RE: APPROVAL OF RECORDED EXEMPTION #1670 - REED
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1670, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1670 was submitted by Clarence and
Vivian Reed, 306 South 3rd Street Court, LaSalle, Colorado 80645, for property which is located
in part of the N 1/2 NE 1/4 of Section 8, Township 4 North, Range 64 West of the 6th P.M., Weld
County, Colorado, being more particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
10 acres and 70 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption#1670 submitted by
Clarence and Vivian Reed be, and hereby is, approved conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
2. Prior to recording the plat, the following note shall be placed on the plat:
"No more than one residential access shall be allowed per
legal parcel."
3. The following note shall be placed on the recorded exemption plat prior to recording:
"No residential access shall be allowed onto Weld County
Road 53."

4. A Weld County septic permit is required for the proposed home, and its septic
system shall be installed according to the Weld County Individual Sewage Disposal
System (ISDS) regulations. An ISDS evaluation by the Weld County Health
Department on all existing septic systems will be necessary prior to issuing the
required septic permits on the existing systems.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 14th day of November, A.D., 1994.

The following notes shall be placed on the recorded exemption plat prior to recording: 1. No more

A Weld County septic permit is required for any proposed home. The septic system shall be

the Weld County Health Department shall require an Individual Sewage Disposal System
Evaluation.

5 . If it is determined that public facility or service improvements or
maintenance are required by a development, the developer will ' be
required to pay for the costs of the public facility and service
improvements and maintenance. The methodology for compensation shall
be determined during the land-use application review process.
. The developer shall submit the following:
(1) information which accurately identifies all users of the
infrastructure improvements and maintenance;
(2) a proposal which equitably distributes the costs of infrastructure
improvements and maintenance by user share; and
(3) a proposal that identifies the appropriate time that
infrastructure improvements and maintenance charges should be
applied.
This information shall be reviewed by the Board of County Commissioners
in determining an equitable means of distributing infrastructure costs
among the County at large, direct users, and the developer.
! 6. A municipality's adopted comprehensive plan goals and policies will be
considered when an agricultural business is proposed to be located
within an urban growth boundary area.
7. A process that allows a lot in the agricultural district to be divided
into two separate lots will be established. The intent of this policy
is to:
I A. Enable the property owner who is retiring an opportunity to live "
on or sell the existing farm improvements. .
B. Enable the property owner to sell off agricultural land that is

nonproductive for one single family dwelling homesite.
C. Enable the property owner to provide a residence for direct

members of the farm family and also for workers employed at the
farm.
Agricultural districts located outside of am- urban growth boundary .
area or the I-25 mixed-use development corridor are expected to remain
predominantly agricultural. Low density single family residential
development may be permitted but is not encouraged. These rural

Subject: RE-1670, Recorded Exemption, being part of the N2 NE4 of Section 8, T4N, R64W,
6th P.M., Weld County, Colorado.
Dear Commissioners:
This request for a recorded exemption is submitted by Clarence and Vivian Reed. The parcel of
land on which this request is being made is described as the N2 NE4 of Section 8, T4N, R64W of
the 6th P.M., Weld County, Colorado. The property is located south of and adjacent to Weld
County Road 48 and west of and adjacent to Weld County Road 53. This request is to divide a 80
acre parcel into two parcels of 70 acres and 10 acres. The subject property was part of a 160
parcel, 80 acres was sold on August 26, 1994, to Kenneth C. Jones, who is also applying for a
Recorded Exemption (RE-1671). Currently the proposed 10 acre parcel, Lot A, contains a
farmhouse, barn, shop, garage, and corrals. The proposed 70 acre parcel, Lot B, is vacant
farmland with one tank battery. The applicant indicated within the application materials that he
plans to build a new home on Lot B and continue a farming operation. Lot A is proposed to be
used as a home and rural agricultural tract.
The applicant indicated in his application that the property has not been properly operated in the
past due to financial reasons and that he intends to restore the property to its previous productive
state and operate it with good management principles. In telephone conversation with the applicant
he indicated that he does not have water rights to the property and that he does not intend to farm
the land, and he plans to use it as dry land pasture. The water rights for the subject property were
sold October 8, 1986. The Non-Irrigation Covenant states that water rights may be leased from
the Grantee to irrigate the farm. If irrigated, the subject property could be restored to its original
productive state which the applicant stated in the application.
Access to proposed Lot A is existing from Weld County Road 48 and Weld County Road 53.
Access to proposed Lot B is existing from Weld County Road 53. The Weld County Department
of Public Works has stated that only one main access per legal parcel shall be utilized. Proposed

