Tr NZ N µ O W a NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld z County, Colorado, that the Board of County Commissioners: rn oHI a) Accepts the right, title, and interest to all of Keota's � inventory, including personal property and stock, and GI including cash on hand in Highway Users Tax Fund accounts and general fund accounts as set forth in the inventory list which is attached hereto as "Exhibit B." b) Accepts the right, title, and interest in all real property and the improvements thereon as set forth in the attached "Exhibit C. David applied to p % the Secretary of State for a determination of abandonment of the Weld County it W a town of Keota. O U 2) Notice of the abandonment application was published on January 3, 1991 o in the Greeley Dally Tribune, a newspaper of general circulation in Weld County. 0 — a 3) It appeared from the testimony of County Attorney David that only five ti W people live in Keota at present and that no elections have been held there for a at least five years. al U Z 4) It appeared from the testimony of Department of State Elections W Division staff assistant Michele Burton that the Division has no record of any Mo election held in Keota, and that the Division's records go back more than five x years. Lop `1-) W N 5) It appeared from the testimony of Don Sandoval , of the Department of w Z Local Affairs, that , in accord with his communications with two of the residents N Z of Keota and his own observations, residents are too few to take care of the o official business of an incorporated municipality. PG a 6) All testimony received showed that Keota has failed to hold any regular or special election or to elect officers and maintain town government for at rn NI least the five years immediately prior to the making of the application referred c� r to at 1 ) above. No evidence or argument to the contrary was presented. RI w 7) In light of the foregoing findings and in accord with C.R .S. 31-3-201 , the town of Keota is abandoned. WHEREFORE I , Merilyn L . The undersigned (hereinafter called the "Applicant") hereby applies for membership in and agrees to purchase electric energy from Morgan County Rural Electric Association (hereinafter called the "Coopera- tive"), and hereby subscribes for one (1) share of the capital stock of the Cooperative of the par value of five dollars ($5.00), under the following terms and conditions: 1. The Applicant will, when electric energy becomes available, purchase from the Cooperative all electric energy used on the premises described below and will pay therefor monthly or annually at rates to be determined from time to time in accordance with the by-laws of the Cooperative; provided, however, that the Cooperative may limit the amount of electric energy to be furnished for industrial uses. 2. The Applicant will comply with and be bound by the provisions of the charter and by-laws of the Cooperative, and such rules and regulations as may from time to time be adopted by the Cooperative. 3. The Applicant by paying a membership fee and becoming a member, assumes no personal liability or responsibility for any debts or liabilities of the Cooperative, and it is expressly understood that under the law his private property is exempt from execution for any such debts or liabilities. The acceptance of this application by the Cooperative shall constitute an agreement between the Appli- cant and the Cooperative, and the contract for electric service shall continue in force for one year from the date the service is made available by the Cooperative to the Applicant, and thereafter until cancelled by at least 30 days' written notice given by either party to the other. Notwithstanding anything herein contained, the Applicant expressly agrees that the Cooperative may, prior to the acceptance of this application, use the $5.00 for the development of a rural electrification project. If the Cooperative is unable to obtain a loan from the Rural Electrification Administration to finance the construction of such a project the Applicant agrees that only so much of the $5.00 as has not been expended for development expenses will be returned to him. If the Cooperative succeeds in establishing a rural electrification project but is unable to furnish service to the Applicant, the sum of $5.00 will be returned to the Applicant. 4.
