No. 52 Weld County AGREEMENT TO PARTICIPATE IN THE COST OF HIGHWAY IMPROVEMENT • THIS AGREEMENT entered into this 25th day of April, 1951, by and between 'the COLORADO STATE HIGHWAY DEPARTMENT, hereinafter .called the "Department," and the COUNTY OF'WELD, hereinafter called the ”County,“ WITNESSETH •that WHEREAS the Department has included'4n the Budget for 1951 dated December 19, 1950, a Federal Aid Secondary Project to consist of improvements on State Highway - No.-52, beginning atfnudson-andextending-easterly, for-which the'sumTof-$100,000;00-- has been'allocated, and '1n which the County'has previously agreed to participate to the extent of twenty five (25) per cost of the project, NOW, THEREFORE, in consideration.of the premises and'the mutual covenants 'and agreements herein contained, and the faithful'performance thereof, the parties hereto promise and agree as follows: 1. ' The Department'will prepare the plans, specifications end estimates for - the work, will advertise for bids, will award -the;contract, prepare the monthly and final estimates, and pay the contractor according thereto. .Also, •the Depart- ment will arrange for-the force account work by railroad, utility and irrigation companies. 2. ' The Cbunty'will secure at'its own expense all right of way required for project, as indicated by right of way linesiahown on,project construction plans. '3. It is the intent of this Agreement that the 'County will reimburse the Department'in--the amount of`twenty-five,"(25) pet:cent of-the-final cost7of-the- Project, exclusive of right of way, end'-with the understanding that the charges for Engineering will not. exceed' six' (6) per cent of the construction-cost. If after bids are received'it appears that the final cost will be materially in excess of the budgeted amount-above named, any obligation of the County- in excess of $25,000.00 will be subjected to negotiation. • 4. ' The Department will submit each month a statement covering twenty five •(25) per-cent of the cost:of the construction work-on the project as represented •by the.progress estimate paid to-the'contractor.. This will not include any charges for engineering, which charges' will'be billed when the project is completed and 'final estimate made. The'County agrees- to' promptly pay approved statements submit- ted.'as. per this. paragraph. '5. The County further agrees that-when the'project'is completed' and ready ' for'traffic, the County will maintain the same in-a satisfactory manner, and if said- project-is not so, maintained the Department is authorized to do. said mainten- ance with its own forces-and to bill' the County for the cost 'thereof. L. 1947, sufficieAt funds to cover the delinquent payment'-or'payments. - 1 - 11- h/ 6. This Agreement shall not be deemed valid until it shall have been ap- proved by the Controller of the State of Colorado, or by such assistant as he may designate. • 7. This Agreement shall be binding upon and inure to the henetit of the successors and assigns of the parties hereto, respectively. • • 8. Young Weld County Agreement We enclose seven copies of agreement dated April 25, 1951, between Weld County and this Department covering additional funds appropriated for construction of Project 8 0030 (2), Hudson - Sisterly, with the County participating to the extent of 25$ of the cost. Please have the County sign and return five copies of the agreement with the customary resolution along with the attest and seal of the County Clerk.