Lot B has two tank battery accesses and one agricultural access. Proposed Lot A has two
residential accesses. One access is onto WCR 53 and the other onto WCR 48. Central Weld
County Water District is the proposed water service along with septic systems proposed for sewage
disposal on both Lots A and B.
The Department of Planning Services' staff has concerns that the proposed division is inconsistent
with efficient and orderly development and with the agricultural goals and policies as stated in the
Weld County Comprehensive Plan. The Comprehensive Plan allows a lot in the A (Agricultural)
zone district to be divided into two separate parcels if the intent of the recorded exemption is met.
This applicant however, is not able to satisfy any of the three established criterion. This request,
if approved, would allow for a residence on Lot B, greatly intensifying the residential uses on the
property thus reducing the area of agricultural farm ground. The Comprehensive Plan promotes
preserving the agricultural use of farm ground.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this proposal and determine if the standards of Sections 11.5.1 through 11.5.7 of the Weld
County Subdivision Ordinance have been met.

RECORDED EXEMPTION QUESTIONNAIRE
1 . Explain the reason for the proposed recorded exemption and how
each proposed lot will be used.
The reason for this Recorded Exemption proposal is to separate
existing improvements and approximately 10 acres from the balance
of the 80 acre farm. We are planning to build our new home on the
70 acres which remains . The proposed Lot A will continue to be
used as a home and rural agricultural tract, the proposed Lot B
will continue to be used as a farm. The subject property has not
been properly operated in the past due to financial problems of the
previous owner. We intend to begin the process of restoring the
subject property to its previous productive state and operate it
with good management principles .
2 . Describe the location, size and present use of the area where
each proposed new lot will be created.
The subject property is located approximately 3 1/2 miles South of
Kersey at the intersection of Weld County Roads 53 and 48 .
Proposed Lot A will be approximately 10 acres in size an.d proposed
Lot B will consist of 70 acres more or less . The present use which
exists in the area is irrigated farming and other agricultural
uses.
3 . Explain how the proposal is consistent withe the Weld County
Comprehensive Plan and any adopted municipal plan, if
applicable.
This proposal is consistent with the Comprehensive Plan of Weld
County in the division of non-productive agricultural property.
4 , Explain how the uses permitted will be compatible with the
existing uses surrounding the proposed recorded exemption.
The uses permitted on both of the proposed lots will be those
currently in place and allowed under the Agriculture zoning.
Uses on the surrounding properties is the same as those utilized on
the subject proposed Lots A & B. These uses are consistent and
very compatible with the area and will positively impact the
appearance of both proposed Lots A & B and the surrounding area.
No change of use or zoning is sought.
5 . Explain how the proposal is consistent with the intent of the
zoning district it is located within.
This proposal is consistent with the intent of the Agricultural
zoning currently in place which allows uses and activities related
to agriculture. Both of the proposed Lots A & B will continue to
be used in a fashion consistent with past uses, no changes in
zoning and or use are required or anticipated.
6 . Explain how the proposal is consistent with efficient and
orderly development.
This proposal is consistent with existing uses in the area and
would not have a negative impact on the efficient and orderly
developement of the area in any way. This proposal would create
lots which are suitable to and blend in well with the surrounding
area and its current uses .
7 . Explain how adequate provision for the protection of the
health, safety, and welfare of the inhabitants of the
neighborhood and the County will be acomplished.
By adhereing to and following all ordinances, regulations , and
requirements as set forth by Weld County. Proper water sources and
sewage disposal methods are or will be installed, access to both
proposed Lots A & B exist from Weld County Roads 48 & 53, and
sufficient utilities are available to adequately serve the
property.

# 6 rebar. Apparently the existing monument was not removed and replaced as required
by Board Rules . It appears that the # 6 rebar was driven in on the North side of the
existing # 4 rebar.
