out to these rural areas. 9'30I91. CONDITIONS OF APPROVAL Wallace C. Young RE-1499 1. The applicants shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. A Weld County septic permit is required for the proposed home and the septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) Regulations. 3. An Individual Sewage Disposal System permit must be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. 4.
